HomeMy WebLinkAboutCity Council - 2291 RESOLUTION NO.2291 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA TO VACATE TWO PORTIONS OF AN ALLY LOCATED IN TRACT NO. 1*992 IN SAID CITY AND GIVING NOTICE OF HEARING ON SAID VACATION. WHEREAS, the map of Tract No. 1+992, dedicated an alley, with a tuna-around area at its northerly terminus, to the public use; and WHEREAS, the map of Tract No. 5661 dedicated an alley, which provided through traffic for the previous mentioned alley, to the public use; and WHEPXJ3,, two surplus areas, of no further value to the public, were created by the completion of the alley route; and WHERE',, the City Council of the City of Huntington Beach desires to vacate those portions of alley as hereinafter described: NOW, THEREFORE, the City Council of the City of Huntington Beach, California, does resolve, determine, find, stipulate, and declare as follows: Section 1. The City Council of the City of Huntington Beach does hereby declare its intention to vacate those portions of alley, within the City of Huntington Beach, described as follows: Those portions of alley, shown on a map of Tract No. 1*992, recorded in Book 197, Pages 1 and 2 of Miscellaneous Maps, records of Orange County, California, being more particularly described as follows.- Parcel At Beginning at the southeast corner of Lot No. 50 of said Tract No. 4992; thence north 0o 30' 150 west 61*.00 feet to the True Point of 1 Resolution No. 2291 Beginning; thence north 450 301 15" west 14.14. feet to a point; thence north 00 30' 15" west 20.00 feet to a point in the north boundary line of Tract No. 4992; thence north 890 29' 45" east 18.92 feet, along said boundary line, to a point; thence south 160 031 15" West 31.30 feet to the True Point of Beginning. Parcel B.-,, Beginning at the southwest corner of Lot No. 57 of said Tract No. 4992; thence north 00 30' 15" west 37.64 feet to the True Point of Beginning; thence north 170 55' 51" east 31.62 feet to a point in the north boundary line of Tract No. 4992; thence south 00 301 15" east 20.00 feet to a point; thence south 440 29' 45" west 14.14 feet to the True Point of Beginning. For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of said City. Section 2. That title to Parcel A, being vacated, described in Section 1 above shall be considered conveyed to the owner of record of Lot no. 50 of said Tract No. 4992. Section 3. That title to Parcel B, being vacated, described in Section 1 above shall be considered conveyed to the owner of record of Lot No. 57 of said Tract No. 4992. Section 4, That notice is hereby given that the 7th day of February, 1966, at the hour of 8:00 o'clock P.M, in the Council Chamber in the City Hall, Huntington Beach, California, is the time and place 2 Resolution No. 2291 when and where a public hearing shall be held upon said resolution of intention to vacate two portions of an alley located in Tract No. 4992, at which hearing all persons interested in or objecting to the proposed vacation may be heard. Section 5. The City Clerk is hereby authorized and directed to cause a copy of this resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach, by one insertion prior to the hearing as set forth in Section 4 hereof. Section 6. The City Council of the City of Huntington Beach, in vacating the portions of an alley located in Tract No. 4992, as above described, does elect to proceed under the provisions of the Street Vacation Act of 1941, Division 9, Part 3, of the Streets and Highway Code of the State of California. Section 7. The Street Superintendent is hereby authorized and directed to post notices of street vacation as required by law. PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California, at a regular meeting thereof held on the 3rd day of January, 1966.
