A RESOLUTION OF INTENTION OF THE CITY
COUNCIL OF THE CITY OF HUNTINGTON
BEACH, CALIFORNIA -TO VACATE TWO SEPA-
RATE TEN-,FOOT UTILITY EASEMENTS WITHIN',
TRACT NO: -5331 IN THE CITY OF HUNTINGTON
BEACH, CALIFORNI A
WHEREAS, the map of Tract No. 5331 dedicated two separate
ten foot utility easements for sanitary sewer and &ainage
purposes ; and
WHEREAS, subsequent construction desigrs eliminated
the necessity to utilize these easements for their intended
purposes ; and
WHEREAS , the City Council of the City of Huntington Beach
desires to vacate the easements as hereinafter described.
NOW THEREFORE, the City Council of the City of Huntington
Beach, California, does resolve, determine, find, stipulate,
and declare as follows :
Section 1. The City Council of the City of Huntington
Beach does hereby declare its intention to vacate those certain
easements , within the City of Huntington Beach, described as
follows:
Parcel 1: That ten foot easement, dedicated for sanitary
sewer purposes , as shown on a map of Tract No. 5331 , recorded
in Book 231 pages 15-17 of Miscellaneous Maps , records of
Orange County, California, said easement being the westerly
ten feet of lot 38 of said Tract.
Parcel 2: That ten foot easement, dedicated for drainage
purposes , as shown on a map of Tract No 5331 , recorded in Book
1.

231 , pages 15-17 of Miscellaneous Maps , records of Orange
County, California, said easement being the westerly ten feet
of lot 36 of said Tract.
For further particulars as to the proposed vacation,
reference is hereby made to a map on file in the office of
the City Clerk of said City.
Section 2. That notice is hereby given that the 3rd day
of July, 1967, at the hour of 7:30 P.M. , or as soon thereafter
as possible, in the Council Chamber in the City Hall, Huntington
Beach, California, is the time and place when and where a public
hearing shall be held upon said resolution of intention to
vacate the above described easements , at which hearing all
persons interestedin or objecting to the proposed vacation
may be heard.
Section 3. The City Clerk is hereby authorized and
directed to cause a copy of this resolution of intention to be
publi shed in the Huntington Beach News , a newspaper of general
circulation, printed and published in the City of Huntington
Beach, by two insertions prior to the hearing as set forth in
Section 2 hereof.
Section 4. The City Council of the City of Huntington
Beach, in vacating the above described easements , does elect
to proceed under`- the provisions of the Public Service Ease-
ments Vacation Law of 1943, Title 5, Division 1 , Part 1 ,
Chapter 2, Article 5 of the Government Code of the State of
California.
Section 5. The Street Superintendent is hereby authorized
and directed to post notices of the easement vacations as re-
quired by law.

PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, at a regular meeting thereof
held on the 5th day of June, 1967.

acting City Clerk of the City of Huntington Beach, and ex-

certify that the whole number of members of the City Council
of the City of Huntington Beach is seven; that the foregoing
resolution was passed and adopted by the affirmative vote of
more than a majority of all the members of said City Council
at a regular meeting thereof held on the 5th
day of ijune 19 67 , by the following vote:
