A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE VACATION OF
CERTAIN EASEMENTS IN THE PARKING AUTHORITY
PROJECT
WHEREAS , on January 5, 1970 the City Council of the City of
Huntington Beach duly adopted Resolution No . 3109 declaring its
intention to vacate certain easements located in the Parking
Authority Project , and referring to a map or plan on file in the
office of the City Clerk for particulars as to the proposed
vacation; and
Said resolution fixed the time and place of February 2 , 1970
at the hour of 7: 30 p.m. , or as soon thereafter as the matter may
be heard, in Council Chambers in the City Hall, Huntington Beach,
California for hearing all persons interested in the proposed va-
cation, which time was not less than fifteen (15) days from the
passage of said resolution. Notices of the proposed vacation
were posted conspicuously along the line of the easements pro-
posed to be vacated, and such notices were posted not more than
three hundred (300 ) feet apart and at least three (3 ) were posted
in each easement proposed to be vacated.
On February 2, 1970 at the hour of 7 :30 p .m. thereof in the
Council Chambers in the City Hall, Huntington Beach, California,
the City Council of the City of Huntington Beach did convene for
the purpose of hearing all persons interested in the proposed
vacation, at which time evidence was presented showing that the
easements proposed to be vacated were no longer necessary for
drainage, sewerage or pedestrian purposes , and it was found by
the City Council from the evidence submitted that said easements
hereinafter described are not necessary for present or
prospective drainage, sewerage or pedestrian purposes ;

NOW, THEREFORE, the City Council of the City of Huntington
Beach does resolve that certain easements located in the Parking
Authority Project are not necessary for present or prospective
drainage, sewerage or pedestrian purposes , and it is hereby
ORDERED that the following described easements , located in
the Parking Authority Project , be and the same are hereby va-
cated; and said easements so vacated are described as follows :
1 . An easement over a portion of Parcel 9
and 11 for drain pipe purposes under that part of
the right of way of the Pacific Electric Railway
Company described as a strip 3 feet in width, the
center lines of said strip extending in a north-
easterly and southwesterly direction across said
right of way at right angles to the northeasterly
line of said strip and intersecting the center
line of the railway at engineer ' s stations lo-
cated in First Street , as conveyed in a deed from
Pacific Electric Railway Company to the City of
Huntington Beach, recorded April 18 , 1923 in
Book 468, page 8 of Deeds , official Records of
Orange County, California.
2 . An easement over a portion of Parcel 8
for sewer and incidental purposes over two strips
of land two feet wide, the center lines of which
are described as follows :
(a) Beginning at a point in the southerly
line of a strip of land 60 feet wide described in
the deed from Pacific Electric Land Company to Los
Angeles Interurban Railway Company, recorded in
Book 139, page 9 of Deeds , westerly thereon 860 . 5
feet from the east line of Section 14 , Township 6
South, Range 11 West , S.B.B. &M. , thence at right
angles to said southerly line 100 feet to a point
in the northerly line of a 40 foot strip of land,
described in a deed from Southern Pacific Railroad
Company and Southern Pacific Company to Pacific
Electric Land Company, recorded in Book 785 , page
455 of official Records of Orange County, California.
(b) Beginning at a point in the southerly line
of a strip of land 60 feet wide described in the
deed from Pacific Electric Land Company to Los Angeles
Interurban Railway Company, recorded in Book 139 ,
page 9 of Deeds , westerly thereon 1221 . 5 feet from
the east line of Section 14 , Township 6 South,
Range 11 West, S.B.B. & .M. , thence at right angles to

said southerly line 100 feet to a point in the
northerly line of a 40 foot strip of land described in
the deed from Southern Pacific Railroad Company and
Southern Pacific Company to Pacific Electric Land
Company, recorded in Book 785, page 455 of official
Records , as conveyed to the City of Huntington Beach
by deed recorded March 9 , 1939 in Book 989 , page 46
of official Records , County of Orange , California.
3 . A pedestrian crossing up and across that
certain parcel of land situated in the City of
Huntington Beach, Orange County, California, and
described as follows :
A strip of land 8 feet in width extending across
that certain 82 foot strip of land, described in deed
to Los Angeles Interurban Railway Company, recorded in
Book 155 , page 260 of Deeds , records of Orange County,
California, the northwesterly line of said strip of
land 8 feet in width being described as follows :
Beginning at the point of intersection of the
northeasterly line of said 82 foot strip with tie
southwesterly prolongation of a line which is para-
llel to and 8 feet northwesterly, measured at right
angles, from the southeasterly line of Third Street
(60 feet wide) as said street is shown on a map of
Huntington Beach, recorded in Book 3, page 36 of
Miscellaneous Maps , Records of Orange County , Cali-
fornia; thence from said point of intersection
southwesterly long said southwesterly prolongation
of said parallel line to a point of intersection
with the southwesterly line of said 82 foot strip,
as granted in the deed from Pacific Electric Railway
Company to the City of Huntington Beach, recorded
October 5, 1941 in Book 1115 , page 390 of official
Records , Orange County, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 2nd
day of February, 1970 .
