HomeMy WebLinkAboutCity Council - 2785 RESOLUTION NO. 2785 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH REQUESTING DISSOLUTION OF THE TALBERT WATER DISTRICT WHEREAS, the real property located within the boundaries of the Talbert Water District is also located totally within the limits of the City of Huntington Beach; and A vast majority of the landowners within Talbert Water District do not derive any benefit from being in said district • and The district serves only irrigation water and serves such water to only thirteen landowner-users within the district, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows : 1. This resolution of application is made pursuant to Division 1, the District Reorganization Act of 1965, and all other pertinent provisions of the Government Code, with specific reference to Sections 5614o and 56195 thereof. 2. The nature of the change of organization requested is dissolution of Talbert Water District. 3 . Attached hereto and marked Exhibit "A" and made a part hereof is a, map of the area. within Talbert Water District . -1- 4. The only affected city and district are the City of Huntington Beach and Talbert Water District. 5. The reasons for the dissolution of said district are as follows : (a,) The majority of property owners within the district do not receive water for either domestic or irrigation purposes from district. The residents within the district receive domestic water from the City of Huntington Beach. Only thirteen landowner-users receive irrigation water from the district although taxes are paid by all the residents and such taxes are used to help pay the cost of supplying irrigation water to said thirteen landowner-users, and the balance of the taxes is used to pay administrative costs and to build a, sur- plus to pay off the bonded indebtedness of the district . (b) The City of Huntington Beach has indicated its intention, desire and willingness to supply irrigat- ion water to the thirteen landowner-users who need such water, if said district is dissolved. If the district is dissolved, the administrative costs for said district will be greatly decreased and such decreased costs will result in a, lower tax rate, or a faster buildup of a surplus to pay off the bonded indebtedness of said water district . -2- 6. Request is hereby made of the Local Agency Formation Commission for the County of Orange to take appropriate action to dissolve Talbert Water District.
