HomeMy WebLinkAboutCity Council - 2038 RESOLUTION No. 2038 A RFSOLUTI10N OF THE CITY OF HUNTINGTON BEACH CALLING A SPECIAL ELECTION TO BE HELD ON THE 13th DAY OF OCTOBER,1964, PERTA.INI 4G TO THE SUNSET HEIGHTS #3 ANNEXATION TO THE CITY OF HUNTINGTON BEACH. WHEREAS, by Resolution No. 19?9, the City Council of the City of Huntington Beach declared its intention to call a Special Election in certain inhabited territory contiguous to said city proposed to be annexed to said city, for the purpose of submitting to the qualified electors residing in said territory the question whether or not said territory shall be annexed to said city; and WHE'REAS, a copy of said resolution was published as re- quired by law; and WHEREAS, the City Council finds that at the time not later than the hour set by said Resolution for hearing ob- jections to the proposed election, and not later than the time to which said hearing was continued, neither written and oral protests to said election were made by the owners of one-half of the value of the territory proposed to be I annexed, as shown by the last equalized a assessment roll, nor were written and oral protests made by public and pri- vate owners equal to one-half of the value of the territory; and WHEREAS, all proceedings have been made in accordance with said resolution and the Annexation Act of 1913, refer- ence thereto hereby being made for further particulars ; 1. Res. No. 2038 NO'W, THEREFORE, BE IT 'RESOLVED by the City Council of the City of Huntington Beach: Section 1. A special election hereby is called to be held on the 13th day of October, 1964, in the territory here- inafter described and proposed to be annexed to the City of Huntington Beach, for the purpose of submitting to the quali- fied electors residing in said territory, the question whether or not such territory shall be annexed to, incorporated in, and made apart of said City of Huntington Beach, and whether or not the property in said territory shall, after such annex- ation, be subject to taxation, equally with the property with- in the City of Huntington Beach, to pay the entire bonded Indebtedness of the City of Huntington Beach outstanding or authorized at the date of the filing of the petition for an- nexation for the acquisition, construction or completion of municipal improvements. `those portions of Sections 21 and 289Township 5 South., Range 11 West in the Rancho La Bolsa Chica, County of Orange, State of California, as per map recorded in Book 51, page 13 of Miscellaneous Maps, in the office of the County Recorder of said County, together with that por- tion of Tract No. 86 as per map recorded in Hook 10, page 35 of said Miscellaneous Reaps, described as a whole as follows : Beginning at are angle point in the present boundary of the City of Huntington Beach, said ark le point beingthe most southerly southeast corner of "B9LSA CHICA ANNEXA- TION" to the City of Huntington Beach, Ordinance No. 944, certified January 18, 1963, said angle point also being the intersection of the centerline of Bolsa Chica Street with the North line of Los Fatos Avenue, 60.00 feet wide, as vacated by the Board of Supervisors of said Orange County, a certified copy of which was recorded July 159 1943 in Hook 1197, page 424 of Official Records; thence following the present boundary of the City of Huntington Beach and the boundary of said "BOLSA CHICA ANNrCATICN", 2. Res. ANNEXATION". South 00 46' 30" East 30.00 feet to an angle point in said "NORTH ANNEX&_ TION" ; thence continuing along the present boundary of the City of Huntington Beach and along the boundary of said "NORTH ANNEXATION", North 890 37T 30" East 20.00 feet to an angle point in said "NORTH ANNEXATION",said angle point being on the North-South centerline of said Section 28; thence continuing along the present boundary of the City of Huntington Beach and along the boundary of said "NORTH ANNEXATION", South Oo 46' 30f# East 1290.00 feet, more or less, to the easterly prolong- ation of the centerline of said Los Patos Avenue; thence leaving the present boundary of the City of Huntington .Leach, South 890 39' 11" West 2670.16 feet along said prolongation to said centerline of Bolsa Chica treet; thence along last said centerline North 00 44' 30" West 30.00 to the point of beginning. ' Containing an area of 179.66 acres, more or less. Section 2. TIME OF OPENING AND CLOSING OF POLLS. The polls at said election shall be opened I- t 7 :00 o'clock A.M. of the day herein fixed for the holding of said election and shall be kept open until 7 :00 o'clock P,M. of the same day, when the polls shall be closed. Section 3. BALLOTS. Upon the ballots to be used at said election there shall be printed the words : 4. Res. No. 2038 SHALL THE SUNSET HEIGHTS #3 ANNEXATION BE ANNEXED TO, INCOREOnATED IN AND MADE A PART OF THE CITY OF HUNTINGTON BEACH AND THE PROPERTY IN SUCH TE RITORY BE,AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUAL- LY WITH THE PROPERTY WITHIN THE CITY OF HUNTINGTON BEACH, TO PAY THE ENTIRE BONDED INDEBTEDNESS OF THE CITY OF HUNTINGTON BEACH, OUTSTANDING OR AUTHORIZED AT THE DATE OF THE FILING OF THE PETITION FOR ANNEX- ATION FOR THE ACQUISITION, CONSTRUCTION OR COMPLET- TION OF 111UNICIPAL IMPROVEMENTS. Opposite these words there shall be printed the words "Yes" and "No" , and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (f) in the voting square after the printed word "Yes" the vote of such elector shall be counted in favor of the annexation of said territory to the City of Huntington Beach; and if an elector shall stamp a cross (4) in the voting square after the printed word "No" the vote of such elector shall be counted against such annexa- tion. In all particulars not herein recited said election shall be held in conformity; as near as may be, with the laws of the State of California concerning general elections and with said Annexation Act of 1913. 5• Res. No. 2038 Section 4. (a ) For the purpose of said election there Is hereby established in the territory described herein one (1 ) voting precinct. The following is the polling place of said election precinct and the following named persons here- by are named officers of election and shall constitute the boards of election for such election precincts. PRECINCT No, 1 (Consisting of a portion of Orange County Sunset Beach #4 Precinct) Polling Place - La Rue Realty Office 5061 Warner Lvenue Inspector: Mrs. Mildred V. Kuehne Judges : Mrs. Velma L. Dunbar Mrs. Virginia M. Tackaberry (b) For their services in connection with said election, said inspector shall receive 21.00 and said judges 41v18.00 each; and the person in possession of the Polling place named herein shall receive for the use of such premises in connection with said election the sum of $ 15- 00. Section 5. The City Clerk shall publish a notice of said special election as required by said Annexation Act of 1913, at least once a week for the four (4) weeks prior to the date of the election on October 13th,, 1964, in the 'V-147est— minster Herald, a newspaper of general circulation printed and published outside of the City of Huntington Beach but in the County of Orange, California. Section 6, The City Clerk shall certify to the adoption 6. Tics. No. 2038 of this resolution and cause the same to be published once in the Huntington Beach News.
