HomeMy WebLinkAboutCity Council - 2331 RESOLUTION No. 2331 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH RELATING TO THE DE14OLITION OF UNSAFE BUILDINGS AND STRUCT- URES; ESTABLISHING A BOARD OF APPEALS AND DIRECTING THE MAYOR TO APPOINT MEMBERS THEREOF. WHEREAS, the City of Huntington Beach has adopted the Uniform Building Code, copyrighted by the International Conference of Building Officials, as part of its Ordinance Code; and WHEREAS, Section 203(d) of the Uniform Building Code gives the City Council the right to order a building or structure demolished, after due notice, in the event it is determined to be unsafe; and WHEREAS, Section 204 of said Code sets up a Board of Appeals and reads as follows: "Sec.204. In order to determine the suitability of alternate materials and types of construction and to provide for reasonable interpretations of the provisions of this Code, there shall be and is hereby created a Board of Appeals, consisting of five members who are qualified by experience and training to pass upon matters pertaining to build- ing construction. The Building Official shall be an ex-officto member and shell act as Secretary of the Board. The Board of Appeals shall be ap- pointed by the Mayor and shall hold office at his pleasure. The Board shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the Building Official with a duplicate copy to the appellant and may recommend to the City Council such new legislation as is consistent therewith"; and WHEREAS, in order to facilitate the demolition of 1. Res. No. 2331 unsafe struc tures and buildings, it is necessary to appoint members of the Board of Appeals pursuant to Section 204; and WHEREAS, it is further necessary that the City Council delegate to said Board of Appeals, all of the powers necessary to bring an Order to Show Cause why buildings or structures should not be demolished; and further delegate to the Board of Appeals the power to order said demolition of said buildings or structures, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Huntington Beach that the City Council hereby Implements Section 204 of the Uniform Building Code and di- rects the Mayor of the City of Huntington Beach, sub3ect to the approval of the City Council, to appoint members to the Board of Appeals, with all of the powers necessary to bring an Order to Show Cause why buildings or structures should not be demolished, after being determined to be unsafe, and after due notice and hearing, and to carry out any and all functions necessary to remove unsafe buildings and structures in the City of Huntington Beach.
