HomeMy WebLinkAboutCity Council - 2117 RESOLUTION OF INTENTION NO. 2117 ASSESSMENT DISTRICT NO. 6401 HUNTINGTON BEACH, CALIFORNIA The City Council of the City of Huntington Beach, California , in regular session assembled this 15th day of February, 1965 , does hereby resolve and determine as follows: SECTION 1: That the public interest and convenience require, and that it is the intention of said City Council to order the following acquisition of property for public use and work to be done or improvements to be made in said City of Huntington Beach and City of Westminster , California, to wit: A. The acquisition of the following described ease- ments and rights of way situated in the City of Huntington Beach, State of California: 1 . The North 1350 feet of the East 15 feet of the West one-half of the Northwest one-quarter of Section 25 , Town- ship 5 South, Range 11 West , San Bernardino Base and Meridian. 2 . That portion of the Southwest one-quarter of Section 14, Township 5 South, Range 11 West , San Bernardino Base and Meridian, Orange County, California, being more particularly described as follows: A strip of land, 10.00 feet in width, lying 5 .00 feet to each side , measured at right angles from the below described centerline: -1- Beginning at the Southwest corner of said Section 14; thence North 89° 32' 00" East 1321.20 feet, along the South line of said Section 14, to a point; thence South 00 39' 350° East 30.00 feet to the true point of beginning of the above mentioned centerline , said point being a point of tangency with a curve , concave to the West , having a radius of 700.00 feet, a radial line through said point bears North 89° 20' 25" East; thence Northerly 254.06 feet, along said curve, through a central angle of 20° 47 ' 42" to a point of reverse curvature with a curve, concave to the East, having a radius of 700.00 feet; thence Northerly 254.06 feet , along said curve, through a central angle of 200 47 ' 42" to a point of tangency with a line bearing North 00 39 ' 35" West; thence 436.95 feet along said line to a point of tangency with a curve, concave to the Southwest , having a radius of 90.00 feet; thence Northwesterly 141 .37 feet , along said curve , through a central angle of 900 00' 00" to a point of tangency with a line bearing South 890 20' 25" West; thence 20.00 feet along said line , to a point of tangency with a curve , concave to the Northeast, having a radius of 90.00 feet; thence 141 .37 feet , along said curve , through a central angle of 900 00' 00" to a point of tangency with a line bearing North 00 39' 35" West; thence 420.00 feet , along said line , to a point of tangency with a curve , concave to the Southwest, having a radius of 90.00 feet; thence Northwesterly 141.37 feet along said curve , through a central angle of 90° 00' 00" -2- to a point of tangency with a line bearing South 890 20' 25" West; thence 239.19 feet, along said line , to a point of tangency with a curve , concave to the Northeast , having a radius of 90.00 feet; thence Northwesterly 94.55 feet , along said curve, through a central angle of 60° 11' 30" to a point of tangency with a line bearing North 300 28' 05" West; thence 1050.04 feet , along said line, to a point of tangency with a curve , concave to the East, having a radius of 90.00 feet; thence Northerly 47 .12 feet , along said curve, through a central angle of 300 00' 00" to a point of tangency with a line bearing North 00 28' 05" West; thence 50.00 feet , more or less , along said line, to a point on the North line of the Southwest one-quarter of said Section 14, said point lying 89.00 feet Easterly, measured along said North line , from the Northwest corner of said Southwest one-quarter of Section 14. EXCEPTING THEREFROM that portion lying Northerly of the South line of the North 40.00 feet of said Southwest one- quarter and also excepting therefrom that portion lying Southerly of the North line of the South 50.00 feet of said Southwest one- quarter of Section 14. B. The construction and installation of the following described work, together with appurtenances and appurtenant work, in the following described public streets and rights of way: 1. A 12 inch vitrified clay pipe sewer line with man- holes from an existing manhole (to be adjusted to grade) in the -3- common intersection of Golden West Street and Edinger Avenue to a sewer plug to be constructed in the Easterly one-half of Golden West Street at the Easterly right of way line thereof 420 feet North of said existing manhole. 2. Concrete curb and gutter , concrete sidewalk, concrete driveway aprons, asphalt concrete pavement over cement treated base, the removal and relocation of existing telephone poles , the removal of existing pavement, guard rail and reflectors , the relocation of existing stop signs and an existing street sign, the removal of two existing 8 inch steel pipelines and one 6 inch steel pipeline, and the installation of two new 8 inch steel pipe- lines and one 6 inch steel pipeline, and the removal and relocation of an existing communication system of poles and line, said pipe- lines and communication system being used by Standard Oil Company for the transmission of its petroleum products under rights prior to the public easement, in the Easterly one-half of Golden West Street from a point therein 12 feet South of the centerline of Edinger Avenue to a point in Golden West Street 60 feet North of the construction centerline of McFadden Avenue, in the common inter- sections of Golden West Street with Edinger and McFadden Avenues , together with the removal of existing pavement in the Westerly 12 feet of the Easterly 62 feet of Golden West Street from a point 1320 feet North of the centerline of Edinger Avenue to McFadden Avenue and the installation of asphalt concrete pavement in the -4- Westerly one-half of Golden West Street between Stations 13+20.57 and 14+05.57 , and Station 24+60.50 and a point 10 feet North of the construction centerline of McFadden Avenue. 