HomeMy WebLinkAboutCity Council - 2979 RESOLUTION NO . 2979 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF AN EIGHT-FOOT UTILITY EASEMENT LOCATED IN TRACT NO . 6453 OF SAID CITY WHEREAS, on the 17th day of March, 1969 the City Council of the City of Huntington Beach duly adopted Resolution No . 2940, declaring its intention to vacate an eight-foot utility easement for sanitary sewer purposes, located in Tract No . 6453 in the City of Huntington Beach; and Said resolution fixed the time and place of April 21, 1969 at 7 : 30 p .m. in the Council Chamber in City Hall, Huntington Beach, California for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen days from the date of passage of said resolution . Said resolu- tion was duly published in the manner prescribed by law for the publishing of resolutions of the city . Notices of said vacation were posted conspicuously along the line of the easement proposed to be vacated, as required by law. On April 21, 1969 at the hour of 7 : 30 p .m. thereof, in the Council Chamber in City Hall, Huntington Beach, California, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the vacation of the eight-foot utility easement for sanitary purposes , located in Tract No. 6453, at which time no objection was made to said vacation, and evidence was presented showing that the easement rights proposed to be vacated were not necessary for sanitary sewer purposes, and it was found by the City Council from all evidence submitted that the eight-foot utility easement in Tract No . 6453 is not necessary for present or future use by the city . 1. NOW, THEREFORE, the City Council of the City of Huntington Beach does resolve that the utility easement, located in Tract No. 6453, now owned by the city, is not necessary for present or future use by the city, and it is hereby ORDERED that the utility easement , located in Tract No . 6453, be and the same is hereby vacated; and said utility ease- ment so vacated is described as follows : That eight-foot easement, dedicated for sanitary sewer purposes , as shown on a map of Tract No . 6453, recorded in Book 247, pages 23-27 of Miscellaneous Maps , Records of Orange County, Cali- fornia, said easement being the south- westerly eight feet of Lot 55 of said tract, and as shown on the map hereto attached, marked Exhibit "A.
