A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH SUPPORTING THE ENACTMENT
OF A.B. 1218, PERTAINING TO THE PURCHASE OF
REVENUE PRODUCING FACILITIES BY LOCAL
AGENCIES.
WHEREAS, there has been introduced in the current sess..
ion of the State Legislature, A.B. 1218, which proposes to
add Article 8 to Chapter 5, Part 1, Division 2, Title 5, of
the Government Code, and such� Article would provide a means
for any City or County or other public corporation to acquire
a revenue producing facility by means of a contract of pur-
chase under which the purchase price, together with interest
thereon, could be payable over a period of years, solely
from the income and revenue of the facilities so acquired,
and would further provide that the local agency could pledge
as security for the payment of the contract price all or any
part of the income and revenues of the facilities acquired;and
WHEREAS, local agencies and particularly cities in this
State which own and operate public power utilities, when an-
nexing areas already served by private power companies, under
existing law are presented with a financial problem because
there is no legal means by which they can provide for the
purchase of the existing facilities over a period of years
and must therefore pay cash for such acquisition; the proposed
bill, if enacted, will provide a solution to this problem.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Huntington Beach th<:,t the State Legislature be re-

quested to enact A.B. 1218 as a much needed benefit for
local agencies.
BE IT FURTHER RESOLVED that the City of Huntington
Beach urges the League of California Cities and local
agencies throughout the State of California to do all they
can to encourage both Houses of the State Legislature to
pass A.B. 1218, as a much needed benefit for local agencies .
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to send certified copies of this Resolution to
all members of the Assembly Committee on Municipal and
County Government and to Assemblymen Robert E. Badham,
William E. Dannemeyer and James E. Whetmore, State Senator
John J. Schmitz and Richard Carpenter, Executive Director
and General Counsel of the League of California Cities,
and to send copies of this Resolution to each interested
city in the State of California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California this 3rd day of May, 1965 .
