A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH MAKING ITS DETERMINATION AS TO
PROTESTS MADE AT THE TIME OF HEARING ON "NEWLAND
ANNEXATION NO. 4"
WHEREAS, pursuant to the provisions of the Annexation of Un-
inhabited Territory Act of 1939 , and specifically Section 35310
of the Government Code, this Council did pass and adopt Resolu-
tion No . 3144, which said resolution contained a notice of the
day, hour and place when and where the Council of the city would
hear written protests made by any owner of property to the an-
nexation of territory designated as "Newland Annexation No . 4; "
and
Such resolution fixed Monday, April 20 , 1970 at the hour of
7 : 30 p .m. , or as soon thereafter as might be heard, in the Council
Chambers in the City Hall of the City of Huntington Beach, Cali-
fornia as the time and place of hearing protests to said annex-
ation; and
Pursuant to Section 35311 of the Government Code, said
resolution was published at least twice in the Huntington Beach
News , a newspaper of general circulation, printed and published
in the city, and in the Huntington Beach Independent Review, a
newspaper of general circulation published outside the city , but
in the County of Orange, said publication having been completed
at least twenty (20.) days prior to the date set for hearing; and
Written notice of the proposed annexation was mailed to each
person to whom land within the territory proposed to be annexed
was assessed in the last equalized assessment roll available of the
County of Orange on the date annexation proceedings were initiated,
at the address shown on said assessment roll or as known to the
City Clerk, and to any person who had filed his name and address

and the designation of the lands in which he had any interest,
either legal or equitable, with said Clerk; and
At the time set for hearing protests the Council opened the
hearing to hear all protests made by any person owning real
property within the territory proposed to be annexed; and
At the close of said hearing, the City Council did find and
determine that majority protest had not been made to the proposed
annexation of uninhabited territory, designated as "Newland
Annexation No . 4 . "
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby RESOLVE and DECLARE that majority protest
has not been filed before this body against the proposed "Newland
Annexation No. 4 . "
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 20th day
of April, 1970 .

I , PAUL C. JONES, the duly elected, qualified and
acting City Clerk of the City of Huntington Beach, and ex-
officio Clerk of the City Council of said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is seven; that the foregoing
resolution was passed and adopted by the affirmative vote of
more than a majority of all the members of said City Council
at a regular meeting thereof held on the 20th
day of April 1970 , by the following vote :
