HomeMy WebLinkAboutCity Council - 2971 RESOLUTION NO. 2971 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH SUSPENDING THE ISSUANCE OF BUILDING, PLUMBING, ELECTRICAL, SIGN, GRAD- ING AND OTHER PERMITS, AND INSTRUCTING THE PLANNING COMMISSION TO DEFER ALL CONSIDERATION OF ANY PROPOSED PROJECTS IN THE EXPANDED CEN- TRAL CITY PARK AREA TO BE ACQUIRED FOR PUBLIC PURPOSES BY THE CITY COUNCIL WHEREAS, the City of Huntington Beach contemplates the acquisition of certain real property within the city for the purpose of constructing a library and developing a park site for uses incidental thereto; and The city has determined that public need and necessity require the immediate acquisition of certain property within the expanded central city park area for park purposes , NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows : 1. That the City Council is acquiring, by condemnation or otherwise, that certain real property described in Ex- hibits "A" through "L," attached hereto and by reference made a part hereof. 2 . That the health, safety and welfare of the public re- quires, and it is in the best interest . of the City of Huntington Beach that the issuance of building, plumbing, electrical, sign, grading and other permits in said area be suspended, and that the Planning Commission and subordinate bodies take no action on any proposed development or rezoning of said property except for park use , and the Council does hereby order that no such permit shall be issued, and no rezoning or development plans shall be considered by the Planning Commission or subordinate bodies for a period of six months from and after the adoption of this resolu- 1. lution, or unless sooner notified so to do by the City Council. 3. Nothing in this resolution shall be construed to pro- hibit the doing of any act which is necessary to preserve said property in substantially the same condition it is in on the date of adoption of this resolution. 4 . Nothing herein shall be construed as a limitation on the city, county , state, federal government or any other public agency to enforce any code , statute or ordinance applicable to said property .
