A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH DECLARING THAT
PROCEEDINGS ARE INITIATED BY THE CITY
COUNCIL OF SAID CITY TO ANNEX TO SAID
CITY CERTAIN UNINHABITED TERRITORY
DESCRIBED HEREIN AND DESIGNATED AS
"NEWLAND ANNEXATION #3", AND GIVING
NOTICE OF THE PROPOSED ANNEXATION AND OF
THE TIME AND PLACE FOR HEARING WRITTEN
PROTESTS THERETO
The City Council of the City of Huntington Beach does
hereby resolve as follows :
WHEREAS, pursuant to the provisions of the Annexation
of Uninhabited Territory Act of 1939, proceedings are hereby
initiated by the City Council of the City of Huntington Beach on
its own motion as provided in Section 35310 of the Government
Code to annex to the City of Huntington Beach all that uninhabited
territory situate in the County of Orange, State of California,
hereby designated as "Newland Annexation #3", which said territory
is included within the City of Fountain Valley;
WHEREAS, the City of Fountain Valley has consented to
said annexation and has received the written consent of at least
two-thirds of the owners of the real property in the territory
holding at least two-thirds in value of the real property in the
territory. All of said territory so proposed to be annexed is
described as follows :

Commencing at the northeast corner of the southeast one
quarter of the southwest one quarter of Section 36, Township 5,
South, Range 11 west, San Bernarding Base and Meridian, Orange
County, California; thence south 89 38' 35" west, along the
northerly line of said southeast one quarter 792.55 feet to
the True point of Beginning; thence north 36 04' 34" west
825.90 feet to a point; thence north 160 51' 26" east 412.63
feet to a point; thence north 52 24' 34" west 199.21 feet to
a point, said point lying within the northerly right of way
line of Ellis Avenue, 40.00 feet in width as now laid out;
thence north 890 36' 56" east, along said northerly right of
way line of Ellis Avenue, 195.06 feet to a point; thence
south 0 49' 14" east, along the east line and its northerly
prolongation of the northwest one quarter of the northeast one
quarter of the southwest one quarter of said Section 36,
680.88 feet to the southeast corner of the northwest one
quarter of the northeast one quarter of the southwest one
quarter of Section 36; thence south 890 37' 45" west, along
the south line of the northwest one quarter of the northeast
one quarter of the southwest one quarter of said section 36,
64.29 feet to a point; thence south 8 49' 08" east, along
the west line of the east 11 acres of the south one half of
the northeast one quarter of the southwest one quarter of
said Section 36, 660.86 feet to a point; thence south 890
38' 35" west, along the south line of the northeast one
quarter of the southwest one quarter of said Section 36,
67.46 feet to the True Point of Beginning.

WHEREAS, the City Council of the City of Huntington
Beach desires to annex said uninhabited territory to the City
of Huntington Beach for the following reasons : The annexation
of the hereinbefore described territory will correct the common
boundary line between the City of Huntington Beach and the City
of Fountain Valley so as to make such boundary line definite and
certain and conform to existing property lines;
WHEREAS, the LOCAL AGENCY FORMATION COMMISSION OF
ORANGE COUNTY did approve the annexation of the territory above
described and so proposed to be annexed;
WHEREAS, on December 4. 19675 at the hour of 7:30
P.M. at the regular meeting place of the City Council, at 5th and
Orange Streets, Huntington Beach, California, is hereby fixed as
the time and place when and where the City Council will hear
written protests from any owner of property within the territory
proposed to be annexed. Such protests must be in writing and
may be filed at any time prior to final adjournment of the hearing
on protest against the proposed annexation, and shall state the
names or name of the owner or owners of property affected, and
the street address or other description of the property to
identify it on the last equalized assessment roll;
WHEREAS, the City Clerk of the City of Huntington Beach
is hereby directed to cause a copy of this resolution to be pub-
lished at least twice in the Huntington Beach News, a newspaper
of general circulation published in the City of Huntington Beach,
and in the Huntington Beach Independent , a newspaper of general
circulation published outside of the City of Huntington Beach, but
in the County of Orange. Publication should be complete at least
20 days prior to the date set for hearing.
NOW, THEREFORE, BE IT RESOLVED that the City Clerk of
the City of Huntington Beach shall also cause written notice of
such proposed annexation to be mailed to each person to whom land
within the territory proposed to be annexed, is assessed in the
last equalized county assessment roll available on the day these
proceedings were initiated, at the address shown on said assess-
ment roll or as known to said Clerk, and to any person who has
filed his name and address and the designation of the lands in
which he has any interest, either legal or equitable, with said
Clerk.
The notices shall be given not less than 20 days before
the first public hearing on proposed annexation.

resolution was passed and adopted by the affirmative vote of
more than a majority of all the members of said City Council
adjourned
