HomeMy WebLinkAboutCity Council - 2875 RESOLUTION NO. 2875 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH STATING THE RE- SULT OF THE CANVASS OF ELECTION RETURNS OF THE SPECIAL ELECTION HELD NOVEMBER 5, 1968 WHEREAS, the City Council of the City of Huntington Beach, by Resolution No. 2821 and Ordinance No. 1437, duly called and provided for the holding of a special election in said city on November 5, 1968, for the purpose of submitting to the qualified voters of said city the propositions set forth in said resolution and ordi- nance and hereinafter stated; and The City Council of said City of Huntington Beach did request the Board of Supervisors of Orange County, California to include said special election for the City of Huntington Beach with an election being held by the County of Orange for the United States , and the State of California; and Said Board of Supervisors did consent to the com- bining of the Huntington Beach special city election with the general election being held by the County of Orange, through the adoption of their Resolution No. 68-111 on January 30, 1968, and amended by their Resolution No . 68-913 on August 27, 1968; and Notice of said election was duly and regularly given in time, form and manner as provided by law, and said election was duly held on said date at the polling places designated by said County of Orange; and 1. The County Clerk of the County of Orange did on November 29, 1968 issue a certification of the statement of vote for the City of Huntington Beach special municipal election consolidated with the general election held November 5, 1968, and that the votes cast in the special election of the City of Huntington Beach, as combined with the general election held by the County of Orange, are as follows : "M" PARK BOND PROPOSITION: Shall the City of Huntington Beach incur a bonded indebtedness in the princi- pal amount of $6 ,000 ,000 for the acquisition and construc- tion by said city of a certain municipal improvement, to wit : additions to and development of facilities of the city for community recreation, including the acquisition and development of additional parks and the development of existing parks by the landscaping and planting of grounds and the construction of buildings and recreational fa- cilities , sewer and drainage facilities and vehicle parking areas and for any of the foregoing, the acquisition of real property, equipment, furniture , and other property necessary therefor? YES VOTES - 22,009 NO VOTES - 13 ,648 "N" LIBRARY BOND PROPOSITION : Shall the City of Huntington Beach incur a bonded indebtedness in the prin- cipal amount of $3,160 ,000 for the acquisition and construc- tion by said city of a certain municipal improvement, to wit : a new public library building, the reconstruction of existing library buildings , and the planting and land- scaping of the library grounds , including the acquisition of all land, furniture , fixtures , books , furnishings and other property necessary therefor? YES VOTES - 21,514 NO VOTES - 13 ,638 110" : Shall the proposed amendment to the City Charter be adopted deleting from Sections 500, 501 and 503 all reference to the City Attorney, and adding Section 703 .1 thereto to provide for the appointment of the City Attorney by the City Council, and removal of the City Attorney by the City Council or by recall by the people? YES VOTES - 15 ,037 NO VOTES - 19 ,264 2 . NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve, determine and order as follows : SECTION 1. That the special election for the purpose of submitting to the voters of the City of Huntington Beach the propositions hereinafter set forth was duly held on November 5, 1968, and the votes cast at said election were duly and regularly canvassed, and the returns thereof made _ at the time and in the form and manner required by law. SECTION 2 . That the propositions voted upon at said election were numbered "M, " "N," and "0" and were as fol- lows , to wit : "M" PARK BOND PROPOSITION: Shall the City of Huntington Beach incur a bonded indebtedness in the principal amount of $6,000,000 for the acquisition and construction by said city of a certain municipal improvement , to wit : additions to and development of facilities of the city for community recrea- tion, including the acquisition and development of additional parks and the development of existing parks by the landscaping and planting of grounds and the construction of buildings and recreational facilities , sewer and drainage facilities and vehicle parking areas and for any of the foregoing the ac- quisition of real property, equipment , furniture, and other property necessary therefor? "N" LIBRARY BOND PROPOSITION: Shall the City of Hunt- ington Beach incur a bonded indebtedness in the principal amount of $3,160,000 for the acquisition and construction by said city of a certain municipal improvement, to wit : a new public library building, the reconstruction of existing library buildings, and the planting and landscaping of the library grounds , including the acquisition of all land, furniture, fixtures , books , furnishings and other property necessary therefor? SECTION 3 . That all ballots cast , including the ab- sentee ballots cast , have been duly canvassed and counted 3 . as required by law, and the result of such count is herein- after stated. That this City Council does hereby accept the canvass of the returns of said election, as made by the County Clerk of the County of Orange, and certified by the County Clerk of said County in his letter dated November 29 , 1968, with a total count for all precincts established in the City of Huntington Beach, including all absentee ballots cast in said precints , being as follows : MEASURE M - PARK BOND PROPOSITION YES : 223009 No : 13,648 MEASURE N - LIBRARY BOND PROPOSITION YES : 21,514 No : 13,638 MEASURE 0 - PROPOSED CHARTER AMENDMENT YES : 153037 NO : 19 ,264 SECTION 4 . That the votes of a majority of all the voters voting on Proposition "M" at said election were cast for the adoption of said Proposition "M" ; that said majority did not constitute a two-thirds majority and said Prosition "M" is hereby declared to be defeated . SECTION 5. That the votes of a majority of all the voters voting on Proposition "N" at said election were cast for the adoption of said Proposition "N" ; that said majority did not constitute a two-thirds majority and said Proposition "N" is hereby declared to be defeated. SECTION 6 . That the votes of a majority of all the voters voting on Proposition "0" at said election were cast against the adoption of said Proposition "0, " and said Proposition 110" is hereby declared to be defeated, and the Office of the City Attorney, referred to, shall remain elective . 4 .
