HomeMy WebLinkAboutCity Council - 2290 RESOLUTION NO. 2290 A RESOLUTION OF MENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA TO VACATE PORTIONS OF BOLSA AVENUE AND SPRINGDA:LE STREET IN SAID CITY AND GIVING NOTICE OF BEARING ON SAID VACATION. WHEREAS, the Orange County Flood Control District C-4 Channel and facilities, on temporary status, formerly occupied portions of the rights-of-way of Bolsa Avenue and Springdale Street; and WHEREAS, the Orange County Flood Control District C-,l,. Channel and facilities, on permanent status, occupy permanent rights-of-vay; and WHEREAS, Bolsa Avenue and Springdale Street have been designed and realigned to accommodate the positions of the above mentioned channel and facilities; and WHEREAS., the designed realignments have created three areas which are surplus and are of no benefit to the public use; and WHEREAS, the City Council of the City of Huntington Beach desires to vacate those portions of Bolsa Avenue and Springdale Street as here- inafter described.- NOW., THEREFORE, the City Council of the City of Huntington Beach, California, does resolve, determine, find, stipulate, and declare as follows: Section 1. The City Council of the City of Huntington Beach does hereby declare its intention to vacate that portion of Bolsa Avenue, Within the City of Huntington Beach, denoted on the attached plat as Parcel A. described as follows: 1 Resolution No. 2290 That portion of the southwest quarter of Section 10, Township 5 South, Range 11 West, ;San Bernardino Base and Meridian, in the County of Orange, State of California, as shown on a map recorded in Book 51, Page 13 of Miscellaneous Maps, Records of Orange County described as follows: Beginning at the southwest corner of said section, said corner being the centerline intersection of Springdale Street and Bolas, Avenue; thence North ggo 34t 13" east along the south line of said section, said south line being the centerline of Bolsa Avenue, a distance of 289.87 feet to the beginning of a tangent curve, concave to the southwest and having a radius of 1200.00 feet; thence southeasterly along said curve through a central angle of 100 131 250, an are distance of 21.4,12 feet; thence north 90 47' 38" east radially a distance of 60.00 feet to a point on a non tangent curve, concave to the southwest and having a radius of 1260.00 feet, said point being the trine point of beginning; thence north W 34' 13" east 81.39 feet to a point on a non tangent curve, concave northeasterly and northwesterly, having a radius of 30.00 feet, a radial line through said point bears north 1+60 25t 25" west; thence southwesterly and northwesterly along said curve through a central angle of 530 371 44", an are distance of 28.08 feet to the beginning of a compound curve, concave to the northeast and having a radius of 1140,00 feet, a radial line through said beginning of compound curve bears north 70 12' 190 east; thence northwesterly along said compound curve through a central angle of 20 421 31", an are distance of 53•89 feet to the beginning of a reverse curve, concave to the southwest and having a radius of 1260.00 feet, a radial line through said beginning of reverse 2 Resolution No. 2290 curve bears north 90 54' 50" east; thence northwesterly along said reverse curve through a central angle of 00 07' 12", an are distance of 2.61+ feet to the true point of beginning. Section 2. The City Comcil of the City of Huntington Beach does hereby declare its intention to vacate that portion of Bolsa Avenue, within the City of Huntington Beach, denoted on the attached plat as Parcel B, described as follows: That portion of the southwest quarter of Section 10, Township 5 South, Range 11 West, San Bernardino Base and Meridian, in the County of Orange.. State of California, as shown on a map recorded in Book 51, 13 Page/of Miscellaneous Maps, records of Orange County, described as follows: Beginning at the southwest corner of said section, said corner being the centerline intersection of Springdale .Street and Bolsa Avenue; thence north 890 341 13" east along the south line of said southwest quarter a distance of 720.80 feet; thence north OP 251 47" west a distance of 21.00 feet to the true point of beginning; thence north 890 34' 13" east, parallel with the south line of said southwest quarter, a distance of 12.02 feet; thence north OP 251 1+7" west a distance of 19.00 feet; thence south 89° 34' 13" west, parallel with the south line of said southwest quarter, a distance of 97.25 feet to a point on a