RESOLUTION NO. 1962 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO VACATE A PORTION OF TWO U14NANTED STREETS IN THE W. T. NEWLAND TRACT IN SAID CITY AND GIVING NOTICE OF HEARING ON SAID VACATION, WHEREAS,, the streets below described are not on the Master Plan of Arterial Highways; and WHEREAS, these streets will interfere with a proposed development; and WHEN , these streets are shown on a map but are not specifically dedicated to any public agency; and WHEREAS., the City Council desires to vacate all public interest in those portions of the streets as hereinafter described: NOW, THEREFORE, the Cit.- Council of the City of Huntington Beach, California, does resolve, determine, find and declare as follows: Section 1. The City Council of the City of Huntington Beach does hereby declare its intention to vacate all public interest in those portions of the streets, within the City of Huntington Beach, described as follows: Those portions of streets in the W. T. Newland Tract, in the City of Huntington Beach, County of Orange, ;State of California, as per map recorded in book 4, page 56 of Miscellaneous Maps, in the office of the County Recorder of said Orange County, described as follows: l •. Resolution No. 1962 PARCEL 1: The West 20 feet of the street adjoining Dots 1320, 1420, 1520 and 1620 on the East, lying between the Easterly pro- longation of the North line of said Lot 1620 and the Easterly pro— longation of a line parallel with and 20 feet South of the South line of said Lot 1320. PARCEL 2: The North 20 feet of the street adjoining Lots 1319 and 1320 on the South, lying between the Southerly prolongation of the West line of said Lot 1319 and the Southerly prolongation of a line parallel with and 20 feet East of the East line of said Trot 1320, For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of said City. Section 2: That notice is hereby given that the 1 S th day of June, 1964, at the hour of 8:00 o'clock P.M. in the Council Chamber in the City Hall, Huntington Beach, California, is the time and place when and where a public hearing shall be held upon said resolution of intention to vacate said above described streets, at which hear— ing all persons interested in or objecting to the proposed vacation may be heard. Section 3: The City Clerk is hereby authorized and directed to cause a copy of this resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation, 2 Resolution No. 1962 printed and published in the City of Huntington Beach., by one in- sertion prior to the hearing as set forth in Section 2 hereof. Section 4: The City Council of the City of Huntington Beach, in vacating the streets, as above described, does elect to proceed under the provision of the Streets and Highways Code Section 8320 etc. of the State of California. Section 5: The Street Superintendent is hereby authorized and directed to post notices of street vacation as required by law. Box 190 Huntington Beach, California Gentlemen: On behalf of the developer of Tentative Tract No. 5575, we hereby petition your Honorable Body for the vacation and abandonment of those certain streets within the W. T. Newland Tract described in Exhibit "A", attached hereto. Said streets do not include any existing or proposed arterial highways, and are not in fact existing as streets or open to the public at the present time. Neither have they specifically been dedicated to any public agency at any time, and are actually included as ownership in fee simple with the ownership of the lots adjacent. However, since streets were never so specifically dedicated on other tract maps filed at the time that said W. T. Newland Tract was filed (the year 1906), it is the opinion of Title Insurance and Trust Company that a cloud exists as to title of the streets in question. The recording of Tract No. 5575 will, of course, provide fully adequate access to all lots and parcels which will be created thereon by the dedication of new streets. Very truly yours, Frank W. T, Newland Tract Gentlemen: Transmitted herewith is Resolution No. 1962 requesting the vacation of a portion of two unnamed streets with- in the W. T. Newland Tract which was recorded in 1906, The streets within this tract were neither offered in writing by the owner nor accepted by a public agency for dedication. However the title company engaged by the developer is of the opinion that a cloud exists as to the title of the streets in question. Since these streets are shown on the plan of the recorded map this position is understandable . It is therefore suggested that your Honorable Body initiate .the abandonment of any City interest of° the streets as indicated in Resolution No, 1962. Very truly yours, es R.
