Box 190, Huntington Beach, Calif. Attn:Paul C. Jones, City Clerk Gentlemen: I am an attorney-at-law admitted to practice in the State of California. I have examined your application for a grant under 'Title VII of the Housing Act of 1961, as amended, whereby assistance is requested in the beautification and improvement of open-space and other public urban land. I have also reviewed all pertinent Federal, State and lo- cal laws, including local charter provisions, and particularly Article IV, Sections 400 and 401, City Charter, City of Huntington Beach, which establish the City of Huntington Beach as a public body, empower it to receive and expend Federal, State and local funds , and empower it to contract with the United States of Ameri- ca for the purpose of receiving an urban beautification grant un- der Title VII of the Housing Act of 1961, as amended. I have made appropriate inquiry and I am satisfied that there is no pending or threatened litigation, in either Federal or State courts, challenging your authority to beautify and improve open-space and other public urban land or to contract with the Federal Government for the purpose of receiving an urban beautifi- cation grant under Title VII of the Housing Act of 1961, as amended. Based upon the foregoing, it is my opinion that the City of Huntington Beach is a public body empowered to receive and ex- pend Federal, State, and local funds, to contract with the United States of America for the purpose of receiving an urban beautifica- tion grant under Title VII of the Housing Act of 1961, as amended, and to undertake and complete the proposed urban beautification activities designated in said application.
