RESOLUTION NO. 2949 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DETERMINING FEASIBILITY OF PROJECT, WAIVING DEBT LIMITATION, AND OVERRULING PROTESTS ASSESSMENT DISTRICT NO. 6601 WHEREAS , a public hearing was duly and legally called and held by the City Council of the City of Huntington Beach, California upon the Investigation Report of JAMES R. WHEELER, Director of Public Works , in Assessment District No. 6601 on March 17 , 1969, at which time said report was first summarized; and WHEREAS , all protests made in writing or orally to said proposed improvement were duly and legally considered; and WHEREAS , said Director of Public Works has advised that said protests , both oral and written, were not made by owners of more than half of the area of the property proposed to be assessed for said proposed work and improvement , and said City Council having acquired jurisdiction to proceed herein: NOW , THEREFORE, BE IT RESOLVE© by the City Council of the City of Huntington Beach, State of California, in regular session assembled, that all of said protests , both oral and in writing, be and the same hereby are overruled and denied. BE IT FURTHER RESOLVED that said City Council hereby finds from said Investigation Report , the information and opinion furnished by said Director of Public Works , and its personal know- ledge of the land and improvements in this assessment district , that said proposed project is feasible , that the public interest , -1- convenience and necessity require said proposed work and improve- ment , and that the lands to be assessed will be able to carry the burden of the proposed assessments . BE IT FURTHER RESOLVED that limitations upon the mount of assessments provided for in the Special Assessment Investiga- tion, Limitation and Majority Protest Act of 1931, Division 4 of the Streets and Highways Code of the State of California, shall be disregarded, both with respect to the limitations on the district as a whole and as to the limitations on individual specific assess- ments , and that proceedings for said improvement shall be taken under the Improvement Act of 1911 of the State of California, Division 7 of the Streets and Highways Code , and improvement bonds shall be issued pursuant to the provisions of said Improvement Act .
