HomeMy WebLinkAboutCity Council - 1904 RESOLUTION No. 1904 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH GIVING NOTICE OF PROPOSED ANNEXATION TO THE CITY OF HUNTINGTON BEACH OF THAT CERTAIN UNINHAB- ITED TERRITORY DESCRIBED AS "BOLSA CHICA #4 ANNEXATION" AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH: Section 1. That pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939", a petition was signed b-r owners of not less than one-fourth of the land in the hereinafter described territory by area and by assess- ed value as shown on the last equalized assessment roll of the County of Orange, was filed with the Council of the City of Huntington Beach on January 6, 'I964 , requesting annexa- tion of the hereinafter described territory to said City; that said territory which said petitioners .request be annexed to the City of Huntington Beach and which said City and its Council propose to annex to the City of Huntington Beach is situate in the County of Orange, State of California, hereby designated, BOLSA CHICA #4 ANNEXATION and is described as follows: I 1. Res. No. 1904 Beginning at an angle point in the existing boundary of the City of Huntington Beach as established by Ordinance No. 944, said angle point being the inter- section of a line parallel with and Southerly 30-00 feet from the centerline of Warner Avenue, with the West line of Lot 1 in Block 20 of. said Tract No. 86, said West line also being the centerline of Green Street; thence North OP 44' 30" West 30-00 feet along the Northerly prolongation of said West line of Lot 1 in Block 20, to said centerline of Warner Avenue; thence North 00 401 00" West 1320,.66 feet along the West line, and its Southerly prolongation, of Block 16 of said Tract No. 86, to the Northwest corner of said Block 16; thence North 890 39' 30" East 690.06 feet along the North line of said Block 16, and its Easterly pro- longation, to its intersection with the existing bound- ary of the City of Huntington Beach as established by said Ordinance No. 944, said existing boundary being parallel with and Easterly 30-00 feet from the cuter- line of Bolsa Chica Street; thence along said existing boundary the following courses, South 00 401 00" East 1150.33 feet to the Easterly prolongation of the North- ly line of the land described in the lease between Edward N. Howell Company, Lessor, and Socony Mobil Oil Company, Lessee, recorded May 23 , 1962 in Book 6118, Page 910 of Official Records ; thence South 890 39' 30" West 215-00 feet along said prolongation and said North- ly line to the Northwest corner of said land; thence Res. No. 1904 South Oo 40' 00" East 200.33 feet along the Westerly line, and its Southerly prolongation, of said land, to a line parallel with and Southerly 30.00 feet from said centerline of Warner Avenue; thence South 89' 39' 30" West 475.06 feet along said parallel line to the Point of Beginning. Res. No. 1904 Section 2. That the County Boundary Commission of Orange County, California, did in session duly assembled on December 2, 1963, approve the proposed annexation of bounda- ries of said "Bolsa. Chica #4 Annexation" as above described, and as submitted to said Commission by the proponents of said annexation of said territory to said City. Section 3. That February 17, 1964, at the hour of 8:00 o'clock P.M. of said day, in the Council Chambers in the City Hall in the City of Huntington Beach, County of Orange, California, is hereby fixed as the time and place when and where any person owning property within the uninhab- ited territory above described and proposed to be annexed to the City of Huntington Beach and having any objection to the proposed annexation may appear before the Council of the City of Huntington Beach and show cause why such uninhabited territory should not be so annexed to said City of Huntington Beach. Such protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property in general terms. Section 4. The City Clerk of the City of Huntington Beach is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not often- er than once a week, in the "Huntington Beach News", a news- 2. No. 1904 paper of general circulation published in said City of Hunt- ington Beach, the City to which it is proposed to annex the aforesaid territory, and also in the "Westminster Herald", a newspaper of general circulation published outside the City of Huntington Beach, but in the County of Orange, Calif- ornia, the county in which is located the territory proposed to be annexed to the City of Huntington Beach, said publica- tion to be complete at least twenty (20) days prior to the date set for hearing. Section 5. And the said City Clerk is further author- ized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above proceedings were initiated, at the addresses shown on the said assessment roll or as known to said Clerk, and to any person who has filed his name and address and the designa- tion of the lands in which he has any interest; either legal or equitable with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. Section 6. In the event any land within the territory proposed to be annexed is owned by a county, the said City Clerk is directed to cause written notice of such proposed Res. No. 1904 annexation to be mailed to the Board of Supervisors of such County, such notice to be given not, less than twenty (20) days before the first public hearing on the proposed annexa- tion. Section 7. The said City Clerk Is directed to cause written notice to be given to such other person's as may be legally entitled thereto in the manner required by law.
