HomeMy WebLinkAboutCity Council - 3034 RESOLUTION NO. 3034 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH MAKING ITS DETERMINATION AND FINDING OF MAJORITY PROTEST IN PROPOSED ANNEXATION PROCEEDINGS DESIGNATED SUNSET BEACH ANNEXATION NOS. 5 AND 6 WHEREAS, on the 7th day of July, 1969 the City Council of the City of Huntington Beach did pass and adopt Resolution No . 3019 declaring that proceedings had been initiated to annex certain inhabited territory to the City of Huntington Beach, upon re- ceiving a petition signed by not less than one-fourth of the qualified electors residing in such inhabited territory, pur- suant to Section 35116 of the Government Code, said territory being therein designated as "Sunset Beach Annexation Nos . 5 and 6" and the boundaries of the territory proposed to be annexed described in Exhibits "A" and "B" of said resolution; and Said resolution did contain a notice of the day, hour and place when and where the Council of this city would hear protests made by any person owning real property within the territory pro- posed to be annexed to the City of Huntington Beach, and said Resolution No. 3019 fixed Wednesday, August 6, 1969 at the hour of 8: OO p.m. in Council Chambers in the Civic Center of the City of Huntington Beach, County of Orange, State of California as the time and place for hearing protests to the said annexation; and Said resolution was published at least once a week for two successive weeks in the Huntington Beach News , a newspaper of general circulation, published in the City of Huntington Beach, said publication having been completed at least twenty (20) days prior to the date set for said hearing in compliance with and as 1. prescribed by Section 35119 of the Government Code; and At the time set for hearing protests the Council opened and continued the hearing to August 18, 1969 at the hour of 7: 30 p .m. , or as soon as possible thereafter, to hear and pass upon all pro- tests so made; and At the close of said continued hearing, the City Council did hear and pass upon all protests to the proposed annexation; and This resolution is made pursuant to Section 35121. 1 of the Government Code of the State of California, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that it does find and declare that majority protest has been made to the proposed annexation of Sunset Beach Nos . 5 and 6 . BE IT FURTHER RESOLVED by this Council that no further pro- ceedings for annexation of any of the same territory to the City of Huntington Beach shall be taken for one year after adoption of this resolution except upon petition or consent of all property owners of said territory designated as Sunset Beach Nos . 5 and 6. N0 5 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH REQUESTING THE STATE TO CLOSE OR RELOCATE VARIOUS MEDIAN OPENINGS ON BEACH BOULEVARD WHEREAS, the State Division of Highways is preparing plans to widen Beach Boulevard thru this City; and WHEREAS, the location of several existing median openings on Beach Boulevard cause disruptions to through traffic as well as potential traffic hazards; and WHEREAS, the State requires a City Council Resolution before closing or relocating an existing median opening. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach hereby requests the California Division of Highways to include in their proposed widening project on Beach Boulevard the following median alterations: 1) Close the median at Owens Street. 2) Open the median at Constantine Drive. 3) Relocate the median opening at Harbour Volkswagen Agency north of Constantine Drive from their southerly driveway to their northerly driveway. 4) Relocate the median opening at Town & Country Shopping Center south of Ellis Avenue from their northerly driveway ` to their southerly driveway. 5) Close the median opening at Liberty Avenue. 6) Close the median opening between Terry Drive and Chrysler Drive. 7) Close the median openings at Glencoe, Holt and Aldrich Avenues.
