HomeMy WebLinkAboutCity Council - 1914 RESOLUTION No. 1914 AN ORDER OF THE CITY COUNCIL VACATING A PORTION OF WARD STREET IN THE CITY OF HUNTINGTON BEACH WHEREAS, the City Council of the City of Huntington Beach, California, did by unanimous vote on the 2nd day of December, 1963, at a regular meeting of said body, regularly and duly adopt Resolution No. 1884, entitled, "A Resolution of the City Council of the City of Huntington Beach to vacate a portion of Ward Street in said City and giving notice of hearing on said vacation"; and WHEREAS, the City Council of the City of Huntington Beach did elect to proceed under the provisions of the Street Vacation Act of 1941; and WHEREAS, the portion of the street to be vacated lies within the City of Huntington Beach and is not a portion of a state highway; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach, by one insertion on the 5th day of December, 1963; and 1. Res. No. 1914 WHEREAS, said resolution contained a notice that the 6th day of January, 1964, at the hour of 8:00 o'clock P.M. in the Council Chamber in the City Hall, Huntington Beach, was the time and place when and where a public hearing was to be held upon said resolution of intention, at which hearing all persons interested in or objecting to the proposed vacation may be heard: and WHEREAS, notice of street vacation was posted as required by law; and WHEREAS, there were no protests or persons appearing against said proposed street vacation at said hearing; and WHEREAS, the City Council of the City of Huntington Beach finds and determines from all evidence submitted that the portion of Ward Street described in said Resolution No. 1884 is unnecessary for present or prospective public street purposes; NOW, THEREFORE, the City Council of the City of Huntington Beach hereby resolves as follows: Section 1. That it is ordered that that portion of Ward Street in the City of Huntington Beach, described as: That portion of Ward Street as described in the Stearns Rancho Reservations recorded in 1898 in Book 30, page 112 of Deeds, and in 1902 in Book 30, page 361 of Deeds, Records of Orange County, California; said portion being more par- ticularly described as follows: A strip of land 40 feet in width, lying 20 feet on either side of the North-South one quarter (NS 1/4) section line of Section 5, Township 6 South, Range 10 West, San Bernardino Base and Meridian, being bounded on the North by the East- West one quarter (EW 1/4) section line of above described Section 5 and being bounded on the East by the West line of the Santa Ana River, be and the same is hereby vacated for public street purposes. 2. Res. No. 1914 Section 2. That the City Clerk is hereby authorized and directed to cause a certified copy of this Order, attested by the Clerk under the seal of this City, together with a certified copy of Resolution No. 1884 to be recorded in the office of the County Recorder of Orange County, California.
