A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH IN OPPOSITION
TO AB 1461 RELATING TO MANDATORY 40 HOUR
WEEK FOR FIREMEN.
WHEREAS, Assembly Bill No. 1461 provides for a manda-
tory 40 hour week for firemen after July lst, 1970; and
WHEREAS, such Bill requires a minimum 5% reduction In
duty hours each year until the 40 hour duty week becomes fully
effective on said date; and
WHEREAS, each individual city, city-county, county
government or Fire Protection District has a different type of
fire protection service, based on the fire safety needs and
the local conditions in the respective areas served; and
WHEREAS, working conditions, job descriptions, salary
classification, terms of employment are established by the in-
dividual governmental agencies ; and
WHEREAS, local agencies utilize fire departments of
full paid personnel, part paid.-volunteer, or all volunteer
departments depending on the economic feasibilities determined
by local control and local budgetary requirements; and
WHEREAS, the Bill, if it were passed, would provide
great financial burdens on the cities, City-Counties, Counties
and Fire Protections District; and
WHEREAS, this added financial burden could, because
of economic capabilities, curtail effective fire protection
for these respective entities by reductions in personnel and
equipment, thereby increasing the dangers of life and property
from the hazards of fires,

NOW THEREFORE, TIME CITY COUNCIL OF THE CITY OF HUNT-
INGTON BEACH DOES HEREBY RESOLVE:
1. That the adoption of Assembly Bill No. 1461 would
be a direct infringement on the home rule concept.
2. That the Governmental Agencies in the State of
California have attempted and will continue to at.
tempt to provide the highest level of fire protect-
ion for their coillmunities with a minimum of State
control.
3. That the City is opposed to the State establishing
further restrictions on local entities due to the
different types of fire service demands between
localities,
4. That the City of Huntington Beach does hereby ex.
press itself as being in opposition to Assembly
Bill No. 1461 in the interest of Its fire service
employees, other safety employees, miscellaneous
employees, and to the high level of fire protect.

BE IT FURTHER RESOLVED that copies of this Resolution "
be sent to members of the Assembly Committee on Industrial
Relations, Assemblymen Robert E. Badham and William E. Danne-
meyer and James E. Whetmore and to State Senator John J.
Schmitz.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, this 17Lh day of May
1965.

I, MAUL C. JONES, the duly elected qualified and act-
ing City Clerk of the City of Huntington Beach, and ex-of-
ficio Clerk of the City Council of said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is five; that the foregoing
resolution was passed and adopted by the affirmative vote
of more than a majority of all the members of said City
Council at a regular meeting thereof held on the 17ih day
