HomeMy WebLinkAboutCity Council - 2462 RESOLUTION N0. 2462 A RESOLUTION OF IN!tENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO VACATE A PORTION OF ALGONQUIN STREET IN SAID CITY AND GIVING NOTICE OF HEARING ON SAID VACATION. WHEREAS, Algonquin Street, in the vicinity of Warner Avenue* has been realigned recently and a portion of Algonquin Street is no longer necessary for public use; and WHEREAS. the vacation of a portion of Algonquin Street will not be in conflict with the Master Plan of Arterial Streets and Highways; and WHEREAS, the City Council desires to vacate that portion of Algonquin Street as hereinafter described. NOW, THEREFORE# the City Council of the City of Huntington Beaoh, California, does resolve, determine* find and declare as follows: Section 1. The City Council of the City of Huntington Beach does hereby declare its intention to vacate a portion of Algonquin Street, within the City of Huntington Beach, described as follows: That portion of the Northeast quarter of fractional Section 29, Township 5 South, Range 11 Westq San Bernardino Base and Meridian, in the City of Huntington Beach, County of Orange, State of California, as per a map recorded in Book 51 page 13 of Miscellaneous Maps, Records of said County, described as follows: Beginning at the Northwest corner of the Northeast quarter of said fractional Section 29; thence South 0° 43t 22" East, 57.01 feet along the Westerly line of the Northeast quarter of said fractional Section 29 to a point on a curve eDneave to the Northeast, having a radius of 390.00 feet, a radial through said point bears South 59° 59* 01" West# said point is the true point of beginning; thence continuing South 0° 43* 22" East 150.99 feet along the Westerly line of the Northeast quarter of said fractional Section 29 to a point on a tangent curve concave to 1. RESOLUTION NO. 2462 the Northeast having a radius of 6000 feet; thence Southeasterly 49.38 feet along said curve through a central angle of 47° 099 22" to a point of reverse curvature, said curve concave to the Southwest having a radius of 40.00 feet; thence Southeasterly 1.13 feet along said curve through a central angle of 1° 36* 47" to a point on a line parallel with and 20.00 feet Easterly, measured at right angles, from the Westerly line of the Northeast quarter of said fractional Section 29: a radial line throw said point bears North 43° 44' 03" East; thence North 0" 439 22" West 163.82 feet along said line parallel with and 20.00 feet Easterly, measured at right angles, from the Westerly line of the Northeast quarter of said fractional Section 29 to a point on the before described curve, concave to the Northeast having a radius of 390.00 feet, a radial line through said point bears South 540 26. 47" West; thence Northwesterly along said curve 37.69 feet through a central angle of 50 320 14" to the true point of beginning. Section 2. The City Council of the City of Huntington Beach further declares and stipulates that reserved and excepted from the vacation are the non-exclusive rights at any time, or from time to time, to construct, maintains: operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any highway or part thereof proposed to be abandoned and pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, rail- road lines and for the transportAtion or distribution of electric energy, petroleum, and its products, ammonia, water, and for incidental purposes, 2. RESOLUTION NO. 2462 including access to protect the property from all hazards i.n, upon and over the above described Algonquin Street. Section 3. That notice is hereby given that the 3rd day of January, 1967, at the hour of 8:00 P.M, in the Council Chamber in the City Hall, Huntington Beach, California, is the time and place when and where a public hearing shall be held upon said resolution of intention to vacate said above described portion of Algonquin Street, with the above mentioned reservations, at which hearing all persons interested in or objecting to the proposed vacation may be heard. Section 4. The City Clerk is hereby authorized and directed to cause a copy of this resolution of intention to be published in the Huntington Beach News, a newspaper of genergl circulation, printed and published in the City of Huntington Beach, by one insertion prior to the hearing, as set forth in Section 3 hereof. Section 5. The City Council of the City of Huntington Beach, in vacating the Algonquin Street, as above described, does elect to proceed under the provisions of the Street Vacation Act of 1941, Division 99 Part 3, of the Streets and Highway Code of the State of California. Section 6. The Street Superintendent is hereby authorized and directed to post notices of street vacation, as required by law.
