A RESOLUTION OF INTE TION OF THE CITY COTI"'C IL OF
THE CITY OF HUNTINGTON BEACH, CALIFORXIAq TO
VACi1TE A PORTTvN OF W'_RNE'R AVENUE, ADJACENT TO
TRACT No. 5791.
WHEREAS, a map of Tract 5791 dedicated a right of way
for Warner Avenue adjacent to Tract No. 5791; and
WHEREAS, final construction design eliminated the necess-
ity to utilize all of this easement for the intended purpose;
and
WHEREAS, the City Council of the City Of Huntington Beach
desires to vacate that portion of the easement hereinafter de-
scribed,
NOW THEREFORE, the City Co't_:ricil of the City of Huntington
Beach, California , des resolve, determine, stipulate and decalre
as follows:
Section 1. The City Council of the City of Huntington
Beach does hereby declare its intention to vacate that certain
easement described as follows:
That -oortion of Warner Avenue in the City of Huntington
Beach, County of Prange, State of California , described
as follows:
Beginning at the Northwest corner of Lot 5 Of Tract 5791
as per map recorded In book 236, pages 20 through 23, in-
clusive, of iscelloneous Maps, records of said Orange
County; thence 3 87 50* 15" E 410.00 feet to the most
Easterly corner of Lot 9 of said Tract; thence along the
Easterly line of said Tract N 15 220 02" E 20-50 feet
to a line which Is parallel with and distant 60.00 feet
Southerly, measured at right angles, from the centerline
of Warner Avenue as shown on said Tract; thence along
said ,�arallel line S 89024,25" W 415.16 feet to the
point of beginning.

For further particulars as to the proposed vacation,
reference is hereby made to a map on file in the office of
the City Clerk of said City.
Section 2. That notice is hereby given that the 19th
day of February, 1958, at the hour of 7 :30 P.i1. or as soon
thereafter as possible, in the Council Chambers of the City
H8119 Huntington Beach, Cal fornia, is the time and place when and
and where a public hearing shall be held upon said Resolution
of Intention to vacate the above described easement, at
which hearing all persons interested in or objecting to the
proposed vacation may be heard.
Section 3. The City Clerk is hereby authorized and
directed to cause a copy of this Resolution of Intention to be
published in the Huntington Beach News, a newspaper of gener-
al circulation, printed and published in the City of Huntington
Beach, by two insertions prior to the hearing as set forth in
Section 2 hereof.
Section 4, The City Council of the City of Huntington
Beach in vacating the above easement does elect to proceed
under the provisions of the Public Service '_Easements Vacation
Law of 1943, Title 5, Division 1, Part 1, Chapter 29 Article
5 of the Government Code of the State of California.
Section 5. The Street Superintendent is hereby auth-
orized and directed to post the notice of the easement vacation
as rewired by law.

of Huntington Beach, California, this 15th day of
January 1968.

acting City Clerk of the City of Huntington Beach, and ex-
officio Clerk of the City Council of said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is seven; that the foregoing
resolution was passed and adopted by the affirmative vote of
more than a majority of all the members of said City Council
at a regular meeting thereof held on the 15th
