HomeMy WebLinkAboutCity Council - 2571 RESOLUTION NO. 2571 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA TO VACATE CERTAIN PORTIONS OF CANDLE- WOOD DRIVE, DEERVALE LANE, RAMONA LANE, AND HAZELBROOK DRIVE IN SAID CITY AND GIVING NOTICE OF HEARING ON SAID VACATION. WHEREAS, the map of Tract No. 5755, recorded in Book 219, pages 26 and 27 of Miscellaneous Maps, Records of Orange County, California, dedicated rights of way, for public street purposes, for Candlewood Drive, Deervale Lane, Ramona Lane, and Hazelbrook Drive; and WHEREAS, it was originally planned to develop Tract No. 5755 into standard single family residential concepts; and WHEREAS, subsequent requests were made to alter the deirelopment to a walled community concept; and G]BERFAS, the City Council approved the above mentioned requests; and WEERFAS, some street alignment changes are both ,necessary and desirable which warrant the 'vacation of certain surplus areas and the dedication of certain additional areas; and WHEREAS, the City Council of the City of Huntington Beach desires to vacate the street areas as hereinafter described: NOW THEREFORE, the City Council of the City of Huntington Beach, California, does resolve, determine, find, stipulate, and declare as follows: Section 1. The City Council of the City of Huntington Beach does hereby declare its intention to 'vacate those portions of street right of way, within the City of Huntington Beach, described as follows: 1 Resolution No. 2571 PARCELS Al and A 2 Those portions of Candlewood Drive and Deervale lane in the City of Huntington Beach, County of Orange, State of California, as shown on a map of Tract No. 5755, recorded in. Book 219, pages 26 and 27 of Miscellaneous Maps, records of said Orange County, Northerly and Easterly of the following described lines: Beginning at the intersection of the West line of Lot 14 ©,f said Tract with a line which is 37.00 feet Northerly, measured at right angles, and parallel with the oenter line of Candlewood Drive as shown on said Tract; thence Easterly along said parallel line 156.45 feet, more or less, to its intersection with a line which is 32.00 feet Easterly, measured at right angles, and paxall(- . with the Venter line of Deervale Lane as shown on said Tract; thence Southerly along last mentioned par- allel line 149.76 feet, more or less, to the Southerly line of Lot 10 of said Tract. PARCELS B 1 and B 2 Those portions of Candlewood Drive and Ramona Lane as shown an said Tract lying Northerly and Westerly of the following described lines: Beginning at the intersection of the East line of Lot 26 of said Tract with a line which is 37.00 feet Northerly, measured at right angles, and parallel with the center line of Candlewood Drive as shown an said Tract; thence Westerly along said parallel line 117,81 feet, more or less, to its intersection with a line which is 34,44 feet Westerly, measured at right angles, and parallel with the center line of Ramona Lane as shown on said tract; thence Southerly along last mentioned parallel 2 Resolution No. 2571 line 170.61 feet, more or less, to the Southerly line of Lot 30 of said Tract. PARCELS C 1 and C 2 Those portions of Ramona Lane and Hazelbrook Drive as shown on said Tract lying Westerly and Southerly of the following described lines: Beginning at the intersection of the North line of Lot 39 of said Tract with a line which is 34.50 feet Westerly, measured at right angles, and parallel with the center line of Ramona Lane as shown on said Tract; thence Southerly along said parallel line 136.02 feet, more or less, to its intersection with a line which is 35.00 feet Southerly, measured at right angles, and parallel with the center line of Hazel- brook Drive as shown on said Tract; thence Easterly along last mentioned parallel line 156.35 feet, more or less, to the Easterly line of Lot 43 of said Tract. Reserving therefrom an easement 16.00 feet in.-�Adth for san- terry sewer and storm drain purposes, the center line of' which is described as follows: Beginning at the Southeast corner of said Lot 39; thence N 77° 421 08" E 5.00 feet, more or less, to a line which is 34.50 feet Westerly, measured at right angles, and parallel with the center line of said Ramona Lane. The Easterly terminus of the side lines of said easement shall be prolonged or shortened so as to terminate on said parallel line. The Westerly terminus of the side lines of said easement shall be prolonged or shortened so as to terminate can the .masterly lines of Lots 39 and 40 of said Tract. 3 Resolution No. 2571 For further particulars as to the proposed 'vacation, reference is hereby made to a map on file in the office of -the City Clerk of said City. Section 2. That .notice is hereby given that the 3r-d day of July,1967, at the hour of 7:30 o'clock P.S .; or as soon thereafter as possible, in the Council Chamber in the City Hall, Huntington Beach, California, in the time and place when ax)d where a public hearing shall be held upon said resolution of intention to 'vacate certain portions of Candlewood D?r?.•ve, Deervale Lane, Ramona Lane, and Hazelbrook Drive located in Tract No. 5755, at which hearing all persons interested in or objecting to the proposed vacation may be heard. Section 3. The City Clerk is hereby authorized and directed to cause a copy of this resolution of intention to be published in the Huntington Beach News, a .newspaper of general circulation, printed and published in the City of Huntington Beach, by one insertion prior to the hearing as set forth in Section 2 hereof. Section 4. The City Council of the City of Huntington Beach, in 'vacating those portions of Candlewood Drive, Deervale Lane, Ramona Lane, and Hazelbrook Drive located in Tract No. 5755, as above described, does elect to proceed under the provisions of the Street Vacation Act of 1941, Division 9, Part 3, of the Streets and Highway Code of Che State of California. Section 5.
