HomeMy WebLinkAboutCity Council - 2941 RESOLUTION NO. 2941 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA TO VACATE A PORTION OF A UTILITY EASEMENT IN THE CITY OF HUNTINGTON BEACH, CALIFORNIA. WHEREAS, There is an existing fifteen foot utility easement for drain- age purposes, lying within the boundaries of tract No. 6188; and WHEREAS, subsequent construction design eliminated the necessity to utilize this entire easement for its intended purposes; and WHEREAS, the City Council of the City of Huntington Beach desires to vacate a portion of the easement as hereinafter described; NOW THEREFORE, the City Council of the City od Huntington Beach, California, does resolve, determine, find, stipulate, and declare as follows: Section 1. The City Council of the City of Huntington Beach does hereby declare its intention to vacate that portion of the easement, within the City of Huntington Beach, described as follows: That portion of a 15.00 foot easement dedicated to the city of Huntington Beach per deed recorded in Book 7784 Pages 265 through 267 Official Records of Orange County, California described as follows: Commencing at the southeast corner of Lot 16 of Tract No. 6188 recorded in Book 241, Pages 6 through 9 Miscellaneous Maps, Records of Orange County; thence north 00° 361 04" east 15.00 feet along the easterly line of said lot 16 to the True Point of Beginning; thence north 89° 23' 56" west 15.00 feet to a point in a line parallel with and 15.00 feet west of the said easterly line; thence north 000 36' 04" east 63.00 feet along said parallel line; thence south 44' 23' 56" east 21.21 feet to a point in said easterly line; thence south 000 361 04" west 48.00 feet along said easterly line to the True Point of Beginning. For further particulars as to the proposed vacation, reference is hereby made to a map on file in the office of the City Clerk of said City. Section 2. That notice is hereby given that the 21st day of April, 1969, at the hour of 7:30 P.M. , or as soon thereafter as possible, in the Council Chamber in the City Hall, Huntington Beach, California, is the time and place when and where a public hearing shall be held upon said resolution of intention to vacate the above described easement, at which hearing all persons interested in or objecting to the proposed vacation may be heard. -1- v Resolution No. 2941 Section 3. The City Clerk is hereby authorized and directed to cause a copy of this resolution of intention to be publshed in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach, by two insertions prior to the hearing as set forth in Section 2 hereof. Section 4. The City Council of the City of Huntington Beach, in vacating the above described easement, does elect to proceed under the pro- visions of the Public Service Easements Vacation Law of 1943, Title 5, Division 1, Part 1, Chapter 2, Article 5 of the Government Code of the State of California. Section 5. The Street Superintendent is hereby authorized and directed to post notices of the easement vacation as required by law.
