AN CHDER OF THE CITY COUNCIL OF THE CITY OF 'HUNTINGTON :EACH VACATING TI-10 SEPARATE TEN F'OT UTILITY EASM-1-ENTS WITHIN TRACT NO. 5331 IN "'HE CITY OF HUNTINGTON BEACH, CALI;_ O'RNIA- WHEREAS, the City Council of the City of Huntington Beach, California, did, by unanimous vote on the 5th day of June, 1967, at a regular meeting of said body., regularly and duly adopt Resolution NO. 2572, entitled, "A Resolution Of Intention of the City Council of the City of Huntington Beach, California, to Vacate Two Separate Ten Foot Utility Easements within Tract No. 5331 in the City of Huntington Beach, California"; and, WHEREAS, the City Council of the City of Huntington Beach did elect to proceed u.Aer the provisions of the Public Service Easements Vacation Law Of 1943, Title 5, Divis- ion 1, Part 1. Chapter 2. Article 5 of the Government Code of the State of California; and WHEREAS, the City Clerk of the City of Huntington Beach did cause a copy of said resolution of Intention to be published in the Huntington Beach News, a newspaper of general circulation printed and published in the City of Huntington Beach by one insertion on the 8th day of June, 1967; and UHLREAS9 said resolution co twined a notice that the 3rd day of July, 1967, at the hour of 7:300 '610c' in the Council Chamber in the City Hall, Huntington Zeachq California, was the time and place, when and where a public hearing was to 1. Res . No. 2608 be held upon said Resolution of Intention, at which hearing all persons interested in or objecting to the proposed vaca- tion could be heard; and WHEREAS, Notice of Vacation of the ten foot utility easement, dedicated for sanitary sewer purposes and the ten foot utility easement dedicated for drainage purposes, were posted as required by law; NOW, THEREFORE, the City Council of the City of Huntington Beach, after hearing the evidence offered by all persons interested in said matter, does hereby find from all evidence submitted, that the ten foot utility easements herein described as : Parcel 1: That ten foot easement, dedicated for sanitary sewer purposes, as shown on a map of Tract 5331, recorded in Book 231, pages 15-17 of Miscellaneous Maps, records of Orange County, California, said easement being the westerly ten feet of lot 38 of said Tract; and Parcel 2. That ten foot easement, dedicated for drainage purposes, as shown on a map of Tract 5331, recorded in Book 231, pages 15-17 of Miscellaneous Maps, records of Orange County, California, said easement being the westerly ten feet of lot 36 of said Tract, be, and the same are hereby vacated. The City Clerk is authorized and directed to cause a certified copy of this Order, attested to by the Clerk under the seal of this City, to be recorded in the office of the County Recorder of Orange County, California.
