HomeMy WebLinkAboutCity Council - 3194 RESOLUTION NO. 3194 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH REGULATING AND FIXING THE USE OF THE RECREATION CENTER AND LAKE PARK CLUBHOUSE AND REPEALING RESOLUTIONS IN CON- FLICT THEREWITH The City Council of the City of Huntington Beach does hereby resolve as follows : SECTION 1. That the Recreation Center and Lake Park Clubhouse in the City of Huntington Beach are public buildings, erected by and at the cost of the people of said city; and that said Lake Park Clubhouse and Recreation Center shall at all times be, subject to the necessary regulations hereinafter specified, open to the convenient use of the same by the people of the City of Huntington Beach. SECTION 2 . That the City Council of said city shall have and retain the control of said Recreation Center and Lake Park Clubhouse, and shall from time to time prescribe its uses , rules and regulations governing same . SECTION 3 . That the word "person" when used in this reso- lution shall include firm, co-partnership, association, society or guild, incorporated or unincorporated as well as an individual or group of individuals . SECTION 4 . That the Director of Recreation and Parks shall be the custodian of the keys to and the personal property of said Recreation Center and Lake Park Clubhouse; shall receive all appli- cations and fees and issue all permits for the use of same at his discretion and in the interest of the people of the City of Hunt- ington Beach, subject to the final decision of the City Council, reject any application for the use of said buildings , or require any applicant to pay a fee in addition to the regular charges 1 . hereinafter set forth in an amount sufficient to pay for supplemental supervision or police protection deemed necessary to protect the city ' s interest . All fees shall be placed in the Recreation Fund. SECTION 5 . That any person desiring to use the Recreation Center or Lake Park Clubhouse, first apply to the Director of Recreation and Parks for a permit therefor, upon application forms to be furnished by the Director, at least five (5) days prior to the date when such use is desired other than hours of city-sponsored use . SECTION 6 . That priority of building use other than hours of city-sponsored use shall be defined as follows : (a) First priority shall be given to paying persons on a first come, first served basis allowing them to re- serve a maximum of ten (10) dates up to one (1) year in advance if desired, fee to be paid at the time of appli- cation. (b) Second priority shall be given to nonpaying persons, defined as those charitable, philanthropic or civic organizations who have been approved by the Director of Recreation and Parks ; in that they may re- serve a facility no earlier than the first day of the month preceding the month in which they wish their reservations . A maximum of ten (10) dates may be reserved in advance . (c ) That monies of first priority groups be re- funded if cancellation is requested at least fifteen (15) days prior to their reservation. (d) That persons may be allowed to store properties pertinent to their respective organization within city facilities at the discretion of the Director of Recreation and Parks with the needs of city-sponsored programs being given first consideration for available space . SECTION 7 . That the following charges shall be made for the use of the Recreation Center where the object of such rental is not for profit or financial gain other than for charitable, philanthropic or civic uses . 2 . (a) During the hours that the building is generally kept open to the public , there shall be no charge levied to persons allowed reservations for certain rooms . An hourly rate of Four Dollars ( $4 .00) shall be charged persons for use beyond the regular hours , fee to be estimated and paid at the time of application. (b) During the hours that the building is not generally open to the public, there shall be a minimum charge of Fifteen Dollars ($15 .00) and an additional Four Dollars ($4 .00) per hour for any time over three (3) hours, fee to be estimated and paid at the time of application. SECTION 8 . That the following charges shall be made for the use of the Recreation Center where the object of such rental is for financial gain over and above charitable, philanthropic or civic use : (a) During the hours that the building is not generally open to the public, there shall be a minimum charge of Thirty Dollars ($30 .00) and an additional Eight Dollars ($8 .00) per hour for any time over three (3) hours , fee to be estimated and paid at the time of application. (b) During the hours the building is generally kept open to the public, profit-making groups will not be allowed a reservation . SECTION 9 . That the following charges shall be made for the, use of Lake Park Clubhouse where the object of such rental is not for profit or financial gain other than for charitable, philan- thropic or civic uses : (a) During the hours that the Park and Lake Park Clubhouse are supervised by city personnel there shall be no charge other than for use of kitchen facilities and a per hour basis on the following schedule for any period of time when said building and grounds are un- supervised. (b) A Ten Dollar ( $10 .00) minimum and an additional Four Dollar ($4 . 00) per hour fee shall be charged for any time over four (4) hours . 3 . (c) Fees to be estimated and paid at the time of application. SECTION 10 . That the following charges shall be made for a g g the use of Lake Park Clubhouse where the object of such rental is for profit or financial gain over and above charitable, philanthropic or civic use : (a) A Twenty Dollar ($20 .00) minimum and an additional Eight Dollars ($8 . 00) per hour fee shall be charged for any time over four (4) hours . (b ) Fees to be estimated and paid at the time of application. SECTION 11. That any person who has been granted permis- sion to use the Recreation Center or Lake Park Clubhouse shall leave the premises in the same condition of cleanliness as found and agrees to indemnify the City of Huntington Beach for any loss or damage occasioned by the use thereof, upon receipt of notification from the Director of Recreation and Parks of the amount of such loss or damages incurred. SECTION 12 . That any person dissatisfied with a decision of the Director of Recreation and Parks in rejecting an appli- cation for building use, charging a fee, determination of a priority group, or requiring an additional fee for supervision or police protection may appeal to the City Council of the City of Huntington Beach that decision, and the decision of the City Council shall be final . SECTION 13 . That the Director of Recreation and Parks shall at all times see that arrangements have been made to have the Recreation Center and Lake Park Clubhouse securely locked when not in use and shall from time to time inspect the premises and the personal property thereof, and shall require the custodians to report to him promptly any and all damages and/or loss occasioned by the use of said buildings and personal property and shall promptly notify the person or persons responsible for such damage and loss to make proper settlement therefor with the Director. 4 . SECTION 14 . It shall be necessary in order to avoid overcrowding and conflict in dates , for any group of fifty (50 ) or more people to reserve picnic facilities through the Recreation and Parks Department for any picnic facilities . SECTION 15 . That Resolution No . 2442 is hereby repealed. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 20th day of Jules_, 1970 .
