HomeMy WebLinkAboutCity Council - 2711 R73S OLIT2 IOIz OF IlUn'T ION NO. 2 711 MSES' SENT DISTRICT NO. 6701 HLRATINGTON BEACH, CI-%LIF0RNIA The City Council of the City of Huntington Beach, Calif- ornia , in regular session assembled, does hereby resolve and deter- mine as follms: SECTION l: That the public interest and convenience re- quire, and that it is the intention of said City Council to order the following wort. to be done and improvements to be made in said City of Huntington Beach, California, to wit: The construction and installation of concrete curb and gutter , concrete sidewalks, asphalt concrete pavement over aggregate base material, street name and traffic control signs , the ad* st- ment of existing manholes and water valves and meters to grade, the removal of existing pavement , street barricade , concrete drain, corrugated metal pipe culvert , and all other obstacles in the line of worm, and including appurtenances and appurtenant wort:., in Marina View Lane and Orion Drive from a point in the intersection Of Tsarina View Lane with Los Patos Drive 30 feet North of the :southerly right of way line of Los Patos Drive to the intersection of Marina View Lane with Orion Drive, and thence Northeasterly and :easterly in Orion Drive to a point 100 feet mast of the center line of tzarina View Lane extended, and in the Northerly half of Los Patos Drive for a distance of 60 feet Fast and 60 :Feet West of its intersection with the center line of Marina View Lane ; provided, however , that the aforesaid sidewalk shall be installed on only the Easterly side of Marina View Lane and the Southerly side of Orion Drive . Said work and improvement shall also include: (a) The Northerly extension in Marina View Lane of the existing vitrified clay pipe main sewer line for 60 feet to a manhole to be constructed, and including therein one four inch diameter vitrified clay pipe sewer lateral, the removal of the existing lamp hole, and appurtenances and appurtenant worts; (b) The connection of the existing six inch diameter water line in Marina View Lane with the existing six inch diameter ^1- water line in Orion Drive with 193 feet of six inch diameter asbestos cement water pipe , and including one three-quarter inch house service connection, one fire hydrant , the removal of two existing .1istinR blow offs , and appurtenances and appurtenant work; (c) A storm drain and water collection system consisting of catch basins and eighteen inch diameter reinforced concrete pipe , and appurtenances and appurtenant work, in Orion Drive at a point 78 feet East of its intersection with the Northerly terminus of Marina View Lane measured along the center line of Orion Drive, and also in both Marina View Lane and Orion Drive, at , about , and adjacent to their common intersection. SECTION 2: All of the above mentioned work, including the grade to which said work shall be done and the location thereof in and upon the streets and rights of way above mentioned, shall be done upon the grades , along the lines , between the points , of the dimensions , at the places and in the manner described and set forth in the plans , pro-files and detailed drawings of said work, and to specifications for said work heretofore adopted by said City Council on March 18, 19068 by its Resolution No. 2708 __, which plans , profiles , detailed drawings and specifications are on file in the office of the City Engineer of said City of Huntington Beach, and which are hereby referred to for a more particular description of said work, grade of said work, and location of said work in and along the streets and rights of way hereinbefore mentioned, and to which plans , profiles , detailed drawings and specifications reference is hereby made. SECTION 3: That said contemplated work and improvements , in the opinion of said City Council, is of more than local or ordinary public benefit , and that the expenses and cost of said work and -2- improvements shall be chargeable upon a district , which said district said City Council hereby declares to be the district benefited by the work and improvements herein described and to be assessed to pay the cost and expenses thereof; said district shall include that territory in said Cityof Huntington Beach which is shown upon that certain plat or map thereof on file in the office of the City Clerk, entitled `PROPOSED BOUNDARIES OF MARINA; VIW LANE, ORION DRIVE ASSESSMENT DISTRICT, ASSESSMENT DISTRICT NO. 67012 CITY OF HUNTINGTON BEACH, COUNTY OF ORANGE, STATE OF CALIF0ZIA," and which said map or plat indicates by a boundary line the extent of the territory included in the proposed district , and covers all details as to the extent of the area to be assessed. Reference is hereby made to said map . SECTION 4: NOTICE IS HEREBY GIVEN that serial bonds shall be issued in the manner and form provided in Fart 5 , Division 7 of the Streets and Highways Code of the State of California, the Im- provement Act of 1911 , to represent unpaid assessments of Fifty Dollars ($50.00) or over , which said bonds shall bear interest at the rate of six percent (6%) per annum and the last installment of which bonds shall mature nine (9) years from the second day of January next succeeding the first day of September following their date . SECTION 5: NOTICE IS HEREBY FURTHER GIVEN that on Monday, the 6th day of May, 1965 at the hour of 7: 30 o'clock P.M. -3- of said day, or as soon thereafter as the hearing hereinafter mentioned can be held, in the Council Chambers in the City Hall in said City of Huntington Beach, the meeting place of said City Council, any and all persons having any objections to the proposed work and improvements , or any objections to the grades to which said work is to be done, or any objections to the boundaries of the district proposed to be assessed to pay the cost and expenses of said work and improvements may appear before said City Council and show cause why said proposed work and improvements should not be carried out in accordance with this resolution of intention, and may present written protests in the --,-;Orm and manner required by law not later than the hour hereinabove set for hearing objections against authorizing the doing of said work, the grades to which said work is to be done , or the extent of the territory to be assessed to pay the cost and expenses thereof. SECTION 6: The City Clerk shall cause this resolution of intention to be published twice in the Huntington Beach News , a newspaper of general circulation, published and circulated in said City of Huntington Beach, which said newspaper has heretofore been designated by said city Council as the newspaper in which shall be printed and published all notices , resolutions , orders and other matters required to be published in the proceedings to be taken pursuant to this resolution and under the provisions of the Improve- ment Act of 1911. The first publication of said notice shall be not -4- less than ten (10) days prior to the date herein fixed for the public hearing under this resolution of intention. SECTION 7 : The Superintendent of Streets of said City of Huntington Beach shall cause to be conspicuously posted along the line of said contemplated work and improvements , and on all the open streets within the assessment district notice of the passage of this resolution of intention, in the time , form and manner required by law. IMTION 8: The City Clerk of said City of Huntington Beach is hereby directed to mail notices of the adoption of this resolution of intention, postage prepaid, to all persons owning real property proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll for real property taxes , or as knoun to said clergy`. ,,aid mailing is to be completed at least fifteen (15) days prior to the day herein -LLz-ed for the public hearing under this resolution of intention, all in the tixee, form, and manner prescribed in said Improvement Act of: l-"Ill .
