HomeMy WebLinkAboutCity Council - 2072 RESOLUTION No. 2072 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, STA;t'ING THE RESULT OF THE CANVASS OF ELECTION RETURNS OF THE SPECIAL ELEC- TION HELD NOVEMBER 3rd, 1964. WHEREAS, the City Council of the City of Huntington Beach, California, by Resolution No. 2024, duly called and provided for the holding of a special election in said City on November 3, 1964, for the purpose of submitting to the qualified voters of said city the propositions set forth in said ordinance and hereinafter stated; and WHEREAS, the City Council of said City of Huntington Beach, California, did request the Board of Supervisors of Orange County, California, to include said special election for the City of Huntington Beach with an election being held by the County for the United States, the State of California, and the County of Orange; and WHEREAS, said Board of Supervisors did consent to the combining of the Huntington Beach Special City election with the Genetal Election being held by the County of Orange, through the adoption of their Resolution No. 64-1056 on August llth, 1964; and WHEREAS, notice of said election was duly and regular- ly given in time, form and manner as provided by law, and said election was on said date duly held at the polling places designated by said County of Orange; and 1. Res':. No. 2072 WHEREAS, the Boprd of Supervisors of the County of Orange, at their meeting held in their usual place of meeting on August lith, 1964, adopted Resolution No. 64-1490 certify- ing that the canvass of ballots for said General Election had been made as required by law, and that the votes cast in said election covering Propositions "a" and "b" in the Special election of the city of Huntington Beach, as combined with the General Election held by the County of Orange, are as follows: "a" "Shall the ordinance amending Section 1241 of the Huntington Beach Ordinance code to make the office of the City Attorney of Huntington Beach an appointive office, be adopted'" "Yes" votes - 59811 "No" votes - 149813 "b" "Shall the ordinance amending Section 1241 of the Huntington Beach Ordinance Code to make the office of the Chief of Police of Huntington Beach an appointive office, be adopted?" "Yes" votes - 89751 "No" votes - 119879 NOW, THEREFORE, the City Council of the City of Hunt- ington Beach, California, does hereby resolve, determine and, order as follows: Section 1. That the special election for the purpose of submitting to the voters of the City of Huntington Beach the propositions hereinafter set forth was duly held on Novem- ber 3, 1964, and the votes cast at said election were duly and 2. Res'., No. 2072 regularly canvassed, and the returns thereof made at the time and in the form and manner required by law. Section 2. That the propmsitions voted upon at said election were numbered "a" and "b", and were as follows, to-wit: "a" "Shall the ordinance amending Section 1241 of the Huntington Beach Ordinance Code to make the office of ' the City Attorney of Huntington Beach an appointive office, be adopted?" "b" "Shall the ordinance amending Section 1241 .of the Huntington Beach Ordinance Code to make the office of the Chief of Police of Huntington Beach an appointive office, be adopted?" Section 3. That all ballots cast, including the ab- sentee ballots cast, have been duly canvassed and counted as required by law, and the result of such count is herein- after stated. That this City Council does hereby accept the canvass of the returns of said election, as made by the County Clerk of the County of Orange, and certified by the Board of Supervisors of said County in their Resolution No. 64-1490, with a total count for all precincts established in the City of Huntington Beach, including all absentee ballots cast in said precincts, being as follows: Proposition "a" "Yes" T 0g9811 "No" 1 ,813 Prouosl "b" "Yes" 8,751 "No" 119879 3. 'Rehr. No. 2072 Section 4. That the votes of a majority of all of the voters voting at said election were cast against the adoption of said propositions "a" and "b", and said proposit- ions "a" and "b" are hereby declared to be defeated,, and the offices referred to shall remain elective. JONES, the duly elected, qualified and acting City Clerk of the City of Huntington Beach and ex-officio Clerk of the City Council of said City, do hereby certify that the whole number of members of the City Council of the City of Huntington Beach is five; that the foregoing ordinance was read to said City Council at a regular meething thereof held on the 16th day of November , 1964, and was again read to said City Council at a regular meeting thereof held on the 7th day of December , 1964, and was passed and adopted by the affirmative vote of more than a majority of all the members of said City Council.
