HomeMy WebLinkAboutCity Council - 2921 RESOLUTION NO. 2921 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF CIRCLE DRIVE IN SAID CITY WHEREAS , on the 16th day of December, 1968 the City Council of the City of Huntington Beach duly adopted Reso- lution No. 2886 , declaring its intention to vacate a portion of Circle Drive in the City of Huntington Beach; and Said resolution fixed the time and place of January 20, 1969 at 7 : 30 p.m. in the Council Chamber in City Hall, Huntington Beach, California for hearing all persons in- terested in or objecting to the proposed vacation, which time was not less than fifteen days from the date of passage of said resolution. Said resolution was duly published in the manner prescribed by law for the publishing of resolutions of the city. Notices of said vacation were posted conspicuously along the line of the easement proposed to be vacated, as required by law. On January 20, 1969 at the hour of 7 : 30 p.m. thereof, in the Council Chamber in City Hall, Huntington Beach, Cali- fornia, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the vacation of the most southerly portion of Circle Drive, at which time no objection was made to said vacation, and evidence was presented showing that the public street easement rights to Circle Drive , proposed to be va- cated, were not necessary, and it was found by the City Council from all evidence submitted that public street ease- ment rights to said Circle Drive are not necessary for present or future public street purposes . 1 . NOW, THEREFORE, the City Council of the City of Huntington Beach does resolve that the public street easement rights to the most southerly portion of Circle Drive are not necessary for present or future public street purposes , and it is hereby ORDERED that the public street easement rights be va- cated on a portion of Circle Drive, described as follows : That portion of Circle Drive, as shown on a map of a record of Survey, recorded in Book 59, Page 3 of Records of Survey on file in the office of the County Recorder, Records of Orange County, California. Said portion being more particularly described as a strip of land, 75 feet in width lying southerly of a line parallel to and 30. 00 feet southerly, measured at right angles from the north line of the southwest quarter of the northwest quarter of Section 2, Town- ship 6 South, Range 11 West , and lying easterly of a line parallel to and 50 .00 feet easterly, measured at right angles from the west line of the southwest quarter of the northwest quarter of said Section 2 . and; EXCEPTING THEREFROM the nonexclusive right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers , water distribution fa- cilities , and storm drains and appurtenant structures in, under, upon, over and across the westerly, northwesterly, and northerly one half, together with the most westerly 60 .00 feet of the above-described portion of Circle Drive, and pursuant to any existing franchise, or renewals thereof, or otherwise, to construct , maintain, operate, replace, remove, renew and enlarge lines of pipe , conduits , cables , wires , poles and other convenient structures , equipment and fixtures for the operation of gas pipelines , telegraph and telephone lines , and for the transportation or distribution of electric energy, petroleum, and its products , ammonia, water, and for incidental purposes, including access to protect that portion of Circle Drive above-described. 2 . PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting held on the 3rd day of February, 1969 .
