HomeMy WebLinkAboutCity Council - 2530 RES OLUT ION OF INT ENT ION NO. 2530 A,SSESSN7ENT DISTRICT 64403 HUNTINGTON BEACH, CALIFORNIA The City Council of the City of Huntington Beach, California, in regular session assembled, does hereby resolve and determine as follows: SECTION 1: That the public interest and convenience require, and that it is the intention of said City Council to order the following work to be done or improvements to be made in said City of Huntington Beach, California, to wit: The construction and installation of concrete curb and gutter, concrete driveways , asphalt concrete pavement over aggregate i base material, the removal of existing pavement, asphalt, concrete and gravel driveways , concrete sidewalk, concrete curb , fences , and trees and all other obstacles in the line of work and within the public right of way, the relocation of existing mail boxes and traffic control signs , together with appurtenances and appurtenant work, in Newman Avenue from a point therein 133 feet West of its intersection with the construction center line of Beach Boulevard to a point in Newman Avenue 1284 feet West of said construction center line; but , excepting therefrom any of said work in the Northerly one-half of Newman Avenue from a point therein 133 feet West of its intersection with said construction center line of Beach Boulevard to a point in Newman Avenue 228 feet West of said construction center line; together with the construction and installation of on site driveways at premises numbers 7851, 7861, 7862, 7872 , and 7881 Newman Avenue, all private property, to eliminate any disparity in level between said public improvement and said drive- ways . Said City Council hereby finds and determines that a disparity in level between said public improvement and said real property will result from said work, that it is in the public interest and more economical to do such work on said private property than to adjust said public improvement to eliminate such disparity, that the owners of said real property have consented to such work in said real property, and that said City Council will order said work in said real property after acquiring jurisdiction to order said public improvement. -1- Rex. No. 2530 SECTION 2: All of the above mentioned work, including the grade to which said work shall be done and the location there- of in and upon the streets and rights of way above mentioned, shall be done upon the grades , along the lines , between the points, of the dimensions , at the places and in the manner described and set forth in the plans, profiles and detailed drawings of said work, and to specifications for said work heretofore adopted by said City Council on March 20, 1967 by its Resolution No. 2527` , which plans , profiles , detailed drawings and specifications are on file in the office of the City Clerk and which are hereby referred to for a more particular description of said work, grade of said work, and location of said work in and along the streets and rights of way hereinbefore mentioned. SECTION 3: The expenses and cost of said work and im- provement shall be chargeable upon a district, which said district said City Council hereby declares to be the district benefited by the work and improvements herein described and to be assessed to pay the cost and expenses thereof; said district shall include that territory in said City of Huntington Beach, California which is shown upon that certain plat or map thereof on file in the office of the City Clerk, entitled "MAP OF ASSESSMENT DISTRICT NO. 6403, CITY OF HUNT INGTON BEACH, CALIFORM_.," and which said map or plat .indicates by a boundary line the extent of the territory included in the proposed district and covers all details as to the extent of the area to be assessed; said map or plat is hereby -2- Res. No. 2530 referred to for further detail. SECTION 4: NOTICE IS HEREBY GIVEN that s er is 1 bonds shall be issued in the manner and form provided in Part 5 , Division 7 of the Streets and Highways Code of the State of California , the Improvement Act of 1911, to represent unpaid assessments of Fifty Dollars ($50.00) or over, which said bonds shall bear interest at the rate of six percent (6%) per annum and the last installment of which bonds shall mature nine (9) years from the second day of January next succeeding the first day of September following their date . SECTION 5: NOTICE IS HEREBY FURTHER GIVEN that on Monday, the lst day of May, 1967 at the hour of 7:30 o'clock P.M. of said day, or as soon thereafter as said hearing can be held, in the council chambers in the City Hall of said City of Huntington Beach, the meeting place of said City Council, any and all persons having any objections to the proposed work or improvements , or any ob- jections to the grades to which said work is to be done , or any objections to the boundaries of the district proposed to be assessed to pay the cost and expense of said work or improvement, may appear before said City Council and show cause why said proposed work or improvement should not be carried out in accordance with this resolution of intention, and may present written protests in the form and manner required by law not later than the hour hereinabove set for hearing objections against the doing of said work, the grades to which said work is to be done, or the extent of the territory to -3- Res. No. 2530 be assessed to pay the cost and expenses thereof. Said hearing shall be held concurrently with the public hearing upon the Investigation Report of the City Engineer, as called and set by Resolution No. 2529 of this City Council adopted March 20, 1967 . SECTION 6: The City Clerk shall cause this resolution of intention to be published twice in the Huntington Beach News , a newspaper of general circulation, published and circulated in said City of Huntington Beach, which said newspaper has heretofore been designated by said City Council as the newspaper in which shall be printed and published all notices , resolutions , orders , and other matters required to be published in the proceedings to be taken pursuant to this resolution and under the provisions of the Improvement Act of 1911; the first publication of said notice shall be not less than ten (10) days prior to the date herein, fixed for the public hearing fixed by this resolution of intention. SECTION 7: The Superintendent of Streets of said City of Huntington Beach shall cause to be conspicuously posted along the line of said contemplated work and improvements , and on all the open streets within the assessment district notice of the passage of this resolution of intention, in the time , form and manner required by law. SECTION 8: The City Clerk of said City of Huntington Beach is hereby directed to mail notices of the adoption of this resolution of intention, postage prepaid, to all persons awning -4- real property proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll for real property taxes , or as known to said City Clerk. Said mailing is to be completed at least fifteen (15) days prior to the day herein fixed for the public hearing on this resolution of intention, all in the time, form and manner prescribed in said Improvement Act of 1911 . SECTION 9: NOTICE IS HEREBY FURTHER GIVEN that the grades to which said work is to be done are, or may be in part, new and different from those heretofore established, or may be and in some cases are different from existing ground levels . SECTION 10: The total estimated cost of said work and improvements , including estimated incidental costs , is in the amount of $21,162.89. SECTION 11: NOTICE IS HEREBY FURTHER GIVEN that the report of the City Engineer of the City of Huntington Beach, Calif- ornia upon the proposed improvement, as approved by said City Council , is on file in the office of the City Clerk of said City of Huntington Beach, and open to public inspection. SECTION 12: NOTICE IS HEREBY FURTHER GIVEN that the redemption provisions of the serial bonds above mentioned in Section 4 hereof shall provide, in addition to all other matter required by law, for a premium of five percent (5%) of the unpaid principal should the owner or any person interested in any lot or parcel of land upon which any such bonds have been issued desire -5- %ex. No. 2530 to pay off any of such bonds and discharge the land described in any of such bonds from the lien of said assessment prior to its maturity and the commencement of proceedings for sale.
