HomeMy WebLinkAboutCity Council - 3177 RESOLUTION N0. 3177 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH SUSPENDING THE ISSUANCE OF BUILDING AND OTHER PERMITS FOR USES IN THE "TOP OF THE PIER" DEVELOPMENT PLAN AREA INCONSISTENT WITH USES DESIGNATEE IN MASTER PLAN AMENDMENTS 70-1 AND 70-2. WHEREAS, on November 17, 1969 by Resolution No . 3082 , the City Council of the City of Huntington Beach approved the "Top of the Pier" Development Plan for the development of the "Top of the Pier" Development Plan Area of the city; and On December 18, 1969 , by Resolution No . 3103, the City Council instructed the Planning Commission to initiate proceedings to amend the master plan to provide for development of the "Top of the Pier" Development Plan Area in a mannei consistent with the "Top of the Pier" Development Plan, and to take other steps to implement such plan; and On March 2 , 1970, the City Council a opted Resolution No. 3134, amending the city' s Master Plan of L nd Use to include Master Plan Amendment No. 70-1, and by Res lution No. 3135, the City Council adopted Master Plan Amendment No. 70-2 to the Huntington Beach Master Plan of Arterial Streets andHighways ; and A map showing Master Plan Amendment Nos . 70-1 and 70-2, marked Exhibit "A, " is attached hereto and made a part hereof; and The "Top of the Pier" Development Plan Area is that certain Land area of the City of Huntington Beach, County of Orange, State of California, more particularly described in Exhibit "B" attached hereto and made a part hereof; and On March 16 , 1970, the City Council adopted Ordinance No. 1565 , creating a civic district facilities zone, and the Planning Commission of the city is in the process of initiating zone change legislation to place certain areas in said "Top of the Pier" Develop- ment Area in such civic district ; and 1 . Res . 3177 The Planning Commission of city is in the process of initiating legislation to create appropriate land use zones to insure devel- opment in the "Top of the Pier" Development Plan Area in accordance with said Master Plan Amendments Nos . 70-1 and 70-2 ; and The Planning Commission of city is in the process of preparing a precise plan of street alignment for the area within the "Top of the Pier" Development Plan Area; and The Planning Commission is in process of developing a specific plan for the development of the "Top of the Pier" Development Plan Area to provide for development consistent with Master Plan Amend- ments Nos . 70-1 and 70-2 ; and The City Council desires to restrict and prohibit uses in such area inconsistent with the "Top of the Pier" Development Plan, Master Plan Amendments Nos . 70-1 and 70-2, proposed zone change legislation, proposed precise plans of street alignment , and proposed specific development plan; and The City Council finds and determines that the health, safety and welfare of the public requires , and it is in the best interests of the City of Huntington Beach, that the city suspend the issuance of building, plumbing, electrical, sign., , grading and other permits in the "Top of the Pier" Development Plan Area, de- scribed in attached Exhibit "B," in order to preserve the integrity of such property and to prevent uses in such area which are,.,, or will be, inconsistent with the "Top of the Pier" Development Plan and Master Plan Amendment Nos . 70-1 and 70-2 pending the adoption of such proposed zone change legislation, precise plan of street alignment and specific development plan, NOW, THEREFORE , the City Council of the City of Huntington Beach does resolve as follows : 1 . That the health, safety and welfare of the public re- quires , and it is in the best interests of the City of Huntington Beach, that the city suspend the issuance of building, plumbing, electrical, sign, grading, and other permits in the "Top of the Pier" Development Plan Area, described in said Exhibit "B, " in order to preserve the integrity of such property and to prevent 2 . Res 31.77 uses in such area which are, or will be, inconsistent with the "Top of the Pier" Development Plan and Master Plan Amendments Nos . 70-1 and 70-2 , pending the adoption of such proposed zone change legislation, precise plans of street alignment and specific development plan. 2 . This resolution shall be effective for a period of six (6) months from and after the date of its adoption, or until the effective dates of the above-mentioned proposed zone change legislation, pre- cise plan of street alignment , and specific development plan, which- ever shall first occur. 3. That this resolution supersedes any previously adopted resolution inconsistent herewith. 4. Nothing in this resolution shall be construed to prohibit the issuance of building, plumbing, electrical, sign, grading and other permits in order to make minor repairs and maintain existing structures within the above-described real property . 5 . Alterations or remodeling of an existing structure within the "Top of the Pier" Development Plan Area may be permitted when the owner of the structure and the person in possession of said structure agree in writing that they understand and have received notice that the property may be subject to eminent domain proceedings , and they further understand and agree that the value or cost of the alteration or remodeling, or the increase in value of the structure, by reason of said alteration or remodeling, shall not be considered for the purpose of appraisal of said property , or the acquisition of such property by the city . 6 . Nothing herein shall be construed as a limitation on the city , county, state , .federal government or any other public agency to enforce any code, statute or ordinance applicable to properties within said "Top of the Pier" Development Plan Area.
