HomeMy WebLinkAboutCity Council - 2269 RESOLUTION NO. 2269 A RESOLUTION OF INTENTION OF �'YIE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA TO VACATE BORDEN DRIVE ITS SAID CITY AND GIVING NOTICE OF HEARI"LvG ON SAID 'VACAT ION. WHEREAS, Borden Drive was contemplated as a necessary access to a proposed school site; and WHEREAS, the map of Tract No. 5792 did dedicate right of way for Borden Drive; and WHEREAS, the Ocean View School District have chosen another location for this area school; and WHEREAS, the City Council of the City of Huntington Beach desires to vacate Borden Drive as hereinafter described: NOW, THEREFORE, the City Council of the City of Huntington Beach, California, does resolve, determine, find, stipulate, and declare as follows; Section 1. The City Council of the City of Huntington Beach does hereby declare its intention to vacate Borden Drive, within the City of Huntington Beach, described as follows: All of Borden Drive in Tract No. 5792 in the City of Huntington Beach, County of Orange, State of California, as per map recorded in Book 220, pages S through 11, inclusive, of Miscellaneous Maps records of said Orange County, lying Westerly of the Southwesterly prolongation of the Northwesterly line of Greenleaf Lane, 60.00 feet in width, as shown on said map. 1 Resolution No. 2269 For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of said City. Section 2. That title to Borden Drive, being vacated, described in Section 1 above shall be considered conveyed to the owner of record of Lot 126 of said Tract No. 5792. Section 3. That notice is hereby given that the 17th day of January, 1966, at the hour of 8:00 P.M. in the Council Chamber in the City Hall, Huntington Beach, California, is the time and place when and where a public hearing shall be held upon said resolution of intention to vacate said above described Borden Drive, at which hear— ing all persons interested in or objecting to the proposed vacation may be heard. Section 4. The City Clerk is hereby authorized and directed to cause a copy of this resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach, by one insertion prior to the hearing as set forth in Section 3 hereof. Section 5. The City Council of the City of Huntington Beach, in vacating Borden Drive, does elect to proceed under the provisions of the Street Vacation Act of 1941, Division 9, Part 3, of the Streets and Highway Code of the State of California. Section 6. The Street Superintendent is hereby authorized and 2 Resolution No. 2269 directed to post notices of street vacation as required by law.
