A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH DECLARING TH.,I.T THE PUBLIC
INTEREST AND NECESSITY REQUIRE THE ACQUISITION
OF CERTAIN REAL PROPERTY FOR STREET AND DRAIN-
AGE IMPROVEMENTS AND AUTHORIZING THE ACQUISIT-
ION OF SUCH PROPERTY BY CONDEMNATION OR NEGO-
TIATION AND DIRECTING ITS ATTORNEY TO PROCEED
WITH SUCH ACTION.
WHEREAS, the City of Huntington Beach is anticipating
the construction of street improvements and drainage facili-
ties at the intersection of Hamilton Avenue and Brookhurst
Street; and
WHEREAS, the construction of said street improvements
and drainage facilities is imminent and it is necessary that
certain parcels of real -property, hereinafter set forth, af-
fected by these improvements be acquired by the City of Hunt-
ington Beach; and
WHEREAS, it is in the public interest and necessity
to acquire said land for street and drainage purposes;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. Resolved by the City Council of the City of
Huntington Beach, California, that it finds and determines
and hereby declares :
(a ) That the public interest and necessity require
the acquisition, construction and completion of public Improve-
ments, namely public street and drainage facility; and
(b) That the public interest and necessity require
the acquisition for and in connection with said public im-
provement, the real property, or interest in real property,

hereinafter described; and
(c) That the proposed public improvement is planned
and located in a manner which will be most compatible with
the greatest public good and least private injury.
2. BE IT FURTHER RESOLVED that James D. Plunkett
as City Attorney for the City of Huntington Beach be, and he
is hereby authorized, directed and empowered to acquire in
the name of the City of Huntington Beach, a municipal corpora-
tion, a fee simple estate, unless a lesser estate if hereinaf-
ter expressly described, in and to the said hereinafter describ-
ed real property, or interest in real property, by negotiation,
or by condemnation, in accordance with the provisions of the
Code of Code of Civil Procedure and the Constitution of the
State of California relating to eminent domain and such other
statutes of the State of California as may be applicable to pre-
pare and prosecute in the name of the City of Huntington
Beach, such proceeding or proceedings in the proper court
having jurisdiction thereof as are necessary for such acquisit-
ions.
3. The real property, or interest in real property,
which the City of Huntington Beach is by this resolution
authorized to acquire, is situated in the City of Huntington
Beach, County of Orange, State of California, and is more par-
ticularly described as follows :

PARCEL 1.
Lot 199 Lot 21, and the west one--half (W ) of Lot
C lying between the easterly extensions of the
north and south lines of Lot 21, all of Tract No.
193 as shown on a Map recorded in Book 12, Page 49
of Miscellaneous Maps, Records of Orange County,
California
Excepting therefrom, those portions granted to the
City of Huntington. Beach by deeds recorded in Book
4680 on Page 239 and. on Page 241 of Official Records,
Records of Orange County, California
PARCEL 2*
Lot 22 and the west one-half (W-2) of Lot C lying be-
tween the easterly prolongations of the north and south
lines of Lot 22, all of Tract No. 193 as shown on a
map recorded in Book 12, Page 49 of Miscellaneous Maps,
Records of Orange County, California.
PARCEL 3.
Those portions of Tract No. 193 as shown on a map re-
corded in Book 12, Page 49, Miscellaneous Maps, Records
of Orange County, California, being more particularly
described as follows :
Parcel (a) Lot 18 of said Tract No. 193
Parcel (b) Lots 54 and 55 of said Tract No.193
Parcel (c) The east one-half (E2) of Lot C of said
Tract No. 193 lying between the westerly
prolongations of the north line of Lot 54
and the south line of Lot 55.
Parcel (d) Lot 56 and the east one-half (EJ) of Lot
C lying between the westerly prolongations
of the north and south lines of Lot 56 of
said Tract No.193.
Parcel (e) That portion, of Lot 59 of said Tract No.
193, lying westerly of the west line of
that certain right-of-way, 30.00 feet in
wid.th., dedicated to Orange County Sanita-
tion District by a deed recorded in Book
3575, Page 317 , Official Records, Records
of Orange County, California

That portion of Lot 60, Tract No. 193, as shown on a
map recorded in Book 12, Page 49, Miscellaneous Maps,
Records of Orange County, California, lying westerly
of the west line of that certain right-of-way, 30-00
feet in width, dedicated to Orange County Sanitation
District by a deed recorded in Book 3575, Page 317
Official Records, Records of Orange County, California.
PASSED AND ADOPTED by the City Council of the City of
adjourned
Huntington Beach, California, at a regular/meeting held on the
4th day of June, 1965.