non tangent curve, concave to the northeast and having a radius of 30.00 feet, a radial line through said point bears north 670 211 37" east; thence southeasterly along said curve through a central angle of 66° 221 2211, an are distance of 34.75 feet to the beginning of a compound curve, concave northerly 3 Resolution No. 2290 and having a radius of U40.00 feet, a radial line through said beginning of compound curve bears north 00 59' 15" east; thence easterly along said curve through a central angle of 10 251 02", an are distance of 28.20 feet to the true point of beginning. Section 3. The City Council of the City of Huntington Beach does hereby declare its intention to vacate that portion of Springdale Street, within the City of Huntington Beach, denoted on the attached plat as Parcel C, described as follows: That portion of the northwest quarter of Section 15, Township 5 South, Range 11 West, San Bernardino and Meridian, in the County of Orange, State of California, as shown on a map recorded in Book 51, Page 13 of Miscellaneous Maps, records of Orange County, described as follows: Beginning at the northwest corner of said northwest quarter, said corner being the centerline intersection of Springdale Street and Bolsa Avenue; thence south 00 40' 25" east along the west line of said north_ west quarter, a distance of 590.82 feet; thence north 890 34= 26" east a distance of 7.00 feet to the true point of beginning; thence contin- uing along said course a distance of 23.00 feet to a line bearing north 00 401 25" west, parallel with the west line of said northwest quarter and distant 30.00 feet easterly therefrom; thence northerly along said course a distance of 208.63 feet to a point on a non tangent curve, concave northwesterly and having a radius of 1050.00 feet, a radial line through said point bears north 79° 28' 22" west, thence southwest- erly along said curve through a central angle of 00 /+221 06*, an are distance of 12.86 feet to the beginning of a reverse curve, concave to the southeast and having a radius of 950.00 feet, a radial line through said beginning of reverse curve bears north 780 461 16" west; thence 4 Resolution No. 2290 southwesterly along said curve through a central angle of 110 54' 09".. an are distance of 197.35 feet to the intersection of a line bearing north 890 34' 26" east, a radial line through said point bears north 890 19' 35" east, said point of intersection being the true point of beginning. Section /+. That for further particulars as to the proposed vaca- tion, reference is hereby made to a map on file in the office of the City Clerk of said City. Section 5. That title to those portions of right-of-vay, being vacated, shall be considered to have the following dispositions: A. Title to that portion of Bolea Avenue, described as Parcel A in Section 1 above, shall be considered conveyed to the owners of record of the property northerly of and adjacent to the northerly line of Parcel A. B. Title to that portion of Bolsa Avenue, described as Parcel B in Section 2 above, shall be considered conveyed to the owners of record of the property northerly of and adjacent to the northerly line of Parcel B. C. Title to that portion of Springdale Street, described as Parcel C in Section 3 above, shall be considered conveyed to the owners of record of the property easterly of and adjacent to the easterly line of Parcel C. Section 6. That notice is hereby given that the 7th day of February, 1966, at the hour of 8:00 o'clock P.M. in the Council Chamber in the City Hall, Huntington Beach, California, is the time and place 5 Resolution No. 2290 when and where a public hearing shall be held upon said resolution of intention to vacate said above described portions of Bolsa Avenue and Springdale Street, at which hearing all persons interested in or ob- jecting to the proposed vacation may be heard. Section 7. The City Clerk is hereby is hereby authorized and directed to cause a copy of this resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach, by one insertion prior to the hearing as set forth in Section 6 hereof. Section 8. The City Council of the City of Huntington Beach, in vacating the portions of Bolas. Avenue and Springdale Street, as above described, does elect to proceed under the provisions of the Street Vacation Act of 1941, Division 9, Part 3, of the Streets and Highway Code of the State of California. Section 9. The Street Superintendent is hereby authorized and directed to post notices of street vacation as required by law.
