HomeMy WebLinkAboutCity Council - 3249 RESOLUTION N0. 3249 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH STATING THE RE- SULT OF THE CANVASS OF ELECTION RETURNS OF THE SPECIAL ELECTION HELD NOVEMBER 3 , 1970 WHEREAS , the City Council of the City of Huntington Beach, by Resolution No. 3209, duly called and provided for the hold- ing of a special election in said city on November 3 , 1970, for the purpose of submitting to the qualified voters of said city the propositions set forth in said resolution and hereinafter stated; and The City Council of said City of Huntington Beach did re- quest the Registrar of Voters of Orange County, California to include said special election for the City of Huntington Beach with an election being held by the County of Orange for the United States and the State of California; and Notice of said election was duly and regularly given in time , form and manner as provided by law, and said election was duly held on said date at the polling places designated by said County of Orange; and The Registrar of Voters of the County of Orange did on November 23, 1970 issue a certification of the statement of vote for the City of Huntington Beach special municipal election con- solidated with the general election held November 3, 1970, and that the votes cast in the special election of the City of Hunt- ington Beach, as combined with the general election held by the County of Orange, are as follows : PROPOSED CHARTER AMENDMENT K: Shall the Charter be amended to provide for an elective mayor, and that all depart- ments , boards and commissions be established by ordinance, and requiring compensation for councilmen be set by public hearing and ordinance? 1 . YES VOTES - 16 ,060 NO VOTES - 163230 PROPOSED CHARTER AMENDMENT L: Shall the Charter be amended to require public works contracts involving more than $10, 000 be let to the lowest responsible bidder except under specified con- ditions? YES VOTES - 23,635 NO VOTES - 8 ,319 PROPOSED CHARTER AMENDMENT M: Shall the Charter be amended to authorize general obligation bonds upon the affirmative votes of the majority required by law of the electors voting on the bond proposition? YES VOTES - 18,951 NO VOTES - 11, 589 PROPOSED CHARTER AMENDMENT N: Shall the Charter be amended to permit the receipt of the canvass of ballots on the Monday following the election, to require candidates for elective office to pay a fee of $100 for filing nomination papers and to require nomination papers to be signed by fifty electors? YES VOTES - 22,137 NO VOTES - 8 ,907 As provided in the California Constitution, the city Charter may amended by majority vote of its electors voting on the question. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve, determine and order as follows : SECTION 1 . That the special election for the purpose of submitting to the voters of the City of Huntington Beach the propositions hereinafter set forth was duly held on November 3, 1970 , and the votes cast at said election were duly and regularly canvassed, and the returns thereof made at the time and in the form and manner required by law. SECTION 2 . That the propositions voted upon at said elec- tion were numbered "K, " "L, " "M, " and "N" and were as follows, to wit : CHARTER AMENDMENT K: Shall the Charter be amended to pro- vide for an elective mayor, and that all departments , boards and commissions be established by ordinance, and requiring com- 2 . pensation for councilmen be set by public hearing and ordinance? SECTION 3 . That all ballots cast , including the absentee ballots cast , have been duly canvassed and counted as required by law, and the result of such count is hereinafter stated. That this City Council does hereby accept the canvass of the returns of said election, as made by the Registrar of Voters of the County of Orange, and certified by the Registrar of Voters of said county, in his letter dated November 25, 1970, with a total count for all precincts established in the City of Huntington Beach, including all absentee ballots cast in said precincts, being as follows : PROPOSED CHARTER AMENDMENT K YES VOTES - 16, 060 NO VOTES - 16,230 PROPOSED CHARTER AMENDMENT L YES VOTES - 233635 NO VOTES - 8,319 PROPOSED CHARTER AMENDMENT M YES VOTES - 18,951 NO VOTES - 11, 589 PROPOSED CHARTER AMENDMENT N YES VOTES - 22,137 NO VOTES - 8,907 3 . SECTION 4 . That the votes of a majority of all the electors voting on Proposition "K" at said election were cast against the adoption of said Proposition "K, " and said Proposition "K" is hereby declared to be defeated. SECTION 5. That the votes of a majority of all the electors voting on Proposition "L" at said election were cast for the adoption of said Proposition "L, " and said Proposition "L" is hereby declared to be adopted. SECTION 6. That the votes of a majority of all the electors voting on Proposition "M" at said election were cast for the adoption of said Proposition "M, " and said Proposition "M" is hereby declared to be adopted. SECTION 7 . That the votes of a majority of all the electors voting on Proposition "N" at said election were cast for the adoption of said Proposition "N, " and said Proposition "N" is hereby declared to be adopted. PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California at a regular meeting thereof held on the 7th day of December, 1970 .
