HomeMy WebLinkAboutCity Council - 2403 RESOLUTION No 2403 A RESOLUTION AUTHORIZING AND DIRECTING THE CON- DEMNATION OF CERTAIN RLAL PROPERTY AND PERSONAL PROPERTY IN THE COUNTY OF ORANGE, STATE OF CALIFORNIA, AND DECLEtRING THE PUBLIC NECESSITY THEREFOR WHEREAS, the City of Huntington Beach is authorized,by virtue of the statutes of the State of California, to take prop- erty by condemnation and hold, use and enjoy said property as necessary to the full exercise of its power NOW, THEREFORE, the City Council of the City of Hunting- ton Beach does hereby resolve as follows Section 1 That the City Council of the City of Hunt- ington Beach has found and determined and does hereby find and determine that the public interest and necessity require for public use the acquisition, operation and maintenance by said City of Huntington Beach of certain real and personal property, to lilt The entire water system of the Sunset Beach-Surfside Water Company, including the pump station site, wells and reservoirs, water rignts and franchises , water mains in place and appurtenances necessary or incidental thereto, including easements and rights of way, office building, and all other real and personal property hereinafter described, situated both in and outside of the City of Huntington Beach, in the County of Orange, State of California, that said acquisition is for the purpose of conducting, storing and distributing water to the City of Huntington Beach and its inhabitants and the inhabitants of neighborhoods and communities nearby or 1• Re s No adjacent thereto, and for the purpose of insuring an adequate domestic water supply for the present and future needs of the City of Huntington Beach and its inhabitants and the inhabi- tants of neighborhoods and communities nearby or adjacent thereto. Section 2. That the real property, the acquisition of which is required for the public interest and necessity for the uses and purposes set forth in Section 1 hereof, is situat- ed in the County of Orange, State of California , and is more particularly described as follows, to-wit Legal description of real property to be acquired by the City of huntington Beach from Sunset Beach- Surfside Water Company PARCEL 1 That portion of the northeast quarter of the northwest quarter of fractional section 29, Township 5 South, Range 11 West, San Bernardino Base and Meridian, in the City of Hunting- ton Beach, as per map recorded in Book 51, paoe 13 of Miscell- aneous Daps , records of Orange County, described as follows Beginning at the Southeast corner of the Northeast one-quarter of the Northwes8 one-quarter of said frac-c�ional Section 29, thence South 89 51'53" West 50 22 feet along the South line of the Northeast quarter of the Northwest quarter of said fract- ional Section 29 to a point, said line also being the Easterly prolongation of the centerline of Warner Avenue, thence North 00 08 '07" West 30 00 feet to the true point of beginning, said point lies on a line 30 00 feet, measured at right angles , North of the Easterly centerline prolongation of Warner Avenue, thence South 89 51'53" West 253 79 feet along said line to a point also lying on a curve coiicave to the Northwest and having a radius of 645 00 feet, a radial line through said point bears South 28002127 ' East , thence Northeasterly along said curve 110.84 feet through a central angle of 90 50 '3811 to a point, said point also lying on a line 90 00 feet, measured at right angles North of the Easterly prolongation of Warner Avenue, thence North 89051'53" East 180 38 feet along said line to a point, said point also lying on a line 30 00 feet, measured at right angles West of the East line of the Northeast one-quarter of the Northwest one-quarter of said fractional Section 29, thence South 0043122" 39.79 feet along said line to a point 2. Res No. said point also lying on a tangent curve concave to the North- west and having a radius of 20 00 feet, thence Southwesterly 31 62 feet along said curve through a central angle of 90035' 15t1 to the true point of beginning PARCEL 2 That portion of Fractional Section 24, Township 5 South, Range 12 West, as shown on a Map of Government Survey approv- ed April 7, 1914 by Frank C Gould, United States Surveyor General for California, being a portion of the Parcel of land described in the Patent to John C Ord recorded July 13, 19169 in Book 1, page 303 of Patents , records of Orange County, California , described as follows Beginning at a point on the Northeasterly line of the 50 foot right of way aescribed in the deed to Pacific Electric Railway Company, recorded June 15, 1917 in Book 302, page 106 of Deeds , distant 40 feet Northwesterly from the Northwesterly line and/or the Southwesterly extension thereof, of the Rancho La Bolsa Chica, as shown on a Map recorded in Book 1, page 431 of Patents, records of Los Angeles County, California , thence North- westerly along said Northeasterly line of the Pacific Electric Railway Company, 100 feet, thence Northeasterly parallel to the Northwesterly line of Rancho La Bolsa Chica, 60 feet, thence Southeasterly parallel to said Northeasterly line of the Pac- ific Electric Railway Company, 100 feet, thence Southwesterly parallel with the Northwesterly line of said Rancho La Bolsa Chica, 60 feet to the point of beginning Section 3 That the personal property, the acquisition of which is required by the public interest and necessity for the uses and purposes set forth in Section 1 hereof, is situat- ed in the county of Orange, State of California, and is more particularly describea as follows, to-wit A. That the City Council of the City of Hunt- ington Beach hereby declares its intention to acquire the real property described in Section 2 and the personal property de- scribed in Section 3 hereof by proceedings in eminent domain. That K Dale Bush, City Attorney for the City of Huntington Beach, and Rutan &.
