A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH DECLARING THAT PROCEEDINGS
ARE INITIATED TO ANNEX TO SAID CITY CERTAIN UN-
INHABITED TERRITORY DESCRIBED HEREIN AND DESIG-
NATED AS "NEWLAND ANNEXATION NO. 4 ," AND GIVING
NOTICE OF THE PROPOSED ANNEXATION AND OF THE
TIME AND PLACE FOR HEARING WRITTEN PROTESTS
THERETO
The City Council of the City of Huntington Beach does
hereby resolve as follows :
SECTION 1. That , pursuant to the provisions of the
Annexation of Uninhabited Territory Act of 1939 , proceedings
are hereby initiated by the City Council of the City of Hunt-
ington Beach on its own motion, as provided in Section 35310
of the Government Code , to annex to the City of Huntington
Beach all that uninhabited territory situate in the County
of Orange , State of California, hereby designated as "Newland
Annexation No . 4 , " which said territory is included within
the City of Fountain Valley.
SECTION 2 . The City of Fountain Valley, by Resolution
No. 4075 , adopted January 2, 1968 , has consented to said
annexation, and has received the written consent of at least
two-thirds of the owners of real property within the territory,
holding at least two-thirds in value of the real property, in
the territory.
SECTION 3 . All of said territory so proposed to be annexed
is described as follows :
Commencing at the southeast corner of the southwest
one quarter (SW 1/4) of Section 36, Township 5 South,
Range 11 West , San Bernardino Base and Meridian,
Orange County, California; thence north 0050 ,14" west
20 . 00 feet , along the east line of said southwest one
quarter, to a point on the present right of way line

of Garfield Avenue , said point being on the common
boundary line of the City of Huntington Beach and
the City of Fountain Valley as established by
Resolution No. 2633 of the City of Huntington Beach
and by Resolution No. 4050 of the City of Fountain
Valley, said point also being the true point of
beginning; thence along the following described
common boundary line as established by said Reso-
lution No . 2633 and consented to by said Resolution
No. 4050, south 89140 ' 15" west 422 . 80 feet to a
point ; thence north 15°04 ' 34" west 270 . 41 feet to
a point ; thence north 88103126" east 188 .10 feet to
a point ; thence north 19104 ' 34" west 403 . 26 feet to
a point ; thence north 32°24 ' 34" west 9 .11 feet to a
point ; thence continuing north 3202434" west 683 . 23
feet to a point ; thence north 3004 '34" west 66 . 42
feet to a point ; said point being an angle point in
the common boundary line of the City of Huntington
Beach and the City of Fountain Valley, established
by the intersection of the boundary line described
by said Resolution No . 2633 and Resolution No . 4050
with the southerly line of the "Newland Annexation
No . 3" to the City of Huntington Beach as established
by Ordinance No. 1379 of the City of Huntington Beach
and as consented to by Resolution No . 4050 of the
City of Fountain Valley; thence along the following
described common boundary line established by said
Ordinance No. 1379; north 89038 ' 35" east 67 .46 feet
to a point ; thence north 0°49108" west 660 . 86 feet
to a point ; thence north 89037 , 45" east 64 . 29 feet to
a point ; thence north 0049114" west 680 . 88 feet to a
point in the northerly right of way line of Ellis
Avenue, 40 . 00 feet in width as now laid out , said
point also lying in the east line of the southwest
one quarter (SW 1/4) of the southeast one quarter
(SE 1/4) of the northwest one quarter (NW 1/4) of
said section 36 ; thence leaving the boundary line
of the City of Fountain Valley and continuing along
the boundary line of the City of Huntington Beach
established by said Ordinance No. 1379 and City of
Huntington Beach Ordinance No . 683 "Harpers Annex-
ation" south 89036 ' 56" west 660 . 22 feet to a point
in the west line of the southeast one quarter (SE 1/4)
of the northwest one quarter (NW 1/4) of said section
36, said point being an angle point in the boundary
line of the City of Huntington Beach; thence north
0046 '14" west 1300 . 03 feet along said west line of
the southeast one quarter (SE 1/4) of the northwest
one quarter (NW 1/4) of the said section 36 and the
boundary line of the City of Huntington Beach as
established by "North Annexation" to the City of
Huntington Beach Ordinance No . 667, said point being

