HomeMy WebLinkAboutCity Council - 2278 RESOLUTION NO- 2278 AN ORDER OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH VACATING A PORTION OF TERRY DRIVE IN SAID CITY. WHEREAS, the City Council of the City of Huntington Beach, California, did, by unanimous vote on the 18th day of October, 1965, at a regular meeting of said body, reg- ularly and duly adopt Resolution No. 2244, entitled "A Resolution of Intention of the City Council of the City of Huntington Beach, California, to Vacate a Portion of Terry Drive in said City and Giving Notice of Hearing on said Vacation;" and AREAS, the City Council of the City of Huntington Beach did elect to proceed under the provisions of the Street Vacation Act of 1941; and WHEREAS, the portion of the street lies within the City of Huntington Beach and is not a portion of a State Highway; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation printed and published in the City of Huntington Beach, by one insertion on the 21st day of October, 1965; and WHEREAS, said resolution contained a notice that the 6th day of December, 1965, at the hour of 8:00 P. M. Res. No. 2278 in the Council Chamber in the City Hall, Huntington Beach, California, was the time and place when and where a public hearing was to be held upon said resolution of intention at which hearing all persons interested in or objecting to the proposed vacation may be heard; and WHEREAS, notice of street vacation was posted as required by law-, NOW, THEREFORE, the City Council of the City of Huntington Beach does resolve as follows: Section 1. The City Council of the City of Hunt- ington Beach, after hearing the evidence offered by all persons interested appearing before said Council, does hereby find from all the evidence submitted that the portion of Terry Drive herein described is unnecessary for present or prospective public street and alley purposes. Section 2. It is hereby ordered that a portion of that certain street in the City of Huntington Beach described as: Commencing at the Southwest corner of Lo� 1 of said Tract No. 5735; thence North 0 17t 30" East along the Westerly line of said Lot 1 a distance of 60.00 feet to the true point of beginning, said point being the beginning of a tangent curve concave Southeasterly having a radius of 20.00 feet; thence Northeasterly along said curve through a central angle of 99 33t 26" an are distance of 34.75 feet to a tangent reverse curve concave Northerly 2. Res. No. 2278 having a radius of 40.00 feet; thence Easterly and Northeasterly through a central angle of 52 121 25" an are distance of 36.45 feet to a. tangent reverse curve concave Southeasterly having a radius of 50.00 feet; thence Northeasterly along sgid curve through a central angle of 19 451 34" an are distance of 17.24 feet to a point on the Northerlg line of said Lot 1; thence North 89 311 29" West 51.52 feet to a tangent curve concave Southeasterly having a radius of 20.00 feet; thence Southwesterly, along Said curve, through a central angle of 90 111 01" an are distance of 31.48 feet; thence South Oo 17t 30" West 19.20 feet to the true point of beginning. For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of said City. be and the same in hereby vacated for public street and alley purposes, subject to the reservation of easements and rights of-way set forth in Section 8330 of the Streets and Highways Code of the State of California. Section 3. The City Clerk is hereby authorized and directed to cause a certified copy of this order, attested by the Clerk under the seal of this City, together with a certified copy of Resolution No. 2244 to be recorded in the office of the County Recorder of Orange County, California.
