HomeMy WebLinkAboutCity Council - 2853 RESOLUTION OF INTENTION NO. 2853 ASSESSMENT DISTRICT NO. 6804 HUNT INGTON BEACH, CALIFORNIA The City Council of the City of Huntington Beach, Calif- ornia, in regular session assembled, does hereby resolve and deter- mine as follows: SECTION 1: That the public interest and convenience re- quire, and that it is the intention of said City Council to order the following work to be done and improvements to be made in said City g of Huntington Beach to wit: > California, The construction and installation of a twelve inch diameter asbestos cement main water line with six fire hydrant assemblies , valves and tee, hot tap connections , trenching and backfilling, and the replacement of existing street pavement over aggregate base material necessitated by such trenching and backfilling, in Beach Boulevard and Heil Avenue from a connection with the existing main water line in Heil Avenue at a point therein 125 feet west of the construction center line of Beach Boulevard to a connection with the existing main water line in Beach Boulevard in its intersection with Edinger Avenue, and including eight inch diameter stubouts for a distance of 20 feet westerly from said twelve inch diameter main water line in each of the intersections of Beach Boulevard with Alhambra Drive, Glencoe Avenue, and MacDonald, Holt , Stark and Aldrich Streets ; all together with appurtenances and appurtenant work. SECTION 2: All of the above mentioned work, including the grade to which said work shall be done and the location thereof in and upon the streets and rights of way above mentioned, shall be done upon the grades, along the lines , between the points , of the dimensions , at the places and in the manner described and set forth in the plans , profiles and detailed drawings of said work, and to -1- specifications for said work heretofore adopted by said City Council on October 21, 1968 by its Resolution No. 2850 , which plans , profiles , detailed drawings and specifications are on file in the office of the City Engineer of said City of Huntington Beach, and which are hereby referred to for a more particular description of said work, grade of said work, and location of said work in and along the streets and rights of way hereinbefore mentioned, and to which plans , profiles , detailed drawings and specifications refer- ence is hereby made. SECTION 3: That said contemplated work and improvements , in the opinion of said City Council, is of more than local or ordinary public benefit , and that the expenses and cost of said work and improvements shall be chargeable upon a district , which said district said City Council hereby declares to be the district benefited by the work and improvements herein described and to be assessed to pay the cost and expenses thereof; said district shall include that territory in said City of Huntington Beach which is shown upon that certain plat or map thereof on file in the office of the City Clerk, entitled "PROPOSED BOUNDARIES OF BOULEVARD GARDENS ASSESSMENT DISTRICT , ASSESSMENT DISTRICT NO. 6804, CITY OF HUNT INGT ON BEACH, COUNTY OF MANGE, STATE OF CALIFORNIA," and which said map or plat indicates by a boundary line the extent of the territory included in the proposed district , and covers all details as to the extent of the area to be assessed. Reference is hereby made to said map. -2- SECTION 4: NOTICE IS HEREBY GIVEN that serial bonds shall be issued in the manner and form provided in Part 5 , Division 7 of the Streets and Highways Code of the State of California, the Im- provement Act of 1911, to represent unpaid assessments of Fifty Dollars ($50.00) or over , which said bonds shall bear interest at the rate of seven percent (7%) per annum and the last installment of which bonds shall mature nine (9) years from the second day of January next succeeding the first day of September following their date. SECTION 5: NOTICE IS HEREBY FURTHER GIVEN that on Monday, the 2nd day of December , 1968 at the hour of 7:30 o'clock P .M. of said day, or as soon thereafter as the hearing hereinafter mentioned can be held, in the Council Chambers in the City Hall in said City of Huntington Beach, the meeting place of said City Council, any and all persons having any objections to the proposed work and improvements , or any objections to the grades to which said work is to be done, or any objections to the boundaries of the district proposed to be assessed to pay the cost and expenses of said work and improvements , may appear before said City Council and show cause why said proposed work and improvements should not be carried out in accordance with this resolution of intention, and may present written protests in the form and manner required by law not later than the hour hereinabove set for hearing objections against authorizing the doing of said work, the grades to which said work is to be done, or the extent of the territory to be assessed to pay the cost and expenses thereof. -3- SECTION 6: The City Clerk shall cause this resolution of intention to be published twice in the Huntington Beach News , a newspaper of general circulation, published and circulated in said City of Huntington Beach, which said newspaper has heretofore been designated by said City Council as the newspaper in which shall be printed and published all notices , resolutions , orders and other matters required to be published in the proceedings to be taken pursuant to this resolution and under the provisions of the Improve- ment Act of 1911 . The first publication of said notice shall be not less than ten (10) days prior to the date herein fixed for the public hearing under this resolution of intention. SECTION 7: The Superintendent of Streets of said City of Huntington Beach shall cause to be conspicuously posted along the line of said contemplated work and improvements , and on all of the open streets within the assessment district , notice of the passage of this resolution of intention, in the time, form and manner required by law. SECTION 8: The City Clerk of said City of Huntington Beach is hereby directed to mail notices of the adoption of this resolution of intention, postage prepaid, to all persons owning real property proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll for real property taxes , or as known to said clerk. Said mailing is to be completed at least fifteen (15) days prior to the day herein fixed for the public hearing under this resolution -4- of intention, all in the time, form and manner prescribed in said Improvement Act of 1911 . SECTION 9: NOTICE IS HEREBY FURTHER GIVEN that the grades to which said work is to be done are, or may be in part , new and different from those heretofore established, or may be , and in some cases are different from existing ground levels . SECTION 10: The total estimated cost of said work and improvement , including estimated incidental costs , is in the amount of $29,335 .63 . The City of Huntington Beach shall contribute to the cost of said work and improvement the actual cost of installa- tion of said main line from its connection with the existing main water line in Heil Avenue to a point in Beach Boulevard 30 feet north of the center line of Alhambra Drive, and in Beach Boulevard from its connection with the existing main water line in its intersection with Edinger Avenue to a point in Beach Boulevard 205 feet south of the center line of Edinger Avenue, the difference in the pipe cost between twelve inch diameter and eight inch diameter pipe throughout the balance of Beach Boulevard, and all costs of engineer- ing, all estimated at $7 ,657 .12 . SECTION 11: NOTICE IS HEREBY FURTHER GIVEN that the report of JAMES R. WHEELER , City Engineer, upon the proposed work and improvement , as approved by said City Council, is on file in the office of the City Clerk of said City of Huntington Beach, and open to public inspection.
