HomeMy WebLinkAboutCity Council - 2342 RESOLUTION NO. 2 342 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, DECLARING A NUISANCE TO EXIST AND PROVIDING FOR THE ABATREM THEREOF. WAS, there are, growing upon the streets and sidewalks and private property within the City of Huntington Beach, California, noxious weeds which attain and have attained such large growth as to become a fire menace when dry, and which have become dry and are of such growth and density as to constitute a public nuisance and obstruct the public streets and sidewalks, and which are otherwise noxious and dangerous; and WHEREAS, there is now upon the streets, sidewalks and private property within the City of Huntington Beach, California, rubbish, re— fuse and dirt which constitutes a public nuisance and obstructs the parkways, public streets and sidewalks; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that the said condition and the said weeds, rubbish, refuse and dirt, all and singular, do constitute and are hereby declared to constitute a public nuisance; and BE IT FURTFER RESOLVED that the Superintendent of Streets shall cause notices to be conspicuously, posted on or in front of the property on or in front of which the nuisance exists, as follows: (a) One (1) notice to each separately owned parcel of property of not over fifty (50) feet frontage. (b) Not more than two (2) notices to any such parcel of one hundred (100) feet frontage or less. 1 Resolution No. 2 342 (c) Notices at not more than one hundred (100) feet apart if the frontage of such a parcel is greater than one hundred (100) feet. BE IT FURTHER, RESOLVED that the headings of the notices shall be.- "NOTICE TO DESTROY WEEDS AND REMOVE RUBBISH, USE AND DIRT", and such heading shall be in letters not less than one (1) inch in height, and shall be substantially in the following form: NOTICE TO DESTROY WMS AND REMOVE RUBBISH• REFUSE AND DIRT Notice is hereby given that on the 21st day of March, 1966, the City Council of the City of Huntington Beach passed a resolution declar— ing that noxious and dangerous weeds were growing upon or in front of the property on this street, and that rubbish, refuse and dirt were upon or in front of property on this street in the City of Huntington Beach and more particularly described in the resolution, and that they constitute a public nuisance which must be abated by the removal of the weeds, rubbish, refuse and dirt. Otherwise they will be removed and the nuisance abated by the City and the cost of removal will be assessed upon the land from or in front of which the weeds, rubbish, refuse and dirt are removed and will constitute a lien upon such land until paid. Reference is hereby made to the resolution for further particulars. A copy of said resolution is on file in the office of the City Clerk. All property owners having any objections to the proposed removal of the weeds, rubbish, refuse and dirt are hereby notified to attend a meeting of the City Council, City of Huntington Beach, to be held on the 2nd day of May, 1966, when their objection will be heard and given due consideration. BE IT FURTHER RESOLVED that the streets, sidewalks and private property referred to are described as lying within the city limits and boundaries 2 Resolution No. 2342 of the City of Huntington Beach as they exist as of this date. BE IT FURTHER RESOLVED that the time and place for hearing any and all objections or protests to the proposed removal of such weeds, refuse, dirt and rubbish by the City Council of the City of Huntington Beach is hereby fixed at a regular meeting of said City Council to be held on the 2nd day of May, 1966, at the hour of 7:30 o'clock P.M. or as soon there- after as possible of said day, at the City Hall of said City of Huntington Beach, and at said time and place the said City Council will hear and consider all such protests and objections.
