A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH AUTHORIZING FILING OF
APPLICATION FOR URBAN BEAUTIFICATION GRANT.
WHEREAS, Title IX of the Housing and Urban Develop-
ment Act of 1965 amends Title VII of the Housing Act of
1961 and provides for the making of grants by the Depart-
ment of Housing and Urban Development to States and local
public bodies to assist them in the beautification and im-
provement of open-space and other public urban land where
such assistance is needed for carrying out a local program
which is important to the comprehensively planned develop-
ment of the locality; and
WHEREAS, the City of Huntington Beach desires to beaut-
ify and improve open-space and other urban land to facilitate
their increased used and enjoyment; and
WHEREAS, Title VI of the Civil Rights Act of 1964 and
the regulations of the Department of Housing and Urban Devel-
opment effectuating that Title prohibit discrimination on the
basis of race, creed, color, or national origin in the use
of all facilities and improvements provided by Federal assist-
ance; and
WHEREAS, the City of Huntington Beach is cognizant of
the conditions that are imposed in the undertaking and carry-
ing out of programs assisted under Title VII of the Housing
Act of 1961, as amended, including those relating to labor
standards and equal employment opportunity; and
WHEREAS, it is estimated that the cost of the activi-
ties proposed to be carried out in performance of beautifica-
tion and improvement of open space and other public land
exceeds the usual expenditures of the City of Huntington
Beach for comparable activities by 901'62.8. 00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUN`I'INGTON BEACH:
1. That an application be made to the Department of
Housing and Urban Development for a grant in an amount auth-
orized by Title VII of the Housing Act of 1961, as amended,
for urban beautification and improvement of open-space and
other ublic urban land, which amount is presently estimated
to be 45,514.00, and that the City of Huntington Beach will
provide the balance of the cost.

2. That the Mayor and City C'lerk are hereby author-
ized and directed to execute and to file such application
with the Department of Housing and Urban Development, to pro-
vide additional information and to furnish such documents
as may be required by said Department, to execute such con-
tracts as are required by said Department, and to act as the
authorized correspondent of the City of Huntington Beach.
3. That the proposed urban beautification activities
are in accordance with the beautification program prepared
by the City of Huntington Beach, of importance to the com-
prehensively planned development of the locality, and that,
should said grant application be approved, the City of Hunting-
ton Beach will undertake, carry out, and complete said urban
beautification activities designated in said application and
approved by the Department of Housing acid Urban Development.
4. That the United States of America and the Secre-
tary of Housing and Urban Development be, and they hereby are,
assured of full compliance by the City of Huntington Beach
with regulations of the Department of Housing and Urban De-
velopment effectuating Title VI of the Civil Rights Act of
1964.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California , this 18th day of April, 1966.

CERTIFICATE OF RECORDING OFFICER
The undersigned hereby certifies that:
1. He is the duly qualified and acting City Clerk of the
City of Huntington Beach, and the keeper of its records.
2. The attached resolution is a true and correct copy
of the resolution as finally adopted at a meeting of the City
Council of the City of Huntington Beach held on the 18th day
of April, 1966, and duly recorded in his office.
3. The meeting was duly convened and held in all re-
spects in accordance with law and, to the extent required by
law, due and proper notice of the meeting was given. A legal
quorum was present throughout the meeting, and a legally suf-
ficient number of members of the City Council voted in the
proper manner for the adoption of the resolution. All other
requirements and proceedings under law incident to the proper
adoption or passage of the resolution have been duly fulfilled,
carried out, and otherwise observed.
4. If an impression of the seal has been affixed below,
it constitutes the official seal of the City of Huntington
Beach, and, this certificate is hereby executed under the of-
ficial seal.
3. The undersigned is duly authorized to execute this
certificate.

Gentlemen:
I am an attorney-at-law admitted to practice in the State
of California.
I have examined your application for a grant under 'Title
VII of the Housing Act of 1961, as amended, whereby assistance is
requested in the beautification and improvement of open-space and
other public urban land.
I have also reviewed all pertinent Federal, State and lo-
cal laws, including local charter provisions, and particularly
Article IV, Sections 400 and 401, City Charter, City of Huntington
Beach, which establish the City of Huntington Beach as a public
body, empower it to receive and expend Federal, State and local
funds , and empower it to contract with the United States of Ameri-
ca for the purpose of receiving an urban beautification grant un-
der Title VII of the Housing Act of 1961, as amended.
I have made appropriate inquiry and I am satisfied that
there is no pending or threatened litigation, in either Federal
or State courts, challenging your authority to beautify and improve
open-space and other public urban land or to contract with the
Federal Government for the purpose of receiving an urban beautifi-
cation grant under Title VII of the Housing Act of 1961, as amended.
Based upon the foregoing, it is my opinion that the City
of Huntington Beach is a public body empowered to receive and ex-
pend Federal, State, and local funds, to contract with the United
States of America for the purpose of receiving an urban beautifica-
tion grant under Title VII of the Housing Act of 1961, as amended,
and to undertake and complete the proposed urban beautification
activities designated in said application.
