A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH SUSPENDING THE
ISSUANCE OF BUILDING AND OTHER PERMITS
FOR USES IN THE "TOP OF THE PIER"
DEVELOPMENT PLAN AREA INCONSISTENT WITH
USES DESIGNATED IN MASTER PLAN AMENDMENTS
70-1 AND 70-2 .
WHEREAS, on November 17 , 1969 by Resolution No . 3082, the
City Council of the City of Huntington Beach approved the "Top
of the Pier" Development Plan for the development of the "Top
of the Pier" Development Plan Area of the city; and
On December 18, 1969, by Resolution No . 3103, the City
Council instructed the Planning Commission to initiate proceedings
to amend the master plan to provide for development of the
"Top of the Pier" Development Plan Area in a manner consistent
with the "Top of the Pier" Development Plan, and to take other
steps to implement such plan; and
On March 2, 1970, the City Council adopted Resolution No .
3134 , amending the city ' s Master Plan of Land Use to include
Master Plan Amendment No. 70-1, and by Resolution No . 3135,
the City Council adopted Master Plan Amendment No . 70-2 to
the Huntington Beach Master Plan of Arterial Streets and High-
ways ; and
A map showing Master Plan Amendment Nos . 70-1 and 70-2,
marked Exhibit "A, " is attached hereto and made a part hereof;
and
The "Top of the Pier" Development Plan Area is that certain
land area of the City of Huntington Beach, County of Orange,
State of California, more particularly described in Exhibit
"B" attached hereto and made a part hereof; and
On March 16 , 1970, the City Council adopted Ordinance No .
1565 , creating a civic district facilities zone, and the
Planning Commission of the city is in the process of initiating
zone change legislation to place certain areas in said "Top
of the Pier" Development Area in such civic district ; and

The Planning Commission of city is in the process of
initiating legislation to create appropriate land use zones
to insure development in the "Top of the Pier" Development
Plan Area in accordance with said Master Plan Amendments Nos .
70-1 and 70-2; and
The Planning Commission of city has prepared and the City
Council has adopted a majority of the precise plan of street
alignment for the area within the "Top of the Pier" Development
Plan Area; and
The Planning Commission is in process of developing a
specific plan for the development of the "Top of the Pier"
Development Plan Area to provide for development consistent
with Master Plan Amendments Nos . 70-1 and 70-2 ; and
The City Council desires to restrict and prohibit uses in
such area inconsistent with the "Top of the Pier" Development
Plan, Master Plan Amendments Nos . 70-1 and 70-2, proposed zone
change legislation, proposed precise plans of street alignment,
and proposed specific development plan; and
The City Council finds and determines that the health,
safety and welfare of the public requires , and it is in the best
interests of the City of Huntington Beach, that the city suspend
the issuance of building, plumbing, electrical, sign, grading
and other permits in the "Top of the Pier" Development Plan
Area, described in attached Exhibit "B, " in order to preserve
the integrity of such property and to prevent uses in such area
which are, or will be, inconsistent with the "Top of the Pier"
Development Plan and Master Plan Amendment Nos . 70-1 and 70-2
pending the adoption of such proposed zone change legislation,
and the remainder of the precise plan of street alignment and
specific development plan,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does resolve as follows :
1. That the health, safety and welfare of the public
requires , and it is in the best interests of the City of
Huntington Beach, that the city suspend the issuance of building,

plumbing, electrical, sign, grading, and other permits in the
"Top of the Pier" Development Plan area, described in said
Exhibit "B",, in order to preserve the integrity of such
property and to prevent uses in such area which are , or will
be, inconsistent with the "Top of the Pier" Development Plan
and Master Plan Amendments Nos . 70-1 and 70-2, pending the
adoption of such proposed zone change legislation, precise
plans of street alignment and specific development plan.
2 . This resolution shall be effective for a period of
ninety (90) days from and after December 1, 1970 , or until
the effective date of the above-mentioned proposed zone change
legislation, whichever shall first occur .
3 . That this resolution supersedes any previously adopted
resolution inconsistent herewith.
4 . Nothing in this resolution shall be construed to
prohibit the issuance of building, plumbing, electrical, sign,
grading and other permits in order to make minor repairs and
maintain existing structures within the above-described real
property .
5 . Alterations or remodeling of an existing structure
within the "Top of the Pier" Development Plan Area may be per-
mitted when the owner of the structure and the person in
possession of said structure agree in writing that they under-
stand and have received notice that the property may be subject
to eminent domain proceedings , and they further understand and
agree that the value or cost of the alteration or remodeling,
or the increase in value of the structure , by reason of said
alteration or remodeling, shall not be considered for the pur-
pose of appraisal of said property, or the acquisition of such
property by the city .
6 . Nothing herein shall be construed as .a limitation of
the city, county, state , federal government or any other public
agency to enforce any code , statute ordinance applicable to
properties within said "Top of the Pier" Development Plan Area .

7 . This resolution does not supersede Resolution No. 3177
which expires on November 30, 1970 .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at an adjourned regular meeting thereof held
on the 23rd day of November, 1970 .

"TOP OF THE PIER" DEVELOPMENT PLAN
NOTE: use center lines as precise locations of all
streets and alleys unless otherwise noted.
Beginning at a point being thejunction of Pacific
Coast Highway and the extension, of the alley between 7th and
8th Streets, thence northeasterly parallel to 7th Street 2500 feet
plus or minus to Palm Avenue, thence southeasterly 270 feet plus or
minus parallel to Palm Avenge to Main Street, thence easterly
parallel to Hartford Avenue 700 feet plus or minus to Alabama
Street , thence aoutberly parallel to Alabama Street 1670 feet
plus or minus to Chicago Avenue, thence easterly parallel to
Chicago Avenue 2470 feet plus or minus to Beach Boulevard,
thence southerly _paral.lel to Beach Boulevard 4430 feet plus or
minus to the shoreline of the Pacific Ocean, thence north-
westerly along said shoreline 6820 feet plus or minus to the
extension of 8th "Street , thence northeasterly parallel to 8th
