HomeMy WebLinkAboutCity Council - 3011 RESOLUTION NO. 3011 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF H UNTINGTON BEACH DECLARING THAT PUBLIC IN- TEREST AND NECESSITY REQUIRES THE ACQUISITION OF CERTAIN REAL PROPERTY FOR CONSTRUCTION AND DEVELOPMENT OF LIBRARY AND PUBLIC PARK FACIL- ITIES AND USES INCIDENTAL THERETO, AND AUTHOR- IZING THE CONDEMNATION OF SAID PROPERTY OR NEGOTIATION FOR ACQUISITION, AND DIRECTING ITS ATTORNEY TO PROCEED WITH SUCH ACTION WHEREAS, the City of Huntington Beach is anticipating the construction and development of library and public park facili- ties and uses incidental thereto; and Construction of said facilities is imminent and it is nec- essary that certain real property, hereinafter set forth, af- fected by the construction of said facilities be acquired by the City of Huntington Beach; and It is in the public interest and necessity to acquire said land for the construction of such facilities ; NOW, THEREFORE, BE IT RESOLVED as follows : The City Council of the City of Huntington Beach finds , de- termines and declares : 1. That the public interest and necessity requires the ac- quisition, construction and completion of public improvements, namely : library and public park facilities and uses incidental thereto . 2. That the public interest and necessity requires the ac- quisition for and in connection with said improvement of the real property or interest in real property hereinafter described; and 3. That Don P . Bonfa, City Attorney for the City of Hunt- ington Beach, be and he is hereby authorized, directed and em- powered to acquire in the name of the City of Huntington Beach, a municipal corporation, a fee simple estate, unless a lesser estate 1. is hereinafter expressly described, in and to said hereinafter described real property or interest in real property, by con- demnation in accordance with the provisions of the Code of Civil Procedure Section 1237 et seq. and the Constitution of the State of California relating to eminent domain and such other statutes of the State of California as may be applicable , to prepare and prosecute in the name of the City of Huntington Beach such pro- ceeding or proceedings in the proper court having jurisdiction thereof as are necessary for such acquisition. 4 . The real property or interest in real property which the City of Huntington Beach is, by this resolution, authorized to acquire is situated in the City of Huntington Beach, County of Orange, State of California, and is more particularly described as follows : PARCEL 1: Lots 1 through 182 both inclusive in Block A of Tract No. 296, as shown on a map re- corded in Book 14 , page 19 of Miscellaneous Maps , records of Orange County, California. PARCEL 2 : The north half of the south two-thirds of the west three-fourths of the north half of the southwest quarter of Section 26, Township 5 South, Range 11 West partly in the Rancho Las Bolsas and partly in the Rancho La Bolsa Chica, as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps , records of Orange County, California, said land being also described as the central one-third extending east and west of the west three-fourths of the north half of the southwest quarter of said Section 26 . PARCEL 3 : That portion of the east 30 acres of the west 60 acres of the south half of the south- west quarter of Section 26, Township 5 South, Range 11 West , partly in the Rancho La Bolsa Chica and partly in the Rancho Las Bolsas , as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps , records of Orange County, California, lying northerly of the Bolsa Drainage District boundary line as described in the in- strument recorded July 17, 1919 in Book 13, page 303 of Miscellaneous Records , Orange County, California. 2 . The westerly 336 . 00 feet of that portion of the east 30 acres of the west 60 acres of the south half of the southwest quarter of Sec- tion 26, Township 5 South, Range 11 West partly in the Rancho La Bolsa Chica and partly in the Rancho Las Bolsas , as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps , records of Orange County, California, lying southerly of the Bolsa Drainage District bound- ary line as described in the instrument recorded July 17, 1919 in Book 13, page 303 of Miscellaneous Records , Orange County, California. PARCEL 4 : The west half of the east half of the southwest quarter of the northeast quarter of the northeast quarter of Section 34, Township 5 South, Range 11 West, partly in the Rancho La Bolsa Chica and partly in the Rancho Las Bolsas , as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps , records of Orange County, California. PARCEL 5: The southerly 145 feet of the west half of the northwest quarter of the northwest quarter of the northwest quarter of Section 35, in Township 5 South, Range 11 West , in the Rancho Las Bolsas , map in Book 51, page 13, Miscellaneous Maps , records of Orange County, California. PARCEL 6: The west half of the northwest quarter of the northwest quarter of the northwest quarter of Section 35, Township 5 South, Range 11 West in the Rancho Las Bolsas , as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps , records of Orange County, California. EXCEPTING therefrom the southerly 145 feet . PARCEL 7 : The south one-third of the west three- fourths of the north half of the southwest quarter of Section 26 , Township 5 South, Range 11 West , partly in the Rancho Las Bolsas and partly in Rancho La Bolsa Chica, as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps , records of Orange County, California. PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California at a regular meeting thereof held on the 16th day of June, 1969 . Mayor 3 .