3 . An 8 inch asbestos cement water line with meter, meter vault, flanges , adaptors , and plug, at a point in Golden West Street 1190 feet North of the center line of Edinger Avenue and extending in an Easterly and Westerly direction in Golden West Street from an existing 12 inch transite water main in the Westerly one-half of Golden West Street to the Easterly right of way line of Golden West Street. 4. The removal of an existing standpipe and its re- placement with a standard manhole at a point in Golden West Street 1553 feet North of the centerline of Edinger Avenue. 5. Concrete curb and gutter, concrete sidewalk, asphalt concrete pavement over cement treated base, street paving, the removal of existing pavement, the relocation of existing telephone poles , the construction of a street sign and barricade sign in the Southerly 40 feet of McFadden Avenue from its intersection with Golden West Street to its intersection with Gothard Street, in the Northerly one-half of McFadden Avenue from a point 200 feet West of the construction centerline of Gothard Street to Gothard Street , in the common intersections of McFadden Avenue with Gothard and Golden West Streets , in McFadden Avenue from said centerline of Gothard Street to the Westerly line of the right of -5- way of the Southern Pacific Railway Company, and in the Northerly one-half of McFadden Avenue from a point 12 feet East of the centerline of Golden West Street to a point in McFadden Avenue 200 feet East of said centerline , together with the removal of existing pavement and the installation of a Stop Ahead sign in the Northerly 12 feet of the Southerly 52 feet of McFadden Avenue from Golden West Street to Gothard Street . 6. Concrete curb and gutter, concrete sidewalk, asphaltic concrete pavement over cement treated base , driveway approaches , the removal of existing asphalt concrete pavement , the relocation of existing telephone poles and a Stop Ahead sign, for a distance of 400 feet in the Northerly 62 feet of Edinger Avenue from its intersection with the centerline of Golden West Street, and thence in the Northerly 38 feet of Edinger Avenue to a point in Edinger Avenue 504.31 feet East of the centerline of Gothard Street , and in the common intersections of Edinger Avenue with Golden West and Gothard Streets , together with the removal of an existing 48 inch manhole and its replacement with a standard man- hole, and the construction of an 8 inch vitrified clay pipe sewer line with manholes from an existing manhole (to be adjusted to grade) in the common intersection of Edinger Avenue and Gothard Street to a manhole to be constructed in Edinger Avenue 645 feet West thereof. 7 . A 12 inch asbestos cement water line , with fire -6- hydrant, valve and connections from an existing 12 inch transite water line in the common intersection of Gothard Street and Edinger Avenue to a point in Gothard Street 1320 feet North of the construction centerline of Edinger Avenue and from thence an 8 inch asbestos cement water line in Gothard Street to an existing 8 inch transite water line in the common intersection of Gothard Street and McFadden Avenue . 8. An 8 inch vitrified clay pipe sewer line with man- holes in Gothard Street from an existing manhole (to be adjusted to grade) in the common intersection of Gothard Street and Edinger Avenue to a manhole with an 8 inch vitrified clay pipe stubout facing North to be constructed in Gothard Street 1320 feet North of the construction centerline of Edinger Avenue . 9. Concrete curb and gutter , concrete sidewalk, asphalt concrete pavement over cement treated base, driveway approaches , street , traffic and stop signs , the removal of two existing dead end signs , in Gothard Street from Edinger Avenue to McFadden Avenue, and in the common intersections of Gothard Street with Edinger and McFadden Avenues . 10. An unlined earthen channel, approximately 1300 feet in length and of varying depth and width in the public right of way along the West line of the Northeast one-quarter of the North- west one-quarter of Section 23 , Township 5 South, Range 11 West -7- San Bernardino Base and Meridian now owned by said City of Huntington Beach, and the easement and right of way to be acquired as hereinbefore set forth in Paragraph A.1 of this section, between a line 40 feet Southerly from the Southerly line of Edinger Avenue and an existing channel 1274 feet Southerly therefrom. 11 . A reinforced concrete pipe storm drain, composed of 100 feet of 75 inch diameter reinforced concrete pipe (1000D) , 1012.19 feet of 75 inch diameter reinforced concrete pipe (800D) , 1054.19 feet of 69 inch diameter reinforced concrete pipe (800D) , 1096 feet of 63 inch diameter reinforced concrete pipe (800D) , and 48 feet of 57 inch diameter reinforced concrete pipe (1000D) , in Edinger and McFadden Avenues and the easement and right of way hereinbefore described in Paragraph A.2 of this section between the Southerly line of Edinger Avenue at a point 1321.20 feet Easterly from the centerline of Golden West Street and a point in McFadden Avenue 15.65 feet Northerly from the centerline of said avenue, and 89 feet Easterly from the center- line of Golden West Street , together with manholes , catchbasins, 18 inch, 24 inch, and 27 inch diameter reinforced concrete pipe, connecting lines , brickwork, plugs and appurtenant work as shown on the plans . 12. A reinforced concrete pipe storm drain, composed of 582 .8 feet of 24 inch diameter reinforced concrete pipe (1250D) -8- and 150 feet of 18 inch diameter reinforced concrete pipe (1500D) in the Northerly one-half of Edinger Avenue between a junction with the aforesaid proposed 75 inch diameter reinforced concrete pipe storm drain approximately 662 feet Westerly from the center- line of Gothard Street and a point 75 feet Easterly of said centerline , together with catchbasins and appurtenant work as shown on the plans. 