HomeMy WebLinkAboutCity Council - 2087 RESOLUTION No. 2087 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH GIVING NOTICE OF PROPOSED ANNEXATION TO THE CITY OF HUNTINGTON BEACH OF THAT CERTAIN UNINHAB_ !TED TERRITORY DESCRIBED HEREIN AND DES- IGNATED AS "SUNSET BEACH ANNEXATION #4" AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH: Section 1. That pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939", as set forth in Sections 35300 to 35326 inclusive of the Government Code of the State of California, Resolution No. 2059 was passed, on November 2nd, 1964, by the City Council uncil of the City of Huntington Beach in which it initiated on its own motion proceedings to annex certain uninhabited territory situate In the County of Orange, State of California, hereby designated "Sunset Beach Annexation fi"4". and described as follows: "Beginning at an angle p0int in the boundary line of the present city boundary of the City of Huntington Beach, County of Orange, State of California, said boundary having been established by Sunset Beach No.1 Annexation In Ordin- ance No. 993 and by Sunset Beach No.2 Annexation in Ordin- ance No. 1063 of said city, said point being also the inter- section, of the southwesterly line of Tide Land Location No. 141, recorded in Book 1, Page 194 of Patents in the office of the County Recorder of Orange County and also recorded in Book 3, Page 45 of Record of Surveys in the office of the County Recorder of said Orange County, with the northeasterly terminus of a line bec ring N 460 211 00" E having a total length of 118,94 feet, said line being shown on a map record- ed In Book 65 Page 28 of Record of Surveys in the office of the County Recorder of Orange County, said above described point being also the True Point of Beginning; thence S 460 Ord. No. 2087 32' 00" W along last described line, said line being the northwesterly boundary line of the City of Huntington Beach as established by hereinbefore mentioned Sunset Beach No.l Annexation, 113.94 feet to a point in the northeasterly line of that 5.00 foot strip of land conveyed to the State of California recorded in Book 479 Page 326 of Deeds in the office of the County Recorder of Orange County; thence leaving the boundary line of the City of Huntington Beach, N 430 28' 00" W. along the northeasterly line of before described 5.00 foot strip of land, 944.44 feet to a point, said point lying In the boundary line of the City of Huntington Beach as estab- lished by hereinbefore mentioned Sunset Beach No.2 Annexa- tion said line being shown as . 50.80 feet in len th bearing 11 466 32' 00" E on said map recorded in Book 65,�age 28 of Record of Surveys in the office of the County Recorder of Orange County; thence N 46 32' 00" E, along last described line, 45.80 feet to the northeasterly terminus of said line, said point being in the southwesterly line of before described Tide Land Location No. 141, and also being an angle point in the bounder line of the City of Huntington Beach as establish- ed by said unset Beach No, 2 Annexation; thence, following the southwesterly line of Tide Land Location No. 141, and the boundary line of the City of Huntington Beach established by Sunset Beach No. 2 Annexation. along the following bearings and distances, S 580 00' 00" E 367.43 feet to a pint, S 490 00' 00" E 198.00 feet to a point, S 34 00' 00" 330.00 feet to . a point S 530 00' 00" E 67.11 feet to e point, said point being the 'true Point -of _Beginning. Section 2. That the County Boundary Commission of Orange County, California, did in session duly assembled on November 16, 1964, approve the proposed annexation boundaries of said "Sunset Beach Annexation A", as above described, and as submitted to said Commission by the City of Huntington Beach. Section 3, That the Local Agency Formation Commission of Orange County, as established by the State Legislature during the 1963 Session, did in session duly assembled on Dee- ember 2, 1964, hold a public hearing on said "Sunset Beach An- nexation A", and after hearing any and all parties who were for or against such annexation, did approve such annexation as submitted to said Commission by the City of Huntington Beach. 2,, Ord. No, 2087 Section 4. That February 1st, 1965, at the hour of 8:00 o'clock P.M. , or as soon thereafter as possible, of said day in the Council Chambers, in the City Hall in the City of' Huntington Beach, County of Orange, California, is hereby fixed as the time and place when and where any person owning property within the uninhabited territory above described and proposed to be annexed to the City of Huntington Beach and having any objection to the proposed annexation may appear be- fore the Council of the City of Huntington Beach and show cause why such uninhabited territory should not be so annexed to said City of Huntington Beach. Such protest gust be in writing, may be filed at any time before the hour set for hear.* ing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property in general terms. Section 5. The City Clerk of the City of Huntington Beach is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week in the "Huntington Beach News", a newspaper of general circulation published in said City of Huntington Beach, the city in which it is proposed to annex the aforesaid terri- tory and also in the "Westminster Herald" a newspaper published outside the City of Huntington Beach but in the County of Orange, California, the county in which is located the territory proposed to be annexed to the City of Huntington Beach, said publication to be complete at least twenty (20) days prior to the date set for hearing. Ord. No, 2087 Section 6. And the said City Clerk is further auth- orized and directed to cause -1.�'Tritten notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the abDve proceedings were initiated, at the addresses shown on said assessment roll or as known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has any interest; either legal or equitable with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. Section 7. In the event any land within the territory proposed to be annexed is owned by a county, the said City Clerk Is directed to cause written notice of such proposed an- nexation to be mailed to the Board of Supervisors of such County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. Section 8. The said City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto In the manner required by law* PASSED AND ADOPTED by the City Council of the City of Ord.
