HomeMy WebLinkAboutCity Council - 2917 RES GLUT ION OF INTENTION NO. 2917 ASSESSMENT DISTRICT NO. 6601 HUNT INGTON BEACH, CALIFORNIA The City Council of the City of Huntington Beach, County of Orange, State of California, in regular session assembled, does hereby resolve and determine as follows: SECTION 1: The public interest and convenience require, and it is the intention of said City Council to order the following work to be done and improvements to be made in Assessment District No. 6601 in said City of Huntington Beach, California , to wit: The construction and installation of an eight inch vitrified clay pipe sewer main, with four inch vitrified clay pipe sewer laterals and standard manholes , the remodeling of an existing manhole , all together with trenching and backfilling, appurtenances and appurtenant work, from an existing manhole at the intersection of Gregory Lane with the center line of Garfield Avenue to a manhole to be constructed in Gregory Lane 1176 .28 feet North thereof, and in Laura Circle from a manhole to be constructed in said sewer main :at the intersection of Laura Circle with Gregory Lane to the Easterly terminus of Laura Circle. SECTION 2: All of the above mentioned work, including the grade to which said work shall be done and the location thereof in and upon the streets and rights of way above mentioned, shall be done upon the grades , along the lines , between the points , of the dimensions , at the places and in the manner described and set forth in the plans , profiles and detailed drawings of said work, and to specifications for said work heretofore adopted by said City Council on February 3 , 1969 by its Resolution No. 2914 , which plans , profiles , detailed drawings and specifications are on -1- file in the office of the City Clerk of said City of Huntington Beach, and which are hereby referred to for a more particular description of said work, grade of said work, and location of said work in and along the streets and rights of way hereinbefore mentioned. Reference is hereby made to said plans , profiles , detailed drawings and specifications . SECTION 3: The expense of said work and improvements shall be chargeable upon a district, which said district said City Council hereby declares to be the district benefited by the work and improvements herein described and to be assessed to pay the cost and expense thereof. Said district shall include that territory in said City of Huntington Beach, County of Orange, State of California which is shown upon that certain plat or map thereof now on file in the office of the City Clerk of said City of Huntington Beach, entitled "PROPOSED BOUNDARIES OF HARPER ESTATES ASSESSMENT DISTRICT, ASSESSMENT DISTRICT NO. 6601, CITY OF HUNTINGTON BEACH, COUNTY OF ORANGE, STATE OF CALIFORNIA,'' and which said map or plat indicates by a boundary line the extent of the territory included in the proposed district and covers all details as to the extent of the area to be assessed. Reference is hereby made to said map or plat . SECTION 4: Serial bonds shall be issued in the manner and form provided in Part 5, Division 7 of the Streets and Highways Code of the State of California, the Improvement Act of 1911, to represent unpaid assessments of Fifty Dollars ($50.00) or over; said -2- bonds shall bear interest at the rate of seven percent (7%) per annum and the last installment of said bonds shall mature nine (9) years from the second day of January next succeeding the first day of September following their date. SECTION 5: The time and place for hearing any written protest of any and all persons to said work and improvements , or to the grades to which said work is to be done, or to the boundaries of the district proposed to be assessed to pay the cost and expenses of said work and improvements is hereby fixed and set for Monday, the 17th day of March, 1969 at the hour of 7 :30 o'clock P.M. of said day, or as soon thereafter as said hearing can be held, in the meeting room of said City Council in the City Hall, Huntington Beach, California . SECTION 6: The City Clerk shall give notice of the adoption of this resolution of intention by mail , in the time, form and manner required by law, and shall cause said resolution of intention to be published in the time , form and manner required by law. I SECTION 7 : The Superintendent of Streets shall cause notices of the adoption of this resolution of intention to be con- spicuously posted along the line of said contemplated work and improvements , and on all the open streets within the assessment district, in the time, form and manner required by law. SECTION 8: NOTICE IS HEREBY GIVEN that the grades to which said work is to be done are, or may be in part , new and different from those heretofore established, or may be and in some -3- cases are different from existing ground levels . SECTION 9: The total estimated cost of said work and improvement, including estimated incidental costs , is in the amount of $ 20,133 .72 SECTION 10: NOTICE IS HEREBY FURTHER GIVEN that the report of JAM R. WHEELER, City Engineer, upon the proposed work and improvements , as approved by said City Council, is on file in the office of the City Clerk of said City of Huntington Beach, and open to public inspection.