13 . A cement concrete transition structure between the aforesaid 75 inch diameter reinforced concrete pipe storm drain described in Paragraph B. 11 of this section and the earthen channel described in Paragraph B.10 of this section and extending from the Southerly line of Edinger Avenue to a line 20.25 feet Southerly therefrom including the chain link fencing of the entire structure, as shown on the plans. SECTION 2: All of the above mentioned acquisition of property and work, including the grade to which said work shall be done and the location thereof in and upon the streets and rights of way above mentioned, shall be done upon the grades , along the lines, between the points , of the dimensions, at the places and in the manner described and set forth in the plans , profiles and detailed drawings of said work, and to specifications for said work heretofore adopted by said City Council on r V f February 1, 1965 by its Resolution No. 21o8 which plans, profiles , detailed drawings and specifications are on file in -9- the office of the City Clerk and which are hereby referred to for a more particular description of said work, grade of said work, and location of said work in and along the streets and rights of way hereinbefore mentioned; and which plans , profiles , detailed drawings and specifications are hereby incorporated herein and made part hereof by reference as though set forth fully herein. SECTION 3: That said contemplated work and improve- ments, in the opinion of said City Council , is of more than local or ordinary public benefit, and that the expenses and cost of said acquisition of land, work and improvements shall be charge- able upon a district, which said district said City Council hereby declares to be the district benefited by the work and improvements herein described and to be assessed to pay the cost and expenses thereof; said district shall include that territory in said City of Huntington Beach and City of Westminster, Calif- ornia which is shown upon that certain plat or map thereof on file in the office of the City Clerk, entitled "MAP OF ASSESSMENT DISTRICT 64011, CITY OF HUNTINGTON BEACH, CALIFORNIA," and which said map or plat indicates by a boundary line the extent of the territory included in the proposed district and covers all details as to the extent of the area to be assessed; said map or plat is hereby incorporated herein and made a part hereof by reference as though set ,forth fully herein. -10- SECTION 4: NOTICE IS HEREBY GIVEN that serial bonds shall be issued in the manner and form provided in Part 5 , Division 7 of the Streets and Highways Code of the State of Calif- ornia , the Improvement Act of 1911 , to represent unpaid assess- ments of Fifty Dollars ($50.00) or over as to all lots and lands , except that owned by the 'Orange Coast Junior College District, which bonds shall bear interest at the rate of six percent (6%) per annum and the last installment of which bonds shall mature nine (9) years from the second day of January next succeeding the first day of September following their date . Assessments levied upon the lands of the Orange Coast Junior College District shall be paid as provided in Section 5302 .5 of the Streets and Highways u Code of the State of California by said Orange Coast Junior College District and not by said City of Huntington Beach. SECTION 5: NOTICE IS HEREBY FURTHER GIVEN that said City Council has found and determined , by not less than a four- fifths vote of all of its members when considering passage of this resolution of intention, that all of the owners of all of the lots and lands liable to be assessed for the aforesaid work and acquisition of land have signed and filed, within the time required by law, their petition waiving the hearing of objections under this resolution of intention, and declaring that they do not have any objections to the proposed work and acquisition of land, or the extent of the district to be assessed, or any other -11- objections whatsoever, and has ordered that the hearing of objections under this resolution of intention shall not be required and will not be held. SECTION 6: The City Clerk shall cause this resolution of intention to be published twice in the Huntington Beach News , a newspaper of general circulation, published and circulated in said City of Huntington Beach, which said newspaper has hereto- fore been designated by said City Council as the newspaper in which shall be printed and published all notices, resolutions, orders and other matters required to be published in the proceed- ings to be taken pursuant to this resolution and under the provisions of the Improvement Act of 1911 . The first publica- tion of said notice shall be within ten (10) days after the date of adoption of this resolution of intention. SECTION 7: NOTICE IS HEREBY FURTHER GIVEN that the grades to which said work is to be done are, or may be in part, new and different from those heretofore established, or may be and in some cases are different from existing ground levels . SECTION 8: The total estimated cost of said work and improvements , including estimated incidental costs , is in the amount of $528,389.31 . SECTION 9: It is now estimated that said acquisition of property will not cost anything. Any cost, however, will be in addition to the total estimated cost of said work and -12- improvements hereinabove set forth. SECTION 10: All of the lands, rights of way and easements aforesaid, required in said work and improvements, shall be acquired by the City of Huntington Beach, California by gift, purchase or condemnation. Said City of 'Huntington Beach, California shall advance the cost thereof from its general fund and shall assess such cost thereof, including the incidental expenses thereof, as a part of the cost of said improvement .
