HomeMy WebLinkAboutCity Council - 2090 RESOLUTION No. 2090 AT+ ORDER OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH VACATING A PORTION OF SEVENTEENTH STREET IN SAIL CITY WHEREAS, the City Council of the City of Huntington Beach, California, did, by unanimous vote on the 20th day of January, 1964, at a regular meeting of said body, regu- larly and duly adopt Resolution No. 1912, entitled, "A Res- olution of intention of the City Council of the City of Hunt- ington Beach to Vacate a Portion of Seventeenth street in said City and Giving Notice of Hearing on said Vacation"; and WHEREAS, the City Council of the City of Huntington Beach did elect to proceed under the provisions of the Street Vacation Act of 1941; and WHEREAS, the portion of the street to be vacated lies within the City of Huntington Reach and is not a portion of a State Highway; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said resolution of intention to be published in the Huntington Beach Hews, a newspaper of gen- eral circulation printed and published in the City of Hunt- ington Beach, by one insertion on the 23rd day of January , 1964; and WEREAS, said resolution contained a notice that the 17th day of February, 1964, at the hour of 8:00 o'clock P.M, 1. Aes.No. 2090 In the Council Chamber in the City Hall, Huntington Beach, California, was the time and place when and where a public hearing was to be held upon said resolution of intention at which hearing all persons interested in or objecting to the proposed vacation may be heard; and WHEREAS, notice of street vacation was posted as re- quired by law; NOW THEREFORE, the City Council of the City of Hunt- ington Beach does resolve as follows : Section 1. The City Council of the City of Huntington Beach, after hearing the evidence offered by all persons in- terested appearing before said Council, does hereby find from all the evidence submitted that the portion of Seventeen- th Street herein described is unnecessary for present or prospective public street and alley purposes. portions of Section 2. It is hereby ordered that/that certain street in the City of Huntington Beach described as: Parcel I: That portion of Seventeenth Street, as shoxm on a map of the East Side villa Tract record- ed in book 4,page 65 of Miscellaneous Maps,Aeeords of Orange County, California, which is bounded on the west by the northerly and southerly prolonga- tions of the East line of Florida Street, 60 feet In width as now laid out; and which is bounded on the east by the west line of that portion of Seven- teenth Street, abandoned by the Orange County Board of Supervisors, and described in Book 2676,Page 266 of Official Records, Records of Orange County, California; and 2. Res.No. 2090 Parcel 2: That portion of Seventeenth Street as described in a deed from the McCallen Realty Syn- dicate to the State of California, recorded Auger ust 30, 1�51 in Book 2224,page 395, of Official Records, ecords of Orange County, California. be and the same is hereby vacated for public street and alley purposes, subject to the reservation of easements and rights of-way set forth in Section 8330 of the streets and Highways Code of the State of California. Section 3, The City Clerk is hereby authorized and directed to cause a certified copy of this order, attested by the Clerk under the seal of this City, together with a certified copy of Resolution No. 1921 to be recorded in the office of the County Recorder of Orange County, California.