the southwest corner of the northeast one quarter
(NE 1/4 ) of the northwest one quarter (NW 1/4) of
section 36, said point also being in the southerly
boundary line of the Tract No . 2699 as shown on a
map recorded in Book 84 , pages 29 and 30 of Miscel-
laneous Maps , Records of Orange County, California;
thence north 89136 ' 34" east along the southerly line
of said Tract No. 2699 and along the boundary line
of the City of Huntington Beach as established by
Ordinance No . 1379 , 659 . 93 feet to a point , said
point being the southwest corner of "Northeast No .
3" Annexation to the City of Huntington Beach as
established by Ordinance No . 815 of the City of
Huntington Beach; thence continuing north 89036 ' 34"
east 668 . 53 feet , described as south 89047 ' 54" east
667 . 7 feet more or less , by said Ordinance No . 815 ,
to an angle point in the common boundary line of
the City of Huntington Beach and the City of Fountain
Valley as established by Ordinance No . 815 of the
City of Huntington Beach and by the Incorporation
Boundaries of the City of Fountain Valley as certified
on June 13 , 1957 ; thence following said common boundary
line north 34013111" east 19 . 86 feet , described as
north 14°30 ' east 21 . 0 feet more or less by said
Ordinance No. 815 , to an angle point in the last des-
cribed common boundary line, said point lying in the
easterly right of way line of Newland Street , 40 . 00
feet in width as now laid out , and said right of way
line being 20 . 00 feet easterly measured at right
angles from the east line of the northwest one quarter
of said section 36; thence leaving the boundary line
of the City of Huntington Beach and the City of
Fountain Valley, south 0147144" east along the
easterly right of way line of Newland Street , being
parallel with and 20 . 00 feet easterly measured at
right angles from the east line of the northwest one
quarter of said section 36, 1336 . 51 feet to a point
in the centerline of Ellis Avenue, 40 . 00 feet in
width as now laid out , said line being in the north
line of the southeast one quarter of said section 36 ;
thence south 89040 ,14" west along said north line
20 . 00 feet to a point , said point being the center
of said section 36 and also being the intersection
of the centerlines of Ellis Avenue and Newland Street ;
thence south 0050 '14" east along the centerline of
Newland Street and along the east line of the southwest
one quarter of said section 36, 2624 .14 feet to the
true point of beginning.
SECTION 4 . That the City Council of the City of Hunting-
ton Beach desires to annex said uninhabited territory to the
City of Huntington Beach for the following reasons : the

annexation of that portion of the hereinbefore described
territory currently lying within the City of Fountain Valley ,
will correct the common boundary line between the City of
Huntington Beach and the City of Fountain Valley so as to
make such boundary line definite and certain, and conform to
the Newland Street alignment. The annexation of the balance
of the property will eliminate a small pocket of county ter
,ritory between Fountain Valley and Huntington Beach and will
continue the Newland Street common boundary line between said
cities .
SECTION 5 . That the Local Agency Formation Commission
of Orange County on February 25 , 1970 did approve the
annexation of the territory above described and so proposed
to be annexed .
SECTION 6 . That Monday, April 20 1970 ,
at the hour of 7 :30 p.m. , or as soon thereafter as may be
heard, in the Council Chambers in the City Hall of the City
of Huntington Beach, California, is hereby fixed as the time
and place when and where the City Council will hear protests
from any owner of property within the territory proposed to
be annexed, which said time is not less than forty (40) nor
more than sixty (60) days after the adoption of this resolution .
Such protests must be in writing, may be filed at any time
prior to final adjournment of the hearing on protests against
the proposed annexation, and shall state the names or name of
the owner or owners of property affected , and the street
address or other description of the property to identify it
on the last equalized assessment roll .
SECTION 7 . The City Clerk of the City of Huntington
Beach is hereby directed to cause a copy of this resolution
to be published at least twice in the Huntington Beach News ,
a newspaper of general circulation, printed and published in
the City, and in the Huntington Beach Independent Review, a
newspaper of general circulation published outside the city ,

but in the County of Orange . Publication shall be complete
at least twenty (20) days prior to the date set for hearing.
SECTION 8 . The City Clerk shall also cause written
notice of such proposed annexation to be mailed to each
person to whom land within the territory proposed to be
annexed, is assessed in the last equalized county assessment
roll available on the date the proceedings were initiated,
at the address shown on said assessment roll or as known to
said Clerk, and to any person who has filed his name and
address and the designation of the lands in which he has any
interest , either legal or equitable , with said Clerk. Such
notices shall be given not less than twenty (20) days before
the first public hearing on the proposed annexation; provided,
that such notices need not be sent if the owners of all of
the territory to be annexed have filed their consent to such
annexation in writing with the legislative body.
SECTION 9. The City Clerk is directed to cause written
notice to be given to such other persons as may be legally
entitled thereto in the manner required by law.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the
2nd day of March 1970 .
