HomeMy WebLinkAboutCity Council - 2940 RESOLUTION NO. 2940 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA TO VACATE AN EIGHT FOOT UTILITY EASEMENT WITHIN TRACT NO. 6453 IN THE CITY OF HUNTINGTON BEACH, CALIFORNIA. WHEREAS, the map of Tract No. 6453 dedicated an eight foot utility easement for sanitary sewer purposes; and WHEREAS, subsequent construction design eliminated the necessity to utilize this easement for it' s intended purposes; and WHEREAS, the City Council of the City of Huntington Beach desires to vacate the easement as hereinafter described; NOW THEREFORE, the City Council of the City of Huntington Beach, California, does resolve, determine, find, stipulate, and declare as follows: Section 1. The City Council of the City of Huntington Beach does hereby declare its intention to vacate that certain easement, within the City of Huntington Beach, described as follows: That eight foot easement, dedicated for sanitary sewer purposes, as shown on a map of Tract No. 6453, recorded in Book 247, Pages 23 - 27 of Miscellaneous Maps, Records of Orange County, California, said easement being the southwesterly eight feet of Lot 55 of said Tract. For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of said City. Section 2. That notice is hereby given that the 21st day of April, 1969, at the hour of 7:30 P.M., or as soon thereafter as possible, in the Council Chamber in the City Hall, Huntington Beach, California is the time and place when and where a public hearing shall be held upon said resolution of intention to vacate the above described easement, at which hearing all persons interested in or objecting to the proposed vacation may be heard. Section 3. The City Clerk is hereby authorized and directed to cause a copy of this resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach, by two insertions prior to the hearing as set forth in Section 2 hereof. Section 4. The City Council of the City of Huntington Beach, in vacating the above described easement, does elect to proceed under the provisions of the Public Service Easements Vacation Law of 1943, Title 5, Division 1, Part 1, Chapter 2, Article 5 of the Government Code of the State of California. -1- RESOLUTION NO..2940 Section 5. The Street Superintendent is hereby authorized and directed to post notices of the easement vacation as required by law.
