HomeMy WebLinkAboutCity Council - 2017 RESOLUTION NO. 2017 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA.DETERMINING FEASIBILITY OF PROJECT, WAIVING. DEBT LIMITATION, AND OVERRULING PROTESTS, ASSESSNENT. DISTRICT NO. 6302 WHEREAS , a public hearing was duly and legally called and held by the City Council of the City of Huntington Beach, California upon the Investigation Report of Southworth & Stevens, Inc. , assessment engineers in Assessment District No. 6302, City of Huntington Beach, California, on August 3 , 1964, at which time said report was first summarized; and WHEREAS , all protests made in writing or orally to said proposed acquisition and improvement were duly and legally considered; and WHEREAS , said assessment engineers have advised that said protests, both oral and written, were not made by owners of more than half of the area of the property proposed to be assessed for said proposed acquisition, work and improvement, and said City Council having acquired jurisdiction to proceed herein: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach, California, in regular session assembled this 3rd day of August, 1964 that all of said protests , both oral and in writing, be and the same hereby are overruled and denied. _1_ BE IT FURTHER RESOLVED that said City Council hereby finds that said proposed project is feasible , that the public interest, convenience and necessity require said proposed work and improvement, that the lands to be assessed will be able to carry the burden of the proposed assessments and the limitations upon the amount of assessments provided for in the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, Division 4 of the Streets and Highways Code of the State of California, shall be disregarded, both with respect to the limitations on the district as a whole , and as to the limita- tions on individual specific assessments. BE IT FURTHER RESOLVED that proceedings for said im- provement shall be taken under the Improvement Act of 1911 of the State of California , Division 7 of the Streets and Highways Code , and improvement bonds shall be issued pursuant to the pro- visions of said Improvement Act.
