HomeMy WebLinkAboutCity Council - 2733 RESOLUTION NO. 2733 A RES OLUT ION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DETERMINING FEASIBILITY OF PROJECT, WAIVING DEBT LIMITATION, AND OVERRULING PROTESTS ASSESSMENT DISTRICT NO. 6701 WHEREAS , a public hearing was duly and legally called and held by the City Council of the City of Huntington Beach, California upon the Investigation Report of JAMES R. WHEELER , Director of Public Works , in Assessment District No. 6701 on May 6 , 1968 , at which time said report was first summarized; and WHEREAS , all protests made in writing or orally to said proposed improvement were duly and legally considered; and WHEREAS , said Director of Public Works has advised that said protests , both oral and written, were not made by owners of more than half of the area of the property proposed to be assessed for said proposed work and improvement , and said City Council having acquired jurisdiction to proceed herein: NOW , THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach, State of California, in regular session assembled, that all of said protests , both oral and in writing, be and the same hereby are overruled and denied . BE IT FURTHER RESOLVED that said City Council hereby finds from said Investigation Report, the information and opinion furnished by said Director of Public Works, and its personal know- ledge of the land and improvements in this assessment district , that said proposed project is feasible, that the public interest , -1- Res . 2733 convenience and necessity require said proposed work and improve- ment , and that the lands to be assessed will be able to carry the burden of the proposed assessments . BE IT FURTHER RESOLVED that limitations upon the amount of assessments provided for in the Special Assessment Investiga- tion, Limitation and Majority Protest Act of 1931, Division 4 of the Streets and Highways Code of the State of California, shall be disregarded, both with respect to the limitations on the district as a whole and as to the limitations on individual specific assess- ments , and that proceedings for said improvement shall be taken under the Improvement Act of 1911 of the State of California, Division 7 of the Streets and Highways Code , and improvement bonds shall be issued pursuant to the provisions of said Improvement Act .
