HomeMy WebLinkAboutCity Council - 2813 RESOLUTION NO. 2813 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA ACCEPTING DEDICATION FOR PUBLIC USE OF THE HEREIN DESCRIBED PARCEL OF LAND. WHEREAS, there is existing a strip of land, 25 feet in width, commonly known as the West one half of Green Street, a private road, within the city limits of Huntington Beach; and WHEREAS, this strip of land was offered to public use, in the dedication certification on the map of Tract No. 349, recorded in book 15, page 17 of Miscellaneous Maps, records of Orange County, California; and WHEREAS, the Board of Supervisors of Orange County, California on January 2, 1923 did approve said Tract Map, but did not accept the dedication of the private roads; and WHEREAS, the owners of properties abutting this strip of land have petitioned the City Council of the City of Huntington Beach to form an improvement district under the 1911 Act proceedings; and WHEREAS, provisions of the 1911 Act stipulate that work assessable under the proceedings must occur within public right-of-way; and WHEREAS, the City Council of the City of Huntington Beach, California does hereby declare its intention to approve the formation of the improvement district, and does hereby find that acceptance of the former offer of dedication is necessary for said formation and will be a benefit to the general public; NOW THEREFORE, the City Council of the City of Huntington Beach, California does hereby accept the below described parcel .of land for public use as road purposes, and does hereby declare road purposes to be synonymous with present day deed language of public street and utility purposes. DESCRIPTION OF PARCEL TO BE ACCEPTED That 25 foot strip of land, (shown as private road, on a map of Tract No. 349 recorded in Book 15, page 17 of Miscellaneous Maps, Records of Orange County, California ); said strip of land lying easterly of and adjoining the east line of Blocks G and H and their northerly and southerly prolongations, lying between the easterly prolongation of the southerly line of Block H and a line parallel with and lying 30 feet northerly of the north line of Block G. -1- RESOLUTION N0. 28 13 That the City Clerk shall certify to the passage of and adoption of this resolution and shall cause the same to be published by one inser- tion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take" effect and be in force.
