HomeMy WebLinkAboutCity Council - 2558 RESOLUTION' NO. 2558 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR STREET PURPOSES AND AUTHORIZING THE ACQUISITION OF SAID PROPERTY BY CONDEMNATION OR NEGOTIATION AND DIRECTING ITS ATTORNEY TO PRO- CEED WITH SUCH ACTION.. WHEREAS, the City of Huntington Beach is anticipating the immediate widening of Brookhurst Street from Hamilton Avenue to the Southern California Edison Company easement on the north; and WHEREAS, construction and improvement of said street is imminent and it is necessary that certain real property, hereinafter set forth, affected by this street be acquired by the City of Huntington Beach; and WHEREAS, it is in the public interest and necessity to acquire said land for the improvement of said street; NOW, THEREFORE, be it resolved as follows: 1. .Resolved by the City Council of the City of Hunt- ington Beach, California, that it finds and determines and hereby declares: (a) That the public interest and necessity re- quire the acquisition, construction and completion of a public improvement, namely, the widening of a street; and (b) That the public interest and necessity re- quire the acquisition for and in connection with said im- provement of the real property or interest in real property hereinafter described; and -z- Res . No . 2558 (c) That the proposed public improvement is planned and located in a manner which will be most com- patible with the greatest public good and least private injury. 2. BE IT FURTHER RESOLVED that K. Dale Bush as City Attorney or his associate for the City of Huntington Beach be, and he is hereby authorized, directed and empowered to acquire in the name of the City of Huntington Beach, a municipal corporation, a fee simple estate, unless a lesser estate is hereinafter expressly described, in and to the said hereinafter described real property or interest in real property, by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain and such other statutes of the State of California as may be applicable, to prepare and prosecute in the name of the City of Huntington Beach such proceeding or proceedings in the proper court having jurisdiction thereof as are necessary for such acqui- sition. 3. The real property or interest in real property which the City of Huntington Beach is by this resolution authorized to acquire is situated in the City of Huntington Beach, County of Orange, State of California, and is more particularly described as follows : That portion of the northwest quarter of section 17, Township 6 South, Range 14 Vest, San Bernardino Base and Meridian, in the City of Huntington Beach as per map recorded in Book .51, .Page 14 of Miscellaneous -2- Res . No. 2558 Maps, Records of Orange County, described as follows: That portion of Lots 1 through 17 inclusive and Lot A of Tract 193 per map recorded in Book 12, Page 49 of Miscellaneous Maps, Records of Orange County, Lots 1 through 15 inclusive, Lot D and Lot H of Tract 211, per map recorded in Book 13, Page 40 of Miscellaneous Maps, Records of grange County, and Lots 1 through 9 inclusive and Lot I of Tract 223 per map recorded in Book 14, Page 26 of Miscellaneous daps, ,Records of Orange County, lying westerly of a line parallel to and 60.00 feet east, measured at right angles from the west line at the northwest quarter of said Sec- tion 17, said west line of the northwest quarter also being the centerline of Brookhurst Street, together with that portion of Lot 17 of said Tract 193 lying southwesterly of a curve concave to the northeast, having a radius of 30,00 feet, being tangent on the south to a line parallel to and 50.00 feet north measured at right angles from the south line of the northwest quarter of said Section 17 and tangent on the west to a line parallel to and 60.00 feet east measured at right angles from the west line of the northwest quarter of said Section 17. PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California, at a regular adjourned meet- ing thereof held on the 1st day of April, 1967.
